An Airport District and its regulations are established in order to achieve, among others, the following purposes:
(a) To provide an Airport District at the location so designated on the Zone Map;
(b) To provide regulations for the height of structures;
(c) To improve the Airport District by permitting only those uses which are logical, necessary and beneficial to the optimum and safe operation of the airport facility;
(d) To permit as conditional uses certain additional types of principal uses which have the potential to enhance the Airport District, but which require additional development controls and requirements; and
(e) To promote the most desirable use of land in accordance with the Comprehensive Plan and to stabilize and enhance property values.

1149.02 PERMITTED USES.
Buildings and land shall be used, and buildings shall be designed, erected, altered, moved, or maintained, in whole or in part, in an Airport District only for a use specified herein as either a principal use, conditional use or accessory use.
(a)Principal Uses. The categories of principal uses (together with their accessory uses) permitted by right in the Airport District are as follows:
(1)Airport Uses.
A. Airport administration and control structures;
B. Passenger and freight terminals;
C. Aircraft sales, rental, repair, reconstruction, research and development;
D. Aircraft hangars;
E. Landing pads and runways, provided no new runways shall be constructed closer than 500 feet from the Airport District and/or airport property lines, and such limitation shall apply to new ramps and/or taxiways;
F. Aircraft fuel-handling facilities;
G. Aircraft handling, training and instruction; and
H. Communications center and weather bureau.
(2)Airport Related Uses.
A. Motels and hotels;
B. Restaurants and cocktail lounges, see also Section 1155.04(mm);
C. Offices;
D. Business equipment and supplies;
E. Service establishments, including post offices and package delivery services;
F. Auto rental establishments and associated parking lots; and
G. Certain retail uses targeted to airport employees, pilots and travelers, including, but not limited to, barber and beauty shops, gift, and tailor shops.
(3)Manufacturing Uses Permitted by Right in Limited Industrial (L-I) Districts.
(b)Conditional Uses. The following categories of conditional uses may (together with their accessory uses) be permitted, provided they conform to the conditions, standards and requirements of Chapter 1155 and are approved for a particular lot in accordance with the administrative provisions of Section 1109.05 and the requirements of this Chapter:
(1) Restricted industry related specifically to aircraft or air transportation;
(2) Wholesaling, and warehousing; and
(3) Laboratories and research facilities.
(4) Commercial facilities for indoor and outdoor recreation.
(5) Employer child care facility.
(6) Conditional uses in Limited Industrial (L-I) Districts, unless specifically permitted in subsection (a) above.
(c)Accessory Uses. Accessory uses and structures that are clearly incidental and subordinate to a permitted principal or conditional use, and located on the same lot as the principal or conditional use are permitted provided such accessory uses are intended to serve transient traffic and/or airport personnel, and shall include the following:
(1) Medical clinics, lunchrooms, cafeterias in association with a permitted use and located in the same building as the permitted use;
(2) Recreation facilities in association with a permitted use intended for use by employees or customers of the permitted use.
(3) Accessory garages and off-street parking areas;
(4) Signs;
(5) Trash receptacles; and

1149.03 PRINCIPAL BUILDING LOT AND YARD REQUIREMENTS FOR AIRPORT USES.
Airport uses, as described in Section 1149.02(a)(1), shall be located on a zoning lot in such a manner as to create and preserve a front yard adjacent to each street on which such lots abut, a side yard or yards and a rear yard conforming to the requirements of this section. Each yard shall be unobstructed by a principal use or principal building, except as otherwise provided in this Code.
(a) Front Yards. No building, parking area or structure shall be erected within sixty feet of any public right-of-way, except as set forth in Chapter 1163 for signs.
(b) Side and Rear Yards.
(1) Side and rear yards adjacent to any residential district shall have a width not less than fifty feet, of which twenty feet shall be designed and maintained as a landscaped buffer in accordance with a Section 1149.08.
(2) Side and rear yards adjacent to another nonresidential district shall have a width not less than twenty feet.

1149.04 PRINCIPAL BUILDING LOT AND YARD REQUIREMENTS FOR AIRPORT RELATED USES AND CONDITIONAL USES.
(a) Front Yards. No building, parking area or structure shall be erected within 100 feet of Lost Nation Road and Hodgson Road, and within sixty feet of any other public right-of-way, except as set forth in Chapter 1163 for signs.
(b) Side and Rear Yards. Side and rear yards shall be regulated as in Section 1149.03(b).
(c) Access Limitations. Access shall be provided from existing airport roads or from new roads which are part of an approved development plan.

1149.05 PARKING AND OUTDOOR ACTIVITY AREA SETBACK REQUIREMENTS.
Off-street parking and outdoor activity areas shall be located in compliance with the minimum setbacks, measured from the street right-of-way or property line, as specified in Sections 1149.03 and 1149.04, unless otherwise noted in this section.
(a) Off-street parking areas shall not be located in a required front yard.
(b) Outdoor Storage. No outdoor storage of goods, materials, products, equipment or waste shall be permitted within any required yard. All outdoor storage shall be screened according to the regulations set forth in Section 1179.02.

1149.06 HEIGHT REGULATIONS.
The height of any building or structure shall not exceed thirty-five feet, except that the necessary control tower and beacon light may be built to a height not to exceed seventy-five feet above the established airport elevation of 626 feet above sea level. Federal Aviation Administration (FAA) and the Ohio Department of Transportation, Division of Aviation guidelines and height limitations shall supersede the height regulations of this Zoning Code.

1149.07 ACCESSORY USE REGULATIONS.
Accessory uses, buildings and structures permitted in an Airport District shall conform to the regulations of this section.
(a)Waste Receptacles. All solid waste products resulting from any permitted principal, conditionally permitted or permitted accessory use shall either be disposed of or stored in buildings or completely enclosed containers. Such building, container or dumpster may be located in a side or rear yard and shall comply with the minimum parking setbacks established in Schedule 1149.05.
(b)Fences and Walls. Fences and walls may be erected in an Airport District provided they comply with the regulations of Section 1179.03.
(c)Off-Street Parking and Loading Regulations. Off-street parking and loading areas shall conform to the minimum parking setback requirements specified in Section 1149.05 and shall otherwise conform to the regulations of Chapter 1161. Garages shall conform to the yard requirements of Sections 1149.03 and 1149.04 as applicable, and the height regulation of Section 1149.06.
(d)Signs. Signs shall be in compliance with the regulations specified in Chapter 1163.
(e) Medical clinics, lunchrooms, cafeterias and recreational facilities which are accessory to a principal or conditional use, shall be completely enclosed in and accessed internally from the principal or conditional use.

1149.08 LANDSCAPING AND SCREENING REQUIREMENTS.
Landscaping and screening of uses in the Airport District shall be in accordance with the regulations of Section 1179.03.

Any new construction of a permitted principal, conditional, or accessory use, or any existing or previously approved development which proposes to expand the floor area, or any change in use which requires a modification in the amount of parking or the site's circulation requires the submission and approval of a development plan pursuant to Section 1109.04.
