CHAPTER 1141

R-1 Residential District

1141.01 PURPOSE.

    The purpose of the R-1 Residential District is to provide an area for low density residential and associated land uses. In an R-1 Residential District no building or premises shall be used and no building shall be erected which is arranged, intended or designed to be used for other than one or more of the following specified uses.

1141.02 USES PERMITTED IN THE R-1 RESIDENTIAL DISTRICT.

   (a)   Single family dwelling structure.
   (b)   Farming and gardening, provided however, that any such use permitted shall not be constructed to permit the sale, trading or dealing in the commodities or products thereof other than those transactions which are completely of a casual or incidental nature.
   (c)   Direct sales to the residents and guests in their homes: such as, but not limited to, insurance, basket party, art party or Tupperware party. These sales are of the non-recurring type and are held by the invitation of the resident. (Ord. 92-8. Passed 7-7-92.)
   (d)   Home Occupations: Customary Occupations, such as but not limited to handicrafts, dressmaking, millinery, laundry, preserving, home cooking, shoe repair, small appliance repair, personal and home care products, realtors, law offices, tax consultants and accountants: provided that the operations thereof shall be conducted only by resident occupants, that no structural alterations involving features not customarily found in dwellings are required. An unlighted sign of not over two (2) square feet in area and attached flat against the dwelling shall be permitted.

1141.03 CONDITIONAL USES WITH APPROVAL BY THE BOARD OF ZONING AND BUILDING APPEALS.

   (a)   Utility sub-stations and pump houses providing that such structures will not detract from the general appearance of the area no adversely affect the comfort, safety or welfare of the residents of the area.
   (b)   Two family dwelling structures.
   (c)   Essential services.

   (d)   Modular Homes.
      (1)   The Board of Zoning and Building Appeals shall require, in order to consider such use, a detailed drawing and/or statement setting forth:
         A.   The dimensions (in length and width) of the lot where the modular home shall be placed.
         B.   The dimensions of the modular home, including roof pitch and number of stories, excluding basement and attic.
         C.   The age of the modular home.
         D.   The present condition of the modular home.
      (2)   The Board of Zoning and Building Appeals shall consider the following factors, in approving or rejecting such use, among others:
         A.   The age of the modular home.
         B.   The dimensions of the modular home.
         C.   The character of the neighborhood and the surrounding structures.
         D.   The present condition of the home.

1141.04 REQUIRED LOT AREA, FRONTAGE AND YARD.

   All structures shall meet the following minimum standards.

1141.05 CORNER LOTS.

   Corner lots shall have the same minimum front yard requirements on each street side of the lot.

1141.06 HEIGHT REGULATION.

   No residential structure within the R-I Residential District shall exceed fifty (50) feet.

1141.07 REQUIRED FLOOR AREA.

   Any building intended in whole of part for residential purposes shall provide a minimum livable floor area as hereinafter specified:
