A. Continuance Of Use Of Nonconforming Buildings: Any building arranged, intended or designed for a nonconforming use, the construction of which has begun but not been completed at the effective date hereof may be completed and used for the nonconforming use, provided it is completed and so used within one year after the effective date hereof.
B. Repairs, Alterations Or Enlargements: Ordinary repairs and maintenance shall be permitted; however, a building or structure devoted to nonconforming use at the effective date hereof may not be altered or enlarged so as to extend the nonconforming use nor may the use be enlarged in any other way.
C. Damaged Buildings: A nonconforming building which has been damaged by fire, explosion, act of God or public enemy, to the extent of more than sixty percent (60%) of its reproduction value, as determined by the county at the time of damage, shall not be restored except in conformity with regulations of the zone in which it is located. When damaged to less than sixty percent (60%) of its reproduction value, a nonconforming building may be repaired or reconstructed and used as before the time of damage, provided such repairs or reconstruction are completed within one year of the date of such damage. 5-10-2: NONCONFORMING USES:
A. Continuance Or Discontinuance Of Nonconforming Use: A lawful nonconforming use existing at the effective date hereof may be continued; except, that if it is voluntarily discontinued for a period of one year or more, it shall then be deemed abandoned, and unless an extension is granted by the commission, any further use must be in conformity with the uses permitted in such zone.
B. Change Of Use: A nonconforming use shall not be changed to a use of lower or less restrictive classification. Such nonconforming use may, however, be changed to another use of the same or higher classification upon a special use permit approved by the board. (Ord. 51, 9-2-2003)
