ARTICLE I

- STATUTORY AUTHORITY AND PURPOSE

Sec. 98-1.- Authority.

These regulations are adopted under the authority granted by Wis. Stats. §§ 61.35, 61.354, and 62.23(7). Therefore, the Village Board of The Village of West Milwaukee, Wisconsin do ordain as follows.

Sec. 98-2. - Purpose.

The purpose of this chapter is to promote the health, safety, morals, prosperity, aesthetics, and general welfare of this community.

Sec. 98-3. - Intent.

It is the general intent of this chapter to regulate and restrict the use of all structures, lands, and waters; and to:

(1)

Regulate lot coverage and the size and location of all structures so as to prevent overcrowding and to provide adequate sunlight, air, sanitation, and drainage;

(2)

Regulate population density and distribution so as to avoid sprawl or undue concentration and to facilitate the provision of adequate public services and utilities;

(3)

Regulate parking, loading and access so as to lessen congestion in and promote the safety and efficiency of the streets and highways;

(4)

Secure safety from fire, flooding, panic, pollution, contamination, and other dangers;

(5)

Prevent and control erosion, sedimentation, and other pollution of the surface and subsurface waters;

(6)

Further the maintenance of safe and healthful water conditions;

(7)

Protect the traffic-carrying capacity of existing and proposed arterial streets and highways;

(8)

Stabilize and protect existing and potential property values;

(9)

Further the appropriate use of land, protection of water quality, and conservation of natural resources;

(10)

Preserve and protect the beauty of the community;

(11)

Facilitate the use of solar energy devices and other innovative development techniques;

(12)

Implement those municipal, county, watershed, and regional comprehensive plans or plan components adopted by the Village of West Milwaukee;

(13)

Provide for the administration and enforcement of this chapter and to provide penalties for its violation.

Sec. 98-4. - Abrogation and greater restrictions.

It is not intended by this chapter to repeal, abrogate, annul, impair, or interfere with any existing easements, covenants, deed restrictions, agreements, ordinances, rules, regulations, or permits previously adopted or issued pursuant to laws. However, wherever this chapter imposes greater restrictions, the provisions of this chapter shall govern.

Sec. 98-5. - Interpretation.

In their interpretation and application, the provisions of this chapter shall be held to be minimum requirements and shall be liberally construed in favor of the Village and shall not be deemed a limitation or repeal of any other power granted by the Wisconsin Statutes. All words and phrases shall have their customary dictionary meaning unless otherwise defined in Article XIV of this chapter, in which case the word shall have the meaning contained therein.

Sec. 98-6. - Severability.

If any section, clause, provision, or portion of this chapter is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this chapter shall not be affected thereby.

Sec. 98-7. - Repeal.

All other ordinances or parts of ordinances of the Village inconsistent or conflicting with this chapter, to the extent of the inconsistency only, are hereby repealed.

Sec. 98-8. - Title.

This chapter shall be known as, referred to, or cited as the "Zoning Ordinance, Village of West Milwaukee, Milwaukee County Wisconsin."

Sec. 98-9. - Effective date.

This chapter shall be effective after a public hearing, adoption by the Village Board of Trustees, and publication or posting as provided by law.
