CHAPTER 1165

Special Provisions

1165.01 PERFORMANCE STANDARDS.

   No land or building in any district shall be used or occupied in any manner so as to create any dangerous, injurious, noxious or otherwise objectionable element or condition. The following performance standards shall be observed:
   (a)   Fire Hazards. Any activity involving the use of flammable or explosive materials shall be protected by adequate fire fighting and fire suppression equipment and by such safety devices as required by the Ohio Fire Prevention Code.
   (b)   Radioactivity or Electrical Disturbances. No activity shall emit dangerous radioactivity at any point, or electrical disturbance adversely affecting the operation at any points of any equipment other that that of the creator of such disturbance.
   (c)   Noise. Noise which is objectionable as determined by the Board of Zoning and Building Appeals due to volume, frequency or beat shall be muffled or otherwise controlled, except during construction operations. Air raid sirens and related apparatus used solely for public purposes are exempt from this requirement.
   (d)   Vibration. No vibration shall be permitted which is discernible without instruments on any adjoining lot or property.
   (e)   Air Pollution. Air pollution shall be subject to the requirements and regulations established by the Director of the Ohio Environmental Protection Agency.
   (f)   Glare. No direct or reflected glare shall be permitted which is visible from any property or from any public street, road or highway.
   (g)   Erosion. No erosion, by either wind or water, shall be permitted which will carry objectionable substances onto neighboring properties.
   (h)   Water Pollution. Water pollution shall be subject to the requirements and relations established by the Director of the Ohio Environmental Protection Agency.

1165.02 ENFORCEMENT PROVISIONS.

   All uses existing on the effective date of this Zoning Ordinance shall conform to these performance requirements within two (2) years, provided, that an extension of up to six (6) months may be granted by the Board of Zoning and Building Appeals. The Board may grant extensions if the owner or operator of the use can demonstrate that compliance would create an unreasonable hardship. (Ord. 1986-06. Passed 5-27-86.)
