CHAPTER 1137

Manufactured Home Park District

1137.01 PURPOSE.

   The provisions of this chapter provide for the regulation of existing manufactured home parks in order to ensure their continual maintenance as an integral and stable part of the community. (Ord. 2020-21. Passed 2-18-20.)

1137.02 DEFINITIONS.

   (a)   "Manufactured Home Park" means any tract of land upon which three or more manufactured homes used for habitation are parked, either free of charge or for revenue purposes, and include any roadway, building, structure, vehicle, or enclosure used or intended for use as a part of the facilities of such park. A tract of land which is subdivided and the individual lots are not for rent or rented, but are for sale or sold for the purpose of installation of manufactured homes on the lots is not a manufactured home park even though three or more manufactured homes are parked thereon if the roadways are dedicated to the City. "Manufactured Home Park" does not include any tract of land used solely for the storage or display for sale of manufactured homes.
   (b)   "Manufactured Home" means any non-self-propelled vehicle transportable in one or more sections which, in the traveling mode, is eight body feet or more in width or forty body feet or more in length, or, when erected on site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein.

1137.03 PERMITTED USES.

   Structures or land within a Manufactured Home Park District shall be used, and structures shall hereafter be erected, altered, enlarged, repaired or rebuilt, moved, or designed to be used, stored or installed upon property within such Districts only in accordance with the rules and regulations contained in this chapter. Permitted uses shall be as follows:
(a)   Manufactured homes or house trailers, sanitary and laundry facilities and other service buildings, not constituting commercial enterprises;
(b)   Management and sales offices, provided that such offices only pertain to the management of the manufactured home park and such sales offices are confined only to the sales of manufactured homes within the associated manufactured home park and no other products or vehicles.
(c)   No manufactured home or house trailer shall be used to provide the occupancy of more than one family and no mobile home or house trailer designed for occupancy by more than one family shall be permitted to remain on any house trailer lot within the City unless the same is remodeled or modified to provide for the occupancy of only one family.

1137.04 GENERAL STANDARDS FOR MANUFACTURED HOME PARKS.

   Each manufactured home park development shall comply with the following development standards:
(a)   The park shall be served adequately by essential services, provided either publicly or privately, such as highways, streets, drainage, refuse disposal, schools, police and fire protection; and
(b)   The vehicular approaches to the park property shall be so designed as not to create traffic interference or congestion on surrounding public streets or roads.

1137.05 MANUFACTURED HOME PARK REQUIREMENTS.

   The Ohio Manufactured Homes Commission (OMHC) licenses and regulates the operation of manufactured home parks. All manufactured home parks shall comply with the requirements of Ohio Administrative Code Chapter 4781 and Chapter 4781 of the Ohio Revised Code.
