CHAPTER 17

32 - PARKING REGULATIONS

17.32.010 - Applicability of chapter.

The regulations of this chapter shall be part of the regulations in each district insofar as any use referred to in this chapter is a permitted use in a district.

17.32.020 - Two-family dwellings.

Whenever a structure is erected, converted, enlarged or structurally altered for two-family dwelling use, not less than two hundred square feet of all-weather surfaced parking space or garage space for each dwelling unit in the building shall be provided during the existence of the use, on the lot or on an adjoining lot, together with adequate ingress and egress from and to the public street, highway or alley. Such surfaced parking space or garage space shall be for the sole use of the occupants of such building and visitors thereto. The surfaced parking space may be in a required rear yard.

17.32.030 - Multiple-family dwellings.

Whenever a building or part thereof is erected, converted, enlarged or structurally altered for multiple-family dwellings, apartments or group or rowhouses for more than two-family units, not less than two hundred square feet of permanent surfaced parking space or garage space for each dwelling unit shall be provided, during the existence of the use, on the lot or on an adjoining lot, together with adequate ingress and egress from and to the public street, highway or alley. Such surfaced parking space shall be for the sole use of the occupants of such building or buildings and visitors thereto. The surfaced parking space may be in a required rear yard.

17.32.040 - Motels, hotels and rooming houses.

Whenever a building is erected, converted, enlarged or structurally altered for use as a motel, hotel, apartment hotel, boarding or rooming house, or tourist home, not less that two hundred square feet of all-weather surfaced parking space or garage space for each three guestrooms shall be provided, during the existence of the use, on the lot, or within three hundred feet thereof, together with adequate ingress and egress from and to the public street, highway or alley. Such surfaced parking space shall be for the sole use of the occupants of the building, guests thereof and visitors thereto. The surfaced parking space may be in a required rear yard.

17.32.050 - Hospitals.

Whenever a building is erected, converted, enlarged or structurally altered for a hospital or sanitarium, not less than two hundred square feet of all-weather surfaced parking space shall be provided, during the existence of the use, on the lot or within three hundred feet thereof, for each three hundred square feet of sleeping room area for patients, together with adequate ingress and egress from and to the public street, highway or alley. Such parking space shall be for the sole use of the occupants of the building and visitors thereto. Such parking space may be in a required rear yard.

17.32.060 - Theaters and places of assembly.

Whenever a building or part thereof is erected, converted, enlarged or structurally altered for a theater, auditorium or place of amusement or of assembly, there shall be provided, during the continuance of the use, not less than two hundred square feet of all-weather surfaced parking space on the lot or within three hundred feet thereof, for each five seats or similar vantage accommodations provided in such building, together with ingress and egress from and to the public street, highway or alley; provided, however, that an outdoor theater shall provide two hundred square feet of surfaced parking space adjacent to the enclosure and to the public street or highway and outside the enclosure and off the street or highway for each two automobile spaces within the enclosure; and provided further, that in the B-1 districts the parking regulations for such uses shall be as required by Section 17.16.020.

17.32.070 - Commercial uses in B-1 districts.

Whenever any building is erected, converted or structurally altered for a commercial or private service or professional use in a B-1 district, not less than two hundred square feet of surfaced parking space shall be provided, during the existence of the use, on the lot or on an adjacent lot for each two hundred square feet of floor space in the building, except that any restaurant or establishment whose primary use is to serve meals or refreshments to patrons, shall provide two hundred square feet of permanent surfaced parking space on the same or adjacent lot for each one hundred square feet of floor space in the building. Two or more commercial establishments may provide the respective necessary permanent surfaced parking spaces upon a single lot in the B-1 district and within three hundred feet of both establishments. There shall be provided a tight evergreen hedge or a masonry or stone wall not less than five feet in height along each side of the required rear yard.

17.32.080 - Use of off-street parking commission facilities.

In the B-1 district, parking facilities operated by the West Frankfort off-street parking commission, when they fall within the required distance, may be used to satisfy the parking requirements.

17.32.090 - Use of off-street parking in a residential district for the home occupation/profession.

Off-street parking is permitted for vehicles of the owners, employees and business invitees of the home occupation/profession on the street(s) immediately bordering the owner's lot line(s), unless otherwise prohibited.

17.32.100 - Additional parking regulations for vehicles and recreational vehicles.

A.

Definitions.

1.

"Boulevard" means grassy area located between the public sidewalks and the city streets.

2.

"Deterioration" means any preventable decrease in the condition, quality, of functionality of property.

3.

"Easement" means an interest in land owned by another that entitles its holder to a specific limited use or enjoyment, this refers to the easements held by the city of West Frankfort for the maintenance of their utilities, public works, and sidewalks.

4.

"Public sidewalk" means a paved walk for pedestrians that was installed and is maintained by the city of West Frankfort.

5.

"Shoulder" means an edge of the a street or roadway outside of the traveled roadway.

6.

"Special events" includ[es], but [is] not limited to: City-wide events that are not otherwise regulated; events which have been approved for permits by the city; school events including athletic and extracurricular events; church services and events; and extenuating circumstances that exceed a business's designated parking such as services at funeral homes.

B.

Parking on streets. No person shall park any vehicle, trailer, recreational vehicle, or any other motorized device upon any street, alley, or along any curb within the city.

Exceptions:

1.

Vehicles parked within clearly indicated parking spaces provided by the governing street department.

2.

Emergency and government vehicles.

3.

Vehicles engaged in the loading/unloading of items for a business and or construction materials.

4.

Vehicles engaged in the maintenance or construction of utilities.

5.

Vehicles parked along street edges/curbs for the purpose of temporary parking to attend a city approved special event, provided the parking does not render the street impassable to emergency vehicles.

6.

Temporary parking on streets with a shoulder shall not exceed a two-hour limit unless prior approval is granted by the city of West Frankfort.

Violations under this [sub]section shall take effect immediately upon passage of the ordinance.

C.

Parking at easements, boulevards, and sidewalks. No person shall park a vehicle or recreational vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device, in the following places:

1.

In, on, along or over any easement for public utilities

2.

Between the sidewalk and the curb, or the edge of the paved portion of the public right-of-way where curbs do not exist.

3.

Across or on any public sidewalk

4.

Upon any city boulevard

5.

In, on, along or over any drainage ditch, stormwater drain, city water meter well, sewer access or other city-maintained property.

Violations under this [sub]section shall take effect immediately upon passage of the ordinance from which this section is derived.

D.

Parking on lawns.

1.

Except as provided in division 2, it shall be unlawful to park any vehicle on any property, including lawns, fields, grassy areas or any other location within the city not designed, permanently improved, primarily used and approved for parking by the city Of West Frankfort.

a.

Approved surfaces for parking shall include concrete, asphalt, and rock which is maintained to be free of weeds and deterioration.

2.

As a result of a city approved special event, temporary parking on lawns conducted by a registered or charitable organization or the property owner, subject to the following conditions:

a.

Temporary parking shall not exceed four days;

b.

No temporary parking is allowed on any property in a residentially zoned district, except on fully improved, owner-occupied lots;

c.

This excludes any properties subject to current or pending actions, including, but not limited to, foreclosure and liens.

3.

Violations under this [sub]section are enforceable one year from the passage of the ordinance from which this section is derived to give the citizens of West Frankfort time to be in compliance with the requirements of this section. This [sub]section of the section will be enforceable beginning May 28, 2025.

E.

Parking and storage of recreational vehicles.

1.

No recreational vehicle may be parked on any street, alley, public parking lot or public way. Recreational vehicles parked in a front private driveway shall not be parked in excess of forty-eight continuous or uninterrupted hours in any seven-day period. No recreation vehicle may be stored or parked on private property within a residentially zoned area in excess of forty-eight continuous or uninterrupted hours unless such vehicle is parked on an improved parking surface, is not located in any front, side or rear setback as defined by the zoning code, and is no less than three feet behind the front wall, as extended, of the primary structure of the lot.

2.

For the purpose of this section, "recreational vehicles" includes, but is not limited to, every camping trailer, motor home, mini motor home, travel trailer, truck camper, boat, boat trailer, snowmobile, snowmobile trailer, van camper, utility trailer, atv, golf cart, or any other vehicle including air, land or watercraft used primarily for recreational purposes and not used commercially nor owned by a commercial business.

3.

Violations under this section shall take effect immediately upon passage for the requirement to not park on any street, alley, public parking lot or public way.

4.

Violations under this [sub]section are enforceable one year from the passage of the ordinance from which this section is derived to give the citizens of West Frankfort time to be in compliance with the requirements of this section to be parked in only in approved parking areas and not be parked in front of a residence for in excess of forty-eight continuous or uninterrupted hours. This [sub]section of the section will be enforceable beginning May 28, 2025.

F.

Parking along parade routes.

1.

No person shall park a vehicle along or within any parade route within three hours of the start of any parade approved by the city of West Frankfort.

2.

Violation under this [sub]section shall take effect immediately upon passage of the ordinance from which this section is derived.

G.

Penalties.

1.

Any vehicle found to be parked on any street, alley, boulevard, utility easement, sidewalk, drainage ditch, stormwater drain, city water meter well, sewer access or other city-maintained property may be removed and stored at the request of city of West Frankfort police officers, firefighters, EMS personnel, codes officer or public works personnel.

2.

All other violations of this chapter shall be subject to a fine of not less than one hundred dollars nor more than seven hundred fifty dollars. Each day the violation continues shall constitute a separate offense.

3.

Any damage to sidewalks or boulevards caused by a violation of these code sections shall be punishable by the cost of materials and repairs for any damage shown by the city of West Frankfort, in addition to any other penalties assessed.
