CHAPTER 18

ENFORCEMENT

5-18-1: METHODS OF ENFORCEMENT:

The provisions of this ordinance shall be enforced by the following methods:
   (A)   Requirement of a building permit;
   (B)   Inspection and ordering removal of violations;
   (C)   Criminal liability;
   (D)   Injunction. (Ord. 534-2018, 2-15-2018)

5-18-2: BUILDING PERMIT:

No building shall be erected, moved or structurally altered unless a building permit has been approved issued, and signed by an authorized representative of the City of Wendell and the building inspector. All permits shall be in conformance with the provisions of this ordinance and shall be valid for a period of time not exceeding one year from the date of issue. (Ord. 534-2018, 2-15-2018; amd. 5-18-3: INSPECTION:

The City of Wendell, building inspector or their representatives are hereby empowered to cause any building, other structure or tract of land to be inspected and examined, and to order in writing the remedying of any condition found to exist therein or thereat in violation of any provisions of this ordinance. After any such order has been served, no work shall proceed on any building, other structure or tract of land covered by such order, except to correct or comply with such violation. 5-18-4: CRIMINAL LIABILITY:

A person shall be guilty of a misdemeanor in any case where:
   (A)   Any violation of any of the provisions of this ordinance exists in any building or any other structure or on a tract of land;
   (B)   An order to remove any such violation has been served upon the owner, general agent, lessee or tenant of the building, other structure or tract of land (or any part thereof), or upon the architect, building, contractor or any other person who commits or assists in any such violation; and
   (C)   Such person shall fail to comply with such order within ten days after service thereof. (Ord. 534-2018, 2-15-2018)

5-18-5: INJUNCTION:

In addition to any of the foregoing remedies, the City Attorney, acting in behalf of the City Council may maintain an action for an injunction to restrain any violation of this title. (Ord. 534-2018, 2-15-2018)

5-18-6: PENALTY:

Any person, firm or corporation violating any provisions of this title, upon conviction thereof, shall be fined in accordance with Idaho State Code for each offense, or by imprisonment in the County jail for a period of not more than thirty (30) days, or by both such fines and imprisonment. Each day during which the illegal erection, construction, alteration, maintenance or use continues may be deemed a separate offense. (Ord. 534-2018, 2-15-2018)
