The intent of the Commercial District (C-2) is to provide a commercial use other than the downtown main commercial district, without the large setbacks of a Highway Commercial District (C-1).
After the provisions relating to conditional uses have been fulfilled, the Board of Adjustment may permit as conditional uses in a Commercial District (C-2):
(A) Dwellings, single-family;
(B) Manufactured homes;
(C) Modular homes;
(D) Dwellings, multi-family, pursuant to R-3 lot square footage, yard and parking requirements.
In order to ensure that the zoning chapter will permit all similar uses in each district, the Board of Adjustment, upon its own initiative or upon written application and after review and recommendation of the Planning Commission, shall determine whether a use not specifically listed as a permitted, accessory or conditional use in a district shall be deemed a permitted, accessory or conditional use in one or more districts on the basis of similarity to uses specifically listed.
All uses and structures not specifically permitted as principal, accessory or conditional uses or approved as such within the provisions of § 154.264 shall be prohibited.
(A) The Commercial District (C-2) shall be exempt from yard requirements except where the district abuts a residential district.
(B) In such cases:
(1) There shall be an open space of not less than a depth of 20 feet as measured to the front building line;
(2) There shall be an open space of not less than a depth of six feet as measured to the rear building line except when bordering an alley; and
(3) (a) There shall be open spaces of not less than a depth of six feet, up to 20 feet on corner lots at the Board’s discretion, as measured from the side building lines.
(b) The Board shall base its determination upon the prevailing neighborhood patterns and public safety.
