48 Planned Marine And Recreation Zone M-P

16.48.010 Uses Permitted Outright

In an M-P zone, the following uses and their accessory uses are permitted outright, subject to the applicable provisions of Chapters 16.72, 16.76, 16.80 and 16.96 of this title:

  1. Boat launching, marine ways;
  2. Moorage facilities;
  3. Marina;
  4. Dry dock facilities for boat repair and maintenance;
  5. Laboratory for experiment or research of marine life;
  6. Marine loading and unloading facilities;
  7. Owner/Manager residence.

16.48.020 Conditional Uses Permitted

In an M-P zone, the following uses and their accessory uses may be conditionally permitted subject to the applicable provisions of Chapters 16.72, 16.76, 16.80, 16.84 and 16.96 of this title:

  1. Restaurant;
  2. Seafood market;
  3. Commercial fishing gear storage;
  4. Boat storage;
  5. Recreational vehicle park;
  6. Public park, playground or similar recreation area;
  7. Bait and tackle shop;
  8. Marine fuel sales;
  9. Boat charter services; and
  10. Marine supply sales.

16.48.030 Standards

In addition to standards required in Chapters 16.72, 16.76, 16.80, 16.84 and 16.96 of this title, in the M-P zone, the following standards shall apply:

  1. Yards. All yards abutting a residential zone shall be a minimum of twenty (20) feet.
  2. Setbacks. No structure shall be located closer than thirty (30) feet from the right of way of any State highway or any collector or arterial street.
  3. Height. No building in the M-P zone shall exceed a height of forty-five (45) feet.
  4. Fencing. Outdoor storage abutting or facing a street, highway or a residential zone shall be screened with a sight-obscuring fence or a buffer strip of vegetation.

16.48.040 Special Standards

In taking action on a conditional use application, the Planning Commission shall determine that:

  1. The conditional use does not preempt any water-dependent outright uses from direct access to the estuarine waters; and
  2. The conditional use is compatible with an established water-dependent use or is requested in conjunction with a proposed outright use.
