Off-Street Parking

§ 475-122 General off-street parking standards. [1]

General applicability: For all buildings and uses established after the effective date of this section, off-street parking shall be provided as required in this article, prior to issuance of a certificate of occupancy. For buildings and uses that were established prior to the effective date of this Ordinance, compliance with the parking requirements at the time of issuance of the building permit shall be required.
Change in use or intensity: Whenever the use of a building, structure, or lot is changed, parking facilities shall be provided as required by this section for the new use, regardless of any variance that may have been in effect before change of use. If the intensity of use of any building, structure, or lot is increased through the addition of dwelling units, increase in floor area, increase in seating capacity, or through other means, additional off-street parking shall be provided for such increase in intensity of use.
Additional off-street parking, maximum parking: Nothing in this section shall be deemed to prevent the voluntary establishment of off-street parking facilities to serve an existing use of land or buildings, or to prevent the provision of additional parking facilities beyond what is required by the section, provided all such parking is in conformance with the regulations herein. Except for single-family detached residential uses, any person proposing the provision of greater than 125% of the minimum required off street parking as specified in this Article shall demonstrate to the Planning Commission sufficient justification for the additional parking.
Review procedures: Compliance with the requirements in this article shall be subject to site plan review and approval by the Planning Commission. A parking plan, as part of a site plan review by the Planning Commission, shall not be required if one of the following criteria is met:
Single and two-family residential dwellings.
Sites that have 10 or fewer required parking spaces, based on the Minimum Required Parking Table (Table X-X).
Location: Off-street parking shall be located on the same lot or parcel as the building or use being served, or within 300 feet of the building it is intended to serve (as measured from the nearest point of the building to the nearest point of the parking).
Residential parking: Off-street parking spaces in single-family residential districts shall consist of a parking strip, driveway, garage, or combination thereof, and shall be located on the premises they are intended to serve. No parking shall be permitted on a lawn or other unpaved areas on residential lots.
Storage and repair prohibited. The storage of merchandise, sale of motor vehicles, storage of inoperable vehicles, or repair of vehicles are prohibited in required off-street parking lots or areas. Emergency service required to start vehicles shall be permitted.
Banked parking: If the minimum number of required parking spaces exceeds the amount necessary to serve a proposed use, the Planning Commission may approve the construction of a lesser number of parking spaces.

§ 475-124 Provision of parking space; manner and location.

Parking space shall be provided in the manner and location specified in this section:
No parking area, parking space or loading space which exists at the time this article becomes effective or which subsequent thereto is provided for the purpose of complying with the provisions of this article shall thereafter be relinquished or reduced in any manner below the requirements established by this article, unless additional parking area or space is provided sufficient for the purpose of complying with the provisions of this article within 300 feet of the proposed or existing uses for which such parking will be available.
Parking of motor vehicles in residential zones shall be limited to passenger vehicles and not more than one commercial vehicle. The parking of any other type of commercial vehicle or buses, except for those parked on school property, is prohibited in a residential zone.
Motor vehicles parking and storage.
Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:
That area surfaced with concrete, asphalt, gravel or similar material leading from an approved and authorized curb cut to a garage, carport or approved parking space.
That area measured from the front lot line to the first supporting member of a structure. In the case of corner lots, the front yard shall be the area measured by the lot lines on each street to a depth measured from the lot lines to the first supporting member of the structure.
Any automobile, truck, trailer, motorcycle, boat or other motor-driven vehicle.
An area for the purpose of parking one automobile, having a minimum width of 10 feet and a minimum length of 22 feet, surfaced with concrete or asphalt, with access to a public street or alley.
An open space extending the full width of the lot between a building and the rear lot line.
An open space unoccupied and unobstructed between a building and the side lot line extending from the front yard to the rear yard.
Policy of section. In order to protect the public health, safety and general welfare, to enhance the visual environment of the Village and to preserve residential neighborhoods, the parking and storage of motor vehicles in certain areas is prohibited.
Parking. The parking, storage or leaving unattended of any motor vehicle in any front, side or rear yard in any residential district in the Village is declared to be a public nuisance and is hereby prohibited. All motor vehicles in residential zoned districts shall be parked in zoning-approved driveways or garages, provided such vehicles shall not be parked so as to obstruct sidewalks. A noncommercial trailer not exceeding eight feet by 16 feet, a boat or motorboat less than 21 feet in length, and nonmotorized portable living quarters not exceeding 28 feet may be parked or stored in the rear yard of residential zoned and/or used properties.
Enforcement of section. This section may be enforced by injunction, suit for damages or by any other appropriate remedy.
Definitions.
All vehicles and equipment constructed or used for transportation of goods, wares, materials, merchandise, and/or all other vehicles and equipment designed and used for drawing other vehicles or used in construction or landscaping, including dump truck, stake truck, tank truck, flatbed truck, step van, panel truck, wrecker, car hauler, truck tractor, construction and landscaping vehicles and equipment, sprayers, excavating equipment, logging vehicle, bulldozer, backhoe, front loader, bus, hearse, ambulance, or limousine. The determination whether other vehicles or equipment not specifically listed satisfy the definition of 'commercial vehicles and equipment' shall be made by the Village Zoning Administrator.

§ 475-125 Parking areas, spaces and lots.

Requirements for all parking areas, parking spaces and parking lots are as follows:
Each automobile parking space shall be not less than 180 square feet nor less than nine feet wide, exclusive of driveway and aisle space.
Surfacing and drainage.
All off-street parking areas, access lanes, driveways and other vehicle maneuvering areas shall be hard-surfaced with concrete or plant-mixed bituminous material. Porous paving materials may be permitted at the discretion of the Planning Commission, provided that installation and maintenance plans are in accordance with the manufacturer's guidelines. A written maintenance plan must be submitted for the Planning Commission's review.
The Planning Commission may permit a gravel surface for heavy machinery storage areas, provided the applicant or property owner provides sufficient evidence that a paved surface could not support the heavy machinery without being damaged and dust control is provided to the satisfaction of the Township.
Off-street parking areas, access lanes, and driveways shall be graded and drained so as to dispose of surface waters. Surface water shall not be permitted to drain onto adjoining property, unless under an approved drainage plan.
Grading, surfacing and drainage plans shall be subject to review and approval by the Building Official and/or Village Engineer. Where appropriate, on-site stormwater management shall be provided to 1) capture and hold water during storms to be released later at an agricultural rate, and 2) to screen pollutants so they do no enter lakes, streams, wetlands, or other bodies of water.

Off-street parking facilities in nonresidential zones shall be effectively screened on any side which adjoins or faces property in any residential zone by a wall, fence or compact planting not less than four feet or more than eight feet in height. Plantings shall be maintained in good condition and not encroach on adjoining property. Screening shall not be so placed or maintained as to provide a traffic hazard through obstruction of visibility.
All off-street parking areas that make it necessary for vehicles to back out directly into a public road are prohibited, provided that this prohibition shall not apply to off-street parking areas of one- or two-family dwellings.
Space for all necessary loading and unloading operations for any commercial, industrial or other use must be provided in addition to the required off-street parking space. Each loading space as required, shall be a minimum of 10 feet in width and 40 feet in length, with a vertical clearance of 15 feet. Loading and unloading operations may be carried out within proximity of the use it serves and shall not interfere with pedestrian or vehicular movements.
Requirements for the provision of parking facilities with respect to two or more property uses of the same or different types may be satisfied by the permanent allocation of the requisite number of spaces for each use in a common parking facility, cooperatively established and operated, provided that the number of spaces designated is not less than the sum of individual requirements; and provided, further, that the specifications in regard to location, plan, etc., are complied with.
The number of parking spaces required for land or buildings used for two or more purposes shall be the sum of the requirements for the various individual uses, computed in accordance with this section. Parking facilities for one use shall not be considered as providing the required parking facilities for any other use.
