DISTRICT REGULATIONS

§ 154.020 DISTRICTS.

   The village shall be divided into thirteen districts as follows:
   R-1 Residential District
   R-2 Residential District
   R-3 Residential District
   R-4 Residential District
   R-5 Rural Subdivision
   B-1 Retail Business District
   B1-M Marine Related Business District
   B-2 General Business District
   B-3 Shopping Center District
   B-4 Indoor Storage Business District
   B-5 General Storage District
   I-1 Limited Industrial District
   I-2 Light Industrial District

§ 154.021 ZONING MAP.

   The boundaries of the districts listed in § 154.020 are as indicated on the zoning map of the village, a copy of which is on file in the office of the Village Clerk in the Village Hall and is identified on its face as a part of the zoning ordinance and the said zoning map, with all notations, references, and other matters thereon, is as much a part of this chapter as if such notations, references, and other matters were specifically set forth herein. No buildings shall be erected or altered, nor shall any building or premises be used for any purpose other than is permitted in the district in which such building or premises is located, except as provided in §§ 154.205 through 154.209 relating to nonconforming uses.

§ 154.022 BOUNDARIES.

   In the event uncertainties exist with respect to the intended boundaries of the various districts as shown on the zoning map, the following rules shall apply:
   (A)   The district boundaries are the center lines of streets unless otherwise indicated, and where the designation of a boundary line on the zoning map coincides with the location of a street the center line of such street shall be construed to be the boundary of such district.
   (B)   Where the district boundaries do not coincide with the location of streets, but do coincide with lot lines, such lot lines shall be construed to be the boundary of such district.
   (C)   Where the district boundaries do not coincide with the location of streets, or lot lines, the district boundaries shall be determined by the use of the scale indicated on the zoning map.

§ 154.023 PERMITTED USES.

   (A)   No building or other structure shall hereafter be erected, altered, or enlarged, and no use of land shall hereafter be established or enlarged within the village for any use except a use that is permitted within the zoning district in which the building, structure, or land is located.
   (B)   There shall be two exceptions to the requirement in division (A):
      (1)   Uses lawfully established on the effective date of this code may be continued subject to the conditions and restrictions contained in §§ 154.205 through 154.211.
      (2)   Special uses may be allowed, but only in accordance with the provisions of § 154.024.

§ 154.025 LOT SIZE REQUIREMENTS.

   (A)   No building or other structure shall hereafter be erected, altered, or enlarged, nor shall any use of land be established or enlarged on a lot which is smaller in area than the minimum lot area prescribed for the zoning district in which the building, structure, or land is located.
   (B)   No building or other structure shall hereafter be erected, altered, or enlarged, nor shall any use of land be established or enlarged on a tract of land the width of which is less than the minimum lot width prescribed for the zoning district in which the building, structure, or land is located.
   (C)   No building or other structure shall be converted so as to conflict, or further conflict, with
the lot area per dwelling unit requirements for the district in which such building or structure is located.
   (D)   No building containing dwelling units shall hereafter be converted unless the gross floor area when divided by the number of dwelling units within the building or structure produces a quotient of at least 500 square feet. For the purpose of this section, a lodging room may be considered as 3/4 of a dwelling unit.
   (E)   The minimum lot area requirements shall be reduced for lots fronting on Sheridan Road by the number of square feet that said lot is reduced as the result of action taken by federal, state, or municipal agencies, such as by condemnation, for the purpose of widening or otherwise altering said Sheridan Road, except that the minimum lot area shall not be reduced by more than 25%.

§ 154.026 BUILDING BULK REGULATIONS.

   (A)   No building, structure or other installation shall hereafter be erected, altered, installed or enlarged so as to exceed the lot coverage percentage for the district in which the building or structure is located.
   (B)   When a maximum building height is specified in any district or for any particular type of building or other structure, then no such building or structure shall hereafter be erected, altered, or enlarged so as to exceed such maximum building height.
   (C)   When a floor area ratio is specified in any district or for any particular type of building or other structure, then no such building or structure shall hereafter be erected, altered, or enlarged so as to exceed such floor area ratio.
   (D)   No building or other structure shall hereafter be erected, altered, or enlarged, nor shall any use of land be established or enlarged unless the minimum front, side, and rear yards specified for the district in which such building, structure, or use of land is located are maintained. All additions to principal buildings including attached garages shall comply with the yard requirements for the principal building.
   (E)   For the purposes of all coverage calculations, the word “coverage” shall include all buildings, structures, driveways, patios, areas under roof, in-ground swimming pools and all non-specified impervious man-made installations, but excepting therefrom all above-ground decks not under roof and all above-ground swimming pools.
   (F)   For the purposes of all coverage calculations, the lot coverage shall be determined by dividing the areas of land covered by the buildings and other structures described above by the total area of the building lot (or combined lots) upon which the owner wishes to erect or install the building or structures, multiplied by 100.

§ 154.027 SIGNS.

   No sign shall hereafter be erected, altered, or enlarged unless it complies with the regulations and restrictions imposed by Chapter 158 of this code on the use and maintenance of signs in the zoning district in which the sign is, or will be, located.

§ 154.028 OFF-STREET PARKING AND LOADING.

   No building or other structure shall hereafter be erected, altered, or enlarged, nor shall any use of land be established or enlarged unless the minimum off-street parking and loading spaces set out in §§ 154.175 through 154.197 are provided.
