CHAPTER 3

GENERAL ZONING PROVISIONS; ZONING MAP

5-3-1: ZONES AND BOUNDARIES:

The boundaries of each zone are shown on the official zoning map on file in the office of the administrator and designated by ordinance on file in the office of the county clerk and on said map by use of the following colors:
A1    Agricultural: no color
A2    Agricultural transitional: red
C1    Commercial: yellow
C2    Commercial: orange
D1    Light industrial: light brown
D2    Heavy industrial: dark brown
R    Recreation: blue

5-3-2: MINIMUM YARD AREA:

   A.   In zone A2, each building or structure shall be required to have side yards of at least ten feet (10') and a rear yard of at least thirty feet (30').
   B.   In zones A1, C1, C2, D1 and D2, no side yard or rear yard is required except where the lot adjoins a residential A2 zone, in which case, a side yard of not less than ten feet (10') is required and a rear yard of thirty feet (30') is required.
   C.   If there is no minimum yard requirement or if the minimum yard requirement is less than the minimum setback requirements, the setback requirement shall be controlling.
   D.   For purposes of determining the minimum rear yard, the rear yard may be measured to the centerline of an alley abutting the rear property line. (Ord. 51, 9-2-2003)

5-3-3: MAXIMUM HEIGHT OF BUILDINGS AND STRUCTURES:

The following shall be the maximum permissible heights of buildings and structures in the below listed zones; provided, however, that towers and similar structures may be exempted from the below listed requirements by special permits, which may be obtained from the commission:
   A.   Zone A1: Thirty five feet (35').
   B.   Zone A2: Thirty five feet (35').
   C.   Zone C1: Thirty five feet (35').
   D.   Zone C2: Forty five feet (45').
   E.   Zone D1: One hundred feet (100').
   F.   Zone D2: One hundred feet (100'). (Ord. 51, 9-2-2003)

5-3-4: SETBACK BUILDING LINES:

   A.   In zones A1 and A2, no dwelling or structure or any portion thereof, except steps and uncovered porches less than ten feet (10') in width, shall be erected within fifteen feet (15') of the property boundary lines or within fifteen feet (15') of the street right of way or within one hundred feet (100') of any state or federal highway. Prior to any development it shall be the property owner’s responsibility to determine the street right of way width for any street adjacent to the proposed development. Prescriptive right of way shall be used if there is no recorded street right of way width. No farm or ranch buildings shall be erected within fifteen feet (15') of the property boundary lines or within fifteen feet (15') of the county road right of way or within one hundred feet (100') of any state or federal highway. Prior to any development it shall be the property owner’s responsibility to determine the street right of way width for any street adjacent to the proposed development. Prescriptive right of way shall be used if there is no recorded street right of way width.
   B.   In zones C1, C2, D1 and D2, no building or structure or any portion thereof, except steps and uncovered porches less than ten feet (10') in width, shall be erected within five feet (5') of the property boundary lines or within forty feet (40') of the street right of way or within one hundred feet (100') of any state or federal highway. If the property adjoins zone A1 or A2, no structure shall be placed within fifteen feet (15') of the property line or forty feet (40') from a county road or one hundred feet (100') from a state or federal highway.
   C.   Frontage requirements are as follows:
      1.   Zones A and R: No frontage requirements.
      2.   Zone C1: Thirty five feet (35').
      3.   Zone C2: Thirty five feet (35').
      4.   Zone D1: Fifty feet (50').
      5.   Zone D2: Fifty feet (50').

5-3-5: RIGHTS OF WAY:

   A.   Streets:
      1.   All streets and rights of way shall be developed in accordance with the highway standards and development procedures for the Weiser Valley highway district and Washington County, Idaho, and the latest adopted version of the Washington County road and bridge transportation master plan.
   B.   Private Roads:
      1.   All private roads shall have a recorded, permanent, perpetual easement and permanent Road Users' Association maintenance agreement sufficient to provide operational and year round emergency access as required by the emergency service providers (i.e., fire district, ambulance district, QRU, etc.). In the event there are conflicting standards between emergency service providers, the most stringent standard shall govern. (Ord. 77, 12-29-2014)

5-3-6: PARKING FACILITIES:

All parking facilities and requirements shall conform with chapter 12 of this title. (Ord. 51, 9-2-2003)

5-3-7: ZONING MAP; ZONE DESCRIPTIONS:

This title shall consist of its text and the official zoning map, which shall be designated as the Washington County zoning map and is hereby adopted by the board as part of this title. If there is a discrepancy between the written description of the zones and the zoning map, the written description shall determine the boundary of the zone. (Ord. 51, 9-2-2003)
