CHAPTER 1153

Limited Retail and Limited Industrial Overlay Districts

1153.01 PURPOSE.

   The purpose of the Limited Retail and Limited Industrial overlay zoning districts is to allow the City to establish special land use regulations in areas with land use, site planning, and/or building design issues. These overlay zoning districts are also an appropriate mechanism to implement the City's long-term economic development goals.
   (a)   The Limited Retail Overlay District is intended to be applied to areas of the City zoned Limited Industrial District (L-I) in order to allow additional, primarily retail/service uses in locations that are adjacent to existing G-B districts.
   (b)   The Limited Industrial Overlay District is intended to be applied to areas of the City zoned General Business District (G-B) in order to allow additional, primarily storage, distribution and limited industrial uses in appropriate locations.

1153.02 APPLICATION OF THE DISTRICTS.

   The Limited Retail and Limited Industrial Overlay Districts are overlay districts that, when applied, are in addition to and shall overlay the existing base zoning district where the Overlay District is established, so that any parcel of land lying in a Limited Retail Overlay District (LR-O) or a Limited Industrial Overlay District (LI-O) shall also lie in one or more of the other zoning districts provided for in this Code.
   The Planning and Zoning Code provisions of the underlying district(s) shall apply within the Overlay District for permitted and conditional uses enumerated in the underlying district, except where specifically modified or supplemented by provisions of the overlay district.
   Except as modified by the overlay zoning district, the provisions of the applicable base-zoning district shall apply to all development within the boundary of the designated area. If regulations conflict, the applicable overlay zoning district regulations shall prevail.

1153.03 ESTABLISHMENT AND DESIGNATION.

   A Limited Retail Overlay District and a Limited Industrial Overlay District shall be established in accordance with the required procedures for a Zoning Map amendment pursuant to Chapter 1121.03 and shall be applied in conjunction with base zoning districts. The boundaries of all Limited Retail (LR-O) and Limited Industrial (LI-O) Overlay Districts shall be indicated on the Official Zoning Map and the district designation of LR-O or LI-O, as appropriate, shall be superimposed over the existing zoning designations on the Zoning Map.

1153.04 LIMITED RETAIL OVERLAY DISTRICT (LR-OD) PERMITTED USES.

   Schedule 1153.04 enumerates those uses that may be located in a Limited Retail Overlay District as a matter of right as a principal use by right when denoted by the letter "P" provided that all requirements of other City Ordinances and this Planning and Zoning Code have been met. These uses shall be in addition to the uses permitted by right and conditionally permitted in the underlying district.
   (a)   A use listed in Schedule 1153.04 denoted by the letter "PS", is a use permitted by right as a principal use, and is subject to the supplemental use-specific regulations set forth in Chapter 1155.
   (b)   Reference to Use-Specific Regulations. The numbers contained in Schedule 1153.04 in the "Use-Specific Regulations Reference" column are references to additional standards and requirements that apply to the use type listed.

1153.05 LIMITED INDUSTRIAL OVERLAY DISTRICT (LI-OD) PERMITTED USES.

   Schedule 1153.05 enumerates those uses that may be located in a Limited Industrial Overlay District as a matter of right as a principal use and uses that may be located upon obtaining review and approval as a conditional use. These uses shall be in addition to the uses permitted by right and conditionally permitted in the underlying district.
   (a)   A use listed in Schedule 1153.05 shall be permitted as a principal use by right when denoted by the letter "P" provided that all requirements of other City Ordinances and this Planning and Zoning Code have been met;
   (b)   A use listed in Schedule 1153.05 shall be permitted as a conditional use when denoted by the letter "C", provided the Planning Commission first makes the determination that the requirements of Chapter 1155 have been met.
   (c)   Reference to Use-Specific Regulations. The numbers contained in Schedule 1153.05 in the "Use-Specific Regulations Reference" column are references to additional standards and requirements that apply to the use type listed.

1153.06 DEVELOPMENT STANDARDS.

   The development standards of the underlying zoning district shall apply to all new development, redevelopment and occupancy of uses permitted in the overlay zone, including but not limited to the minimum lot requirements, building and parking setbacks, landscaping requirements and sign regulations.
