CHAPTER 10

08 GENERAL DEFINITIONS

§ 10.08.010 Definitions.

As used in this Title, the word "City" shall mean the City of Yamhill, Oregon, including its officers, agents and employees. For the purpose of this Title, words used in the present tense include the future, the singular number includes the plural, the word "shall" is mandatory and directory, the word "building" includes a structure.
"Access"
means the way or means by which pedestrians and vehicles shall have ingress and egress to property.
"Access management"
means measures regulating access to streets, roads, and highways from public roads and private driveways.
"Accessory dwelling unit"
means an interior, attached or detached residential structure that is used in connection with or that is accessory to a single-family dwelling.
"Accessory structure"
means a subordinate building or portion of a main building, the use of which is incidental to that of the main building or to the use of the land but does not include dwellings or living quarters.
"Accessory use"
means a use incidental, appropriate, and subordinate to the main use of a lot or building.
"Accessway"
means a walkway that provides pedestrian and/or bicycle passage either between streets or from a street to a building or other destination such as a school or park. It includes a walkway and additional land on either side of the walkway, often in the form of an easement or right-of-way and adjacent uses.
"Affordable housing"
means as defined in ORS 197A.445.
"Alley"
means a public space or thoroughfare not more than 20 feet, but not less than 10 feet in width which has been dedicated or deeded to the public for public use providing a secondary means of access.
Alteration, structural.
"Structural alteration" means any change or repair which would affect or materially change a supporting member of a building, such as a bearing wall, column, beam, or girder.
"Apartment"
means a dwelling unit or units as defined in this chapter.
"Assisted living facility (ALF)"
means a building, complex, or distinct part thereof, consisting of fully, self-contained, individual living units where six or more seniors and adult individuals with disabilities may reside in homelike surroundings. The assisted living facility offers and coordinates a range of supportive services available on a 24-hour basis to meet the activities of daily living, health, and social needs of the residents as described in these rules. A program approach is used to promote resident self-direction and participation in decisions that emphasize choice, dignity, privacy, individuality, and independence.
"Automobile or trailer sales area"
means a lot used for display, sale or rental of new or used automobiles or trailers, where no repair work is done except minor, incidental repairs of automobiles or trailers to be displayed, sold or rented on the premises.
"Automobile service station"
means a building designed primarily for the supplying of motor fuel, oil, lubrication and accessories to motor vehicles, but excluding major repair and overhaul.
"Basement"
means a portion of a building which has less than one-half or more of its height measured from finished floor to finished ceiling below the average elevation of the adjoining grade.
"Bicycle facilities"
means facilities which provide for the needs of bicyclists, including bikeways and parking.
"Bike lane"
means a portion of a roadway which has been designated by striping and pavement markings for the preferential or exclusive use of bicyclists.
Bikeway.
A "bikeway" is created when a street has the approximate design treatment for bicyclist, based on motor vehicle traffic volumes and speed; shared roadway, shoulder bikeway, bike lane or bicycle boulevard.
"Building"
means a structure built for the support, shelter, or enclosure of persons, animals, chattels, or property of any kind.
"Campground"
means a premises under one ownership where persons camp or live in a manner other than in a permanent building constructed entirely of wood or more lasting materials, excepting mobile home parks, and trailer parks.
"Carport"
means a stationary structure consisting of a roof with its supports and not more than one wall, or storage cabinet substituting for a wall and used for sheltering a motor vehicle.
"Cemetery"
means land used or intended to be used for a columbarium, crematory, mausoleum, or mortuary, when operated in conjunction with and within the boundary of such cemetery.
"Child care center"
means a child care facility, other than a family child care home, that is certified under ORS 329A.280(3).
"City"
means the City of Yamhill, Oregon.
"Clear-vision area"
means a triangular area on a lot at the intersection of two streets or a street and a railroad, two sides of which are lot lines measured from the corner intersection of the lot lines for a distance specified in these regulations. The third side of the triangle is a line across the corner of the lot joining the ends of the other two sides. Where the lot lines at intersections have rounded corners, the lot lines will be extended in a straight line to a point of intersection.
"Clinic"
means a facility for treating human ailments conducted by a group of physicians, dentists, or other licensed practitioner(s) for the treatment and examination of outpatients.
"Club"
means an organization, group, or association supported by the members thereof, the purpose of which is to render a service primarily for members and their guests, but shall not include any organization, group, or association, the chief activity of which is to render service customarily as a business.
"Commission"
means the Planning Commission of the City of Yamhill, Oregon.
"Community building"
means a publicly owned and operated facility used for meetings, recreation or education.
"Comprehensive Plan"
means a plan adopted by Ordinance No. 350, or as amended, as a guide in the growth and improvement of the City, including modifications or refinements which may be made from time to time.
"Council"
means the City Council of Yamhill, Oregon.
"Domestic animals"
means animals customarily kept in a single-family dwelling, similar to dogs, cats, parakeets, parrots, hamsters, and mice, of four or less in combined total but does not include those animals customarily brought from the wilderness into a domesticated state, such as lions, panthers, bobcats, coyotes, bears, snakes, and other animals which, in the sole opinion of the Planning Commission, may represent a danger to the public health, safety or welfare.
"Dwelling"
means a building or portion of a building, including a manufactured dwelling and manufactured home, which is occupied in whole or in part as a dwelling unit, home, residence, or sleeping place, either permanently or temporarily, but excluding hotels, motels and tourist courts.
Dwelling, duplex.
"Duplex dwelling" means two dwelling units on one lot or parcel in any configuration. A duplex dwelling does not include a lot or parcel developed with a single-family dwelling and an accessory dwelling unit.
Dwelling, multi-family.
"Multi-family dwelling" means a building designed and used for three or more dwelling units on one lot or parcel, occupancy, all living independently of each other, and having separate housekeeping facilities. "Multi-family dwelling" includes assisted living facilities.
Dwelling, single-family.
"Single-family dwelling" means one dwelling unit on one lot or parcel.
Dwelling, townhouse.
"Townhouse dwelling" means a dwelling unit constructed in a row of two or more attached units where each dwelling unit is located on an individual lot or parcel and shares at least one common wall with an adjacent unit, also commonly called a "single-family attached dwelling," "row house" or "common-wall house."
"Dwelling unit"
means a building, or portion of a building, that has independent living facilities including provisions for sleeping, cooking and sanitation, and that is designed for residential occupancy by a group of people.
"Easements"
means a grant of the right to use a strip of land for specific purposes.
"Electronic Message Center (EMC)"
means a sign that displays words, symbols, figures, or images that can be electronically or mechanically changed by remote or automatic means.
"Family child care home"
means a child care facility in a dwelling that is caring for not more than 16 children and is certified under ORS 329A.280(2) or is registered under ORS 329A.330.
"Fence"
means an unroofed barrier or an unroofed enclosing structure or obstruction constructed of any materials including, but not limited to, wire, wood, cement, brick, plastic and evergreen or shrubbery planting arranged in such a way as to partially or wholly obstruct vision, light, air or passage.
"Floor area"
means the sum of the gross horizontal areas of the several floors of a building, measured from the exterior faces of the exterior walls or from the centerline of walls separating two buildings, but not including:
(1) 
Attic space providing headroom of less than seven feet;
(2) 
Basement, if the floor above is less than six feet above;
(3) 
Uncovered steps or fire escapes;
(4) 
Private garages, carports, or porches;
(5) 
Accessory water towers or cooling towers;
(6) 
Accessory off-street parking or loading spaces.
"Formula business"
means a type of commercial business establishment, retail sales or rental activity and retail sales or rental establishment, including restaurants, hotels and motels, which, along with 10 or more other establishments, maintains two or more of the following features: (a) standardized array of merchandise or standardized menu; (b) standardized facade; (c) standardized decor or color scheme; (d) uniform apparel; (e) standardized signage; or (f) trademark or service mark; provided, however, a "formula business" shall not include an automated, standalone vending machine.
(1) 
"Standardized array of merchandise" means 50% or more of in-stock merchandise from a single distributor bearing uniform markings.
(2) 
"Trademark" means a word, phrase, symbol or design, or a combination or words, phrases, symbols, or designs that identifies and distinguishes the source of the goods from one party from those of others.
(3) 
"Service mark" means a word, phrase, symbol or design, or a combination or words, phrases, symbols, or designs that identifies and distinguishes the source of a service from one party from those of others.
(4) 
"Decor" means the style of interior finishings, which may include, but is not limited to, style of furniture, wall coverings, or permanent fixtures.
(5) 
"Color scheme" means selection of colors used throughout, such as on the furnishings, permanent fixtures, and wall coverings, or as used on the facade.
(6) 
"Facade" means the face or front of a building, including awnings, looking onto a street or an open space.
(7) 
"Uniform apparel" means standardized items of clothing, including, but not limited to, standardized aprons, pants, shirts, smocks or dresses, hat, and pins (other than name tags) as well as standardized colors of clothing.
(8) 
"Signage" means a "business sign" as defined in Chapter 10.64 of this Code.
(9) 
"Standardized" does not mean identical but means "substantially the same."
"Frontage"
means all the property on one side of a street between two street intersections, crossing or terminating, measured along the line of the street, or if the street is dead-ended, then all of the property abutting on one side between a street intersection and the dead-end of the street.
Garage, private.
"Private garage" means a detached accessory building or a portion of a main building for the parking or temporary storage of automobiles in which no business, occupation, or service is provided for or is in any way conducted.
Garage, public.
"Public garage" means a building, other than private garage, used for the care, repair, or equipping of motor vehicles, or where such vehicles are parked or stored for compensation, hire, or sale.
"Government assisted housing"
means housing that is financed in whole or part by either a Federal or State housing agency or a housing authority as defined in ORS 456.005, or housing that is occupied by a tenant or tenants who benefit from rent supplements or housing vouchers provided by either a Federal or State housing agency or a local housing authority.
"Grade"
means the average elevation of the natural ground elevation at the centers of all walls of a building, except that if a wall is parallel to and within five feet of a sidewalk, the sidewalk elevation opposite the center of the wall shall constitute grade or natural ground elevation.
"Height of building"
means the vertical distance from grade plane to the average height of the highest roof surface.
"Home occupation"
means an occupation carried on solely by the resident of a dwelling house of a secondary use, connection with which no assistants are employed, no commodities are sold other than services, no sounds are heard beyond the premises, and there is no display, advertisement, or sign board except such signs as by this Title may be permitted in the zone where the home or occupations as dressmaking, lawyer, notary public, public accountant, artists, writer, teacher, musician, home office of a physician, dentist, or other practitioner of any of the healing arts, or practices of any art or craft of a nature to be conveniently, unobtrusively, and inoffensively pursued in a family dwelling, provided no structural alterations are made to accommodate such occupations and the residential character of the building remains unchanged, and not more than one half of the floor area of one story is devoted to such use.
"Hotel"
means any building which is designed to be used, or which is used, rented, or hired out to be occupied, or which is occupied for sleeping purposes by guests, in which no provision is made for cooking in individual rooms or suites of rooms.
"Kennel"
means any lot or premises on which four or more dogs and/or cats over the age of four months are kept for sale, breeding, lease, boarding or racing.
"Landscaping"
means any combination of living plants, such as trees, shrubs, plants, vegetative groundcover or turf grasses, and may include structural features, such as walkways, fences, benches, plazas, works of art, reflective pools, fountains or the like. Also includes irrigation systems, mulches, topsoil, and re-vegetation or the preservation, protection and replacement of trees.
"Loading space"
means an off-street space or berth on the same lot with a building, or contiguous to a group of buildings, for the temporary parking of a commercial vehicle while loading or unloading merchandise or materials, and which abuts upon a street, alley or other appropriate means of access.
"Lot"
means a unit of land that is created by a subdivision of land or tract of land having a frontage upon a street and is occupied or to be occupied, by a building or unit group of buildings and its accessory structures, together with such yards or open spaces as required by this Title.
"Lot area"
means the total area measured in a horizontal plane within the lot boundary lines exclusive of public and private roads, and easements for access to other property.
Lot, corner.
"Corner lot" means a lot at least two adjacent sides of which abuts streets other than alleys, provided the angle on intersection of the adjacent streets does not exceed 135 degrees.
"Lot depth"
means the average horizontal distance between the front lot line and the rear lot line.
Lot, interior.
"Interior lot" means a lot other than a corner lot.
"Lot line"
means the property line bounding a lot as defined herein.
Lot line, front.
"Front lot line" means a line separating the lot from the street, in the case of an interior lot; and in the case of a corner lot, a line separating the lot from the street on which the improvement or contemplated improvement will face.
Lot line, rear.
"Rear lot line" means a lot line which is opposite and most distant from the front line. In the case of a triangular shaped lot, the rear lot line, for building purposes, shall be assumed to be a line 10 feet in length within the lot parallel to and at the maximum distance from the front lot line.
Lot line, side.
"Side lot line" means any lot line which is not a front or rear lot line.
"Lot of record"
means a lot which is part of a subdivision or a lot or parcel described by metes and bounds, which has been recorded in the office of the County Recorder and County Surveyor.
Lot, through.
"Through lot" means a lot having frontage on two parallel streets other than alleys.
"Lot width"
means the horizontal distance between the side lot lines, measure at right angles to the lot depth at a point midway between the front and rear lot lines.
"Manufactured dwelling"
means a residential trailer, mobile home or manufactured home. "Manufactured dwelling" does not include any building or structure constructed to conform to the State of Oregon Structural Specialty Code, the Low-Rise Residential Dwelling Code adopted pursuant to ORS 455.020 or 455.610 or the Small Home Specialty Code adopted under Section 2, Chapter 401, Oregon Laws 2019.
"Manufactured home"
(1) 
Except as provided in subsection (2) of this definition, means a structure constructed for movement on the public highways that has sleeping, cooking and plumbing facilities, that is intended for human occupancy, that is being used for residential purposes and that was constructed in accordance with Federal manufactured housing construction and safety standards and regulations in effect at the time of construction, and constructed after June 15, 1976.
(2) 
For purposes of implementing any contract pertaining to manufactured homes between the department and the Federal government, "manufactured home" has the meaning given the term in the contract.
"Middle housing (duplex) land division"
means a partition or subdivision of a lot or parcel on which the development of middle housing (duplex) is allowed.
"Mobile home"
means a structure constructed for movement on the public highways that has sleeping, cooking and plumbing facilities, that is intended for human occupancy, that is being used for residential purposes and that was constructed between January 1, 1962, and June 15, 1976, and met the construction requirements of Oregon mobile home law in effect at the time of construction.
"Mobile home park"
means any place where four or more manufactured dwellings, recreational vehicles as defined in ORS 174.101, or a combination thereof, are located within 500 feet of one another on a lot, tract or parcel of land under the same ownership, the primary purpose of which is to rent space or keep space for rent to any person for a charge or fee paid or to be paid for the rental or use of facilities or to offer space free in connection with securing the trade or patronage of such person.
Does not include a lot or lots located within a subdivision being rented or leased for occupancy by no more than one manufactured dwelling per lot if the subdivision was approved by the municipality unit having jurisdiction under an ordinance adopted pursuant to ORS 92.010 to 92.192.
"Motel"
means a building or group of buildings on the same lot containing guest units, which building or group is intended or used primarily for the accommodation of transient automobile travelers.
"Nonconforming structure or use"
means a lawful existing structure or use, at the time the ordinance codified in this Title or any amendment thereto becomes effective, which does not conform to the requirements of the zone in which it is located.
"Owner"
means the owner of record of real property as shown on the latest tax rolls or deed records of the County, or a person who is purchasing a parcel of property under written contract, or an authorized agent of the owner or contract purchaser.
"Parcel"
means a unit of land that is created by a partitioning of land.
Parking area, private.
"Private parking area" means an open area, other than a street or alley, used for the parking of the automobiles of residents and guests of a building.
Parking area, public.
"Public parking area" means an open area, building or structure, other than a private parking area, street, or alley used for the parking of automobiles and other motor vehicles, but not to include trucks, and available for use by the public or by persons patronizing a particular building or establishment.
"Parking space"
means an enclosed or unenclosed surface area permanently reserved for the temporary storage of one automobile, and connected with a street or alley by a surfaced driveway which affords ingress and egress for automobiles. The following are not considered parking spaces for the purposes of OAR 660-12-045(5)c: park and ride lots, handicapped parking, and parking for car pools and van pools.
"Partition"
means the division of an area or tract of land into two or three parcels within a calendar year and when such area or tract of land exists as a unit or contiguous units of land under single ownership at the beginning of such year. "Partition land" does not include division of land resulting from lien, foreclosure; divisions of land resulting from the creation of cemetery lots; and divisions of land made pursuant to a court order, including, but not limited to, court orders in proceedings involving testate or intestate successions; and "partition land" does not include any adjustment of a lot line by the relocation of a common boundary where an additional parcel is not created and where the existing parcel reduced in size by the adjustment is not reduced below the minimum lot size established by any applicable zoning requirement.
"Partition plat"
means and includes a final map and other writing containing all the descriptions, locations, specifications, provisions and information concerning a partition.
"Patio"
means an unenclosed, covered recreation area adjoining a dwelling or other building and adapted especially to outdoor dining and living.
"Pedestrian circulation system"
means pedestrian connection(s) between building entrance(s) or the proposed development and adjacent street(s), the parking area, and the existing or future development on adjacent properties.
"Pedestrian connection"
means a continuous, unobstructed, reasonable direct route between two points that is intended and suitable for pedestrian use. Pedestrian connections include but are not limited to sidewalks, walkways, accessways, stairways, and pedestrian bridges.
"Pedestrian plaza"
means a small, semi-enclosed area usually adjoining a sidewalk, or a transit stop which provides a place for pedestrians to sit, stand, or rest.
"Pergola"
means an arbor or passageway with a roof of trellis-work on which climbing plants are trained to grow.
"Person"
means an individual firm, partnership, corporation, company, association, syndicate or any legal entity, and including any trustee, receiver, assignee, or other similar representative thereof.
"Planning Commission"
means the Planning Commission of the City of Yamhill.
"Planning Official"
means the Yamhill City Administrator or an official designated by the Yamhill City Administrator with authority to administer the provisions of this Title.
"Plat"
means the final map, diagram, drawing, replat, and other writing containing the description, location, specifications, dedications, provisions and other information concerning a subdivision, replat, or partition plat.
"Prefabricated structure"
means a building or subassembly that has been in whole or substantial part manufactured or assembled using closed construction at an off-site location to be wholly or partially assembled on site. Does not mean a manufactured dwelling.
"Professional office"
means an office occupied by a professional such as an accountant, architect, artist, attorney-at-law, engineer, land surveyor, insurance agent, real estate broker, landscape architect, or practitioner of the human healing arts.
"Property line"
means the division line between two units of land.
"Recreational vehicle"
means a vehicle with or without motive power that is designed for use as temporary living quarters and as further defined by rule by the Director of Transportation.
"Redevelopment"
means a remodel or addition that requires a Type II application.
"Residential home"
means a residential treatment facility or training home, as defined in ORS 443.400, a residential facility registered under ORS 443.480 to 443.500 or an adult foster home licensed under ORS 443.705 to ORS 443.825 that provides residential care alone or in conjunctions with treatment or training or a combination thereof of five or fewer individuals who need not be related. Staff persons required to meet licensing requirements shall not be counted in the number of facility residents, and need not be related to each other or to any resident of the residential home.
"Residential facility"
means a residential care, residential training, or residential treatment facility, as those terms are defined in ORS 443.400, that provides residential care alone or in conjunction with the treatment or training or a combination thereof for six to 15 individuals who need not be related. Staff persons required to meet licensing requirements shall not be counted in the number of facility residents, and need not be related to each other or to any resident of the residential facility.
"Residential trailer"
means a structure constructed for movement on the public highways that has sleeping, cooking and plumbing facilities, that is intended for human occupancy, that is being used for residential purposes and that was constructed before January 1, 1962.
"Right-of-way"
means the area between boundary lines of a street or dedicated easement.
School, elementary, junior high or high.
"Elementary, junior high or high school" means an institution, public, semi-public, parochial, or private, offering instruction in the several branches of learning and study, in accordance with the rules and regulations of the State Department of Education.
"Service drive"
means a driveway entering a street from a drive-in business establishment or from an off-street parking area, excluding residential driveways serving single-family and duplex dwellings.
"Sidewalk"
means a pedestrian walkway with permanent surfacing.
"Sign"
means an identification description, illustration, or device which is affixed to or represented, directly or indirectly, upon a building, structure, or land, and which directs attention to a product, place, activity, person, institution or business.
Sign, advertising.
"Advertising sign" means a sign which directs attention to a business, product, activity, or service which is not necessarily conducted, sold, or offered upon the premises where such sign is located.
Sign, business.
"Business sign" means a sign which directs attention to a business, profession, service, product, activity, or entertainment, sold or offered upon the premises where such a sign is located.
"Single room occupancy"
means a residential development with no fewer than four attached units that are independently rented and lockable and provide living and sleeping space for the exclusive use of an occupant, but require that the occupant share sanitary or food preparation facilities with other units in the occupancy.
"Story"
means that portion of a building included between the upper surface of any floor and the upper surface of the floor next above, except that the topmost story shall be that portion of a building included between the upper-surface of the topmost floor and the ceiling or roof above. If the finished floor level directly above a basement, cellar or unused under-floor space is more than six feet as defined herein for more than 50% of the total perimeter or is more than 12 feet above grade as defined herein at any point, such basement cellar or unused under-floor space shall be considered a story.
Story, half.
"Half-story" means a story under a gable, hip or gambrel roof, the wall plates of which on at least two opposite exterior walls are not more than two feet above the floor of such story.
"Street"
means the entire width between the boundary lines of a public way provided for vehicular and pedestrian traffic, and the placement of utilities and including "road," "highway," "lane," "place," "avenue," "alley," or similar designations.
(1) 
"Alley" means a narrow street through a block primarily for access by service vehicular to the back or side of properties fronting on another street.
(2) 
"Arterial" means a street of considerable continuity which is primarily for intercommunication among large areas.
(3) 
"Collector" means a street supplementary to the arterial street system and a means of intercommunication between this system and smaller areas; used partly by through traffic and partly for access to abutting properties.
(4) 
"Cul-de-sac (dead-end street)" means a short street with one end open to traffic and the other terminated by a vehicle turn-around.
(5) 
"Half-street" means a portion of the width of a street, usually along the edge of a subdivision where the remaining portion of the street could be provided in another subdivision.
(6) 
"Marginal access street" means a minor street parallel and adjacent to a major arterial street providing access to abutting properties, but protected from through traffic. Also known as a "frontage road."
(7) 
"Minor street" means a street intended primarily for access to abutting properties.
"Structural alteration"
means any change to the supporting members of a building including foundations, bearing walls or partitions, columns, beams, or girders, or any structural change in the roof or in the exterior walls.
"Subdivision"
means either an act of subdividing land of an area or a tract of land subdivided.
"Subdivision plat"
means and includes a final map and other writing containing all the descriptions, locations, specifications, dedications, provisions and information concerning a subdivision.
"Summer house"
means a small, roofed structure, not enclosed, located in a park or garden affording shade and rest.
"Sun exposure plane"
means an imaginary, inclined plane:
Northerly Exposure. Beginning on a line parallel to a front, side or rear property line and 10 feet within the abutting property or properties northerly line or lines of the development site to which the sun exposure plane applies and projecting thence due south at a 30 degree slope over the applicable development site.
Easterly, Westerly and Southerly Exposures. Beginning on lines parallel to front, side or rear property lines, and five feet within the abutting property or properties easterly, westerly and southerly from the easterly, westerly, and southerly lines of the development site to which the sun exposure plane applies and projecting thence due west from the easterly line, due east from the westerly line, and due north from the southerly line, at a 60-degree slope over the applicable development site to a maximum distance of 30 feet measured horizontally from each development site line.
"Structure"
means that which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed of parts joined together in some definite manner, regardless of whether it is wholly or partly above or below ground.
"Tiny house"
means a detached dwelling unit of at least 200 square feet built either in accordance with the Oregon Residential Specialty Code or the standards for recreational vehicles established by the State of Oregon. A tiny house is not motorized and is built and moved on a trailer chassis, manufactured off-site and delivered to the site for assembly, or built on-site. A tiny house has wood siding or vinyl siding which looks like wood lap siding, a pitched roof with soffits, and an enclosed crawlspace under the living space. A tiny house is attached to domestic water and sewer service in accordance with applicable plumbing codes.
"Tiny house development"
means a complex of tiny houses, as defined above, developed as a multifamily project on a single property in accordance with the density and other development standards of the applicable zone, or a development on individual lots designed and considered in accordance with Chapter 10.124, Planned Unit Development.
"Trailer (travel or vacation)"
means a vehicle or structure equipped with wheels for highway use that is intended for human occupancy, which is not being used for residential purposes and is being used for vacation and recreational purposes.
"Travel trailer parks"
means an area containing one or more spaces designed for the temporary parking and convenience of travel trailers and similar recreational vehicles.
"Use"
means the purpose of which land or a structure is designed, arranged or intended, or for which it is occupied or maintained.
"Utility structure"
means a building or structure used for the generation, storage, conversion or transfer of energy or for communication facilities such as telephone, telegraph, radio or television. A utility structure, however, shall not include a radio tower, a television tower, a receiving or transmitting satellite dish larger than six feet in diameter, or such other similar facilities.
"Wrecking yard/junk yard"
means a premises used for the storage or sale of used automobile parts or for the storage, dismantling, or abandonment of junk, obsolete automobiles, trailers, machinery, or parts thereof.
"Yard"
means a space other than a court on the same lot with a building open from the ground upward except as otherwise provided herein.
Yard, front.
"Front yard" means a yard extending across the full width of the lot, the depth of which is the minimum horizontal distance between the front lot line and a line parallel thereto the nearest point of the foundation of the main building.
Yard, rear.
"Rear yard" means a yard extending across the full width of the lot between the most rear main building and the rear lot line, but for determining the depth of the required rear yard, it shall be measured horizontally from the nearest point of the rear lot line; or, if the rear lot line adjoins an alley, then from the centerline of the alley, toward the nearest part of the foundation of the main building.
Yard, side.
"Side yard" means a yard between the main building and the side lot line, extending from the front yard, or front lot line where no front yard is required, to the rear yard; the width of the required side yard shall be measured horizontally from the nearest point of the side lot line toward the nearest part of the foundation of the main building.
