CHAPTER 1121

Establishment of Districts and Maps

1121.01 PURPOSE.

   The purpose of this chapter is to establish zoning districts in order to realize the general purposes set forth in this Code, to provide for orderly growth and development, and to protect the property rights of all individuals by assuring the compatibility of uses and practices within districts.

1121.02 ESTABLISHMENT OF DISTRICTS.

   For the purposes of this Planning and Zoning Code the following classifications of districts are hereby established in the City:

1121.03 ESTABLISHMENT OF ZONING MAP.

   The districts established in Section 1121.02 are shown upon the Zoning Map, which, together with all accompanying notations, references, rules and designations, is hereby adopted and made a part of this Planning and Zoning Code, thereby having the same force and effect as if herein fully described in writing. The map is entitled "Zoning Map of the City of Willoughby" and, with all its future additions, amendments, changes and supplements, designates the area assigned to the respective use districts and their boundaries. The map shall indicate the approval of the Commission and adoption by Council. The map, or print thereof, on file in the office of the Building and Zoning Inspector shall be the final authority as to the current Zoning Map districts. A Zoning Map amendment shall not become effective until such amendment and entry have been made on such map.

1121.04 DISTRICT SYMBOLS.

   The several districts may be designated upon the Zoning Map by use of the respective symbols used in Section 1121.02. Whenever the abbreviated terms R-100, R-80, R-60, etc., are used in this Planning and Zoning Code, the abbreviated term shall be construed as referring to the corresponding district titles as set forth above.

1121.05 INTERPRETATION OF DISTRICT BOUNDARIES.

   The following rules shall be used to determine the precise location of any zoning district boundary when there is a discrepancy or uncertainty as to the precise location of the boundary:
(a)   Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries;
(b)   Where district boundaries are so indicated that they are approximately parallel to the center lines or right-of-way lines of streets, or the center lines or right-of-way lines of highways, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as indicated on the Zoning Map. If no distance is given, such dimensions shall be determined by the use of the scale shown on the Zoning Map;
(c)   Where a district boundary line is shown by dimensions or relationship as being located a specific distance from and parallel to a street or property line, such distance shall control;
(d)   Where a district boundary line is shown as adjoining a railroad, it shall, unless otherwise fixed, be construed to coincide with the nearest boundary line of the railroad right-of-way;
(e)   Where a district boundary line divides a parcel of land, the location of such boundary, unless related to fixed points on the property boundary, shall be determined by scale, and the parts of the lot shall comply with the regulations of the district in which each part is located;
(f)   Where a district boundary line does not coincide with any of the aforesaid lines, and where it is not located by dimensions or fixed points shown on the map, it shall be determined by the scale appearing thereon;
(g)   Whenever any street, alley, or other public way is vacated by official Council action, the zoning district adjoining each side of such street, alley, or public way shall automatically be extended to the center of such vacation, and all areas within that vacation shall thenceforth be subject to all regulations appropriate to the respective extended district.
(h)   All questions and disputes concerning the exact location of zoning district boundaries shall be resolved by the Board of Zoning Appeals.

1121.06 ANNEXATION OF NEW TERRITORY.

   Any territory which may hereafter be annexed to the City shall be zoned to the R-100 District and shall be subject to all the regulations of this Planning and Zoning Code which relate to such a district until amended in conformance with the procedures outlined in this Planning and Zoning Code.
