CHAPTER 1149

R-III Residential District

1149.01 PURPOSE.

   The purpose of the R-III Residential District is to provide an area for high density multiple- family residential and associated land uses normally considered an integral part of the neighborhood they serve. In an R-III Residential District no building or premises shall be used and no building shall be erected which is arranged, intended or designed to be used for other than one or more of the following specified uses.

1149.02 USES PERMITTED IN THE R-III RESIDENTIAL DISTRICT.

   (a)   Any uses permitted in the R-III District.
   (b)   Multiple family dwelling structures and apartment buildings for any number of families or housekeeping units, but not primarily for transients.
   (c)   Rooming or boarding houses, provided they are not primarily operated for transients and provided also that any building in which such uses are housed shall be located at least twenty-five (25) feet from any other lot in any R-District.
   (d)   Private Clubs, lodges, and meeting places for other organizations not including any use that is conducted as a gainful business, provided that the building in which such uses are housed shall be located at least twenty-five (25) feet from any other lot in any R-District.
   (e)   Building to be used exclusively to the house the offices of civic, religious, or charitable organizations provided that the buildings in which such uses are housed shall be located at least twenty-five (25) feet from any other lot in any R-District.
 
   (f)   Accessory building and uses.

1149.03 CONDITIONAL USES WITH APPROVAL BY THE BOARD OF ZONING AND APPEALS AFTER A HEARING.

   (a)   Same uses as are conditionally permitted and as regulated in the R-II Residential District, except as specifically limited in this chapter.
   (b)   Rest homes, clinics, nursing homes.

1149.04 REQUIRED LOT AREA, FRONTAGE AND YARD.

   All structures shall meet the following minimum standards:

1149.05 CORNER LOTS.

   Corner lots shall have the same minimum front yard requirements on each street side of the lot, or can conform with the back sets of the adjacent properties.

1149.06 HEIGHT REGULATION.

   No residential structure within the R-III Residential District shall exceed eighty (80) feet, except as provided in Chapter 1173.

1149.07 REQUIRED FLOOR AREA.

   Any building intended in whole or part for residential purposes shall provide a minimum livable floor area as hereinafter specified.
