WATER
The City of Belleair Bluffs has a contract for the supply of water with the County of Pinellas. It is the policy of the City Commission of the City of Belleair Bluffs to encourage and assist the County of Pinellas to implement water conservation measures and the use of recycled water when advisable.
A.
Potable water well fields. Because there are no potable water well fields within the City of Belleair Bluffs, regulations regarding them are not required.
B.
Water usage. It shall be unlawful for any person to use water from a public or private source in violation of the standards set forth by the Southwest Florida Water Management District (SWFWMD) and/or the provisions of this article. Conservation of water is mandatory.

In addition to the definitions contained in § 102-10, the following terms shall have the meanings indicated:
ADVERSE IMPACTS — Any modifications, alterations or effects on a feature or characteristic of water or flood-prone lands, including their quality, quantity, hydrodynamics, surface area, species composition, living resources, aesthetics or usefulness for human or natural uses, which are or potentially may be harmful or injurious to human health, welfare, safety or property or to biological productivity, diversity or stability or which unreasonably interfere with the enjoyment of life or property, including outdoor recreation. The term includes secondary and cumulative as well as direct impacts.
ELEVATION — Height in feet above mean sea level, referenced to the National Geodetic Vertical Datum (NGVD).
EROSION — Wearing or washing away of soil by the action of wind or water.
PREDEVELOPMENT CONDITIONS — Those conditions which existed before alteration of the topography, vegetation and rate, volume, quality or direction of surface or ground water flow by the development for which an application is being submitted.
RECEIVING BODIES OF WATER — Any water bodies, watercourses or wetlands into which surface water flows, either naturally, in manmade ditches or in a closed conduit system.
REGULATORY FLOOD — The one-hundred-year flood, i.e., the flood that has a one-percent probability of being equaled or exceeded in any given year.
SAND DUNES — Naturally occurring accumulations of sand in ridges or mounds landward of the beach.
WATERS — Any and all water on or beneath the surface of the ground, including the water in any watercourse, water body or water management system, diffused surface water, water percolating, standing or flowing beneath the surface of the ground and coastal waters.
WATERSHED — A drainage area or drainage basin contributing to the flow of water in a receiving body of water.
WETLANDS — As defined in § 102-10.

A.
In the event that the governing Board of the Southwest Florida Water Management District (SWFWMD) shall declare a water shortage and shall announce the level of that water shortage and the restrictions that the governing Board has chosen as appropriate and necessary restrictions to achieve the required reduction in overall water demand, then and in that event, the water usage restrictions so chosen and announced by said governing Board of the Southwest Florida Water Management District (SWFWMD) shall be and constitute enforceable water usage restrictions within the city; and the violation of such restrictions shall be a violation of this article and shall be enforced as is hereinafter set forth. Said restrictions as announced shall remain in full force and effect from their effective date until such time as the governing Board of the Southwest Florida Water Management District (SWFWMD) announces that such restrictions have been terminated.
B.
In addition to the provisions of Chapter 150 Article XIV, Water, and §§ 64-7 and 64-8 of the code of the City of Belleair Bluffs, the City Commission may, by resolution, declare the existence of a water emergency in the city if it deems appropriate to do so, whether or not a water shortage has been declared by the governing Board of Southwest Florida Water Management District (SWFWMD), and may designate what water uses shall be prohibited, the hours for certain types of uses, the appropriate exceptions to such prohibited uses and the manner in which such exceptions may be obtained. The provisions of such resolution shall apply from the effective date of such resolution until such time as the water emergency is declared to be ended by the City Commission, by resolution or by motion. The contents of such resolution shall be and form a part of this article and shall be enforced as provided herein as a violation of a municipal ordinance in addition to any other penalties prescribed by law.
C.
The water usage restrictions imposed by the City Commission by resolution may be more severe than those imposed by the governing Board of the Southwest Florida Water Management District (SWFWMD) in order to protect the municipal water supply source.
D.
A copy of any resolution adopted by the City Commission establishing a water emergency will be kept on file with the City Clerk. The regulations and restrictions contained in such resolution will be published in a newspaper of general circulation in the city.
E.
The receipt of water from the city's water supply source is conditioned upon compliance with the terms of this article. Continuing acceptance of water service shall constitute acceptance of the provisions herein as to the present and future use of city water.

Law enforcement and code enforcement officers to enforce. Every law enforcement and code enforcement officer shall, in connection with his duties imposed by law, diligently enforce the provisions of this article.
B.
Discontinuance of service. The City Commission shall have the authority to enforce the provisions of this article by requesting the discontinuance of water service in the event of violation hereof.
