B-1 RETAIL

BUSINESS DISTRICT

§ 154.085 STANDARDS.

   All buildings and uses hereafter established or enlarged in the B-1 Retail Business District shall conform to the following standards:
   (A)   No part of the first or ground floor of any building shall be used for residential purposes.
   (B)   All business establishments shall be retail or service establishments dealing directly with consumers. All goods produced on the premises shall be sold at retail on the premises where produced. Notwithstanding the foregoing, duly licensed recreational cannabis craft growers and recreational cannabis infuser organizations may produce products on the licensed premises for sale at other locations permitted by the Cannabis Regulation and Tax Act (P.A. 101-0027), consistent with any terms and conditions within the business’ applicable conditional use permit.
   (C)   All business, servicing, storage, and display of goods (except for off-street parking and loading) shall be conducted within completely enclosed buildings. As a function of a permitted use, outdoor cafe dining and beer gardens are permitted, subject to the regulations provided in § 110.25 and § 110.31 of this code.
   (D)   Exterior lighting fixtures shall be shaded wherever necessary to avoid casting direct light upon any property located in a residential district or upon any public street or park.
   (E)   All buildings, other structures, and uses shall be provided with a public sewer system or an approved substitute system that complies with the standards set by the state and the county. If an ordinance establishing more restrictive standards for such substitute systems has been adopted by the village, then any such substitute system shall comply with that ordinance.
   (F)   Only the following materials shall be allowed for exterior walls of buildings: brick, split-faced block, architectural concrete, synthetic plaster, stucco, wood or metal as a decorative element. The exterior walls of buildings shall not be constructed of corrugated metal, however corrugated painted metal may be used for awnings.
   (G)   All exterior mechanical equipment, transformers, satellite dishes and antennae and outside storage areas shall be screened from public view using one of the following methods:
      (1)   Screened by structure it serves. Mechanical equipment on or adjacent to a structure may be screened by a parapet or wall of sufficient height, built as an integral part of the structure.
      (2)   Designed as an integral part of the structure. If screening is impractical, mechanical equipment may be designed so that it is balanced and integrated with respect to the design of the
      (3)   Screen by another structure. Mechanical equipment installed on or adjacent to a structure may be screened by a fence, wall or similar structure. Such screening structure shall comply with the following standards:
         (a)   The required screening shall be permanently attached to the structure or the ground and shall conform to all applicable building code requirements.
         (b)   The required screening shall be constructed with materials that are architecturally compatible with the structure.
         (c)   Off-premise advertising signs and billboards shall not be considered required screening.
      (4)   Screened by vegetation. Mechanical equipment installed adjacent to the structure may be screened by hedges, bushes or similar vegetation.
   (H)   Dedicated pedestrian access shall be provided from the main entrance of any private building to the abutting public sidewalk along Sheridan Road.
   (I)   General landscaping standards shall be followed for all new developments and for alterations to existing facilities as outlined in Chapter 159 of the city code.

§ 154.086 PERMITTED USES.

   No building or use shall hereafter be established or enlarged within the B-1 Retail Business District, except for the following purposes:
   (A)   Apartments, located on the second floor above a permitted business use, provided that no new apartments may be constructed if the total number of multi-family units, such as apartments, motels and efficiency apartment units do not number more than 10% of the total number of single-family homes in the village.
   (B)   Banks and savings and loan associations.
   (C)   Barber shops.
   (D)   Beauty parlors.
   (E)   Book and stationery stores excluding any book or stationery store in violation of §§ 133.20 and 133.21.
   (F)   Candy and ice-cream stores.
   (G)   Department stores.
   (H)   Drug stores.
   (I)   Electrical and household appliance stores, including radio and television sales.
   (J)   Food stores, grocery stores, meat markets, fish markets, bakeries, delicatessens, and food lockers.
   (K)   Furniture stores.
   (L)   Garden supply and seed stores.
   (M)   Gift shops excluding any gift shop in violation of §§ 133.20 and 133.21.
   (N)   Hardware stores.
   (O)   Hobby shops.
   (P)   Laundry and dry-cleaning pick-up stations.
   (Q)   Offices, business and professional, including medical clinics.
   (R)   Package liquor stores.
   (S)   Paint and wallpaper stores.
   (T)   Restaurants, including the sale of alcoholic beverages if incidental to the use of the premises as a restaurant.
   (U)   Photography studios.
   (V)   Service and fraternal clubs and lodges.
   (W) Shoe stores and shoe repair shops.
   (X)   Temporary buildings for construction purposes for a period not to exceed the duration of such construction.
   (Y)   Variety stores.
   (Z)   Wearing apparel shops.
(AA)   Accessory uses incidental to and on the same zoning lot as a principal use.
(BB)   Any other retail business use that is not specifically permitted by this section is permitted provided it complies with the standards set forth in § 154.085.

§ 154.087 CONDITIONAL/SPECIAL USES.

   The following special uses relating to recreational cannabis may be permitted in specific situations in accordance with the procedures outlined in the Cannabis Overlay Code, Chapter 154A of this title, as appropriate:
   (A)   Recreational cannabis dispensing organization.
   (B)   Recreational cannabis craft grower.
   (C)   Recreational cannabis infuser organization.
   (D)   Recreational cannabis processing organization.
   (E)   Recreational cannabis transporting organization.

§ 154.088 LOT SIZE REQUIREMENTS.

   There are no lot size requirements for the B-1 Retail Business District.

§ 154.089 BUILDING BULK REGULATIONS.

   (A)   The maximum building height shall be 35 feet.
   (B)   No building or structure shall hereafter be established or enlarged unless the following yards are allowed and maintained.
      (1)   A front yard of not less than 60 feet measured from the center line of the street or road, provided that along Sheridan Road (Illinois Route 137), a front yard of not less than 50 feet shall be allowed.
      (2)   A side yard of not less than ten feet on each side of the lot that adjoins a residential district.
      (3)   A rear yard of not less than 25 feet, but if the rear lot line is adjacent to a publicly dedicated alley, then the rear yard shall be not less than ten feet.
