ARTICLE VI

AMENDMENTS; COMPLIANCE WITH OTHER STANDARDS AND PROVISIONS

Sec. 102-21.- Amendments.

The City Commission may from time to time on its own motion or on application or on recommendation of the Planning Board amend, supplement or repeal the regulations and provisions of this code subject to the following conditions:

A.

Every such proposed amendment or change related to the land use of property shall be first referred to the Planning Board for a public hearing at which parties in interest and citizens shall have an opportunity to be heard, and no action shall be taken by the City Commission until the recommendations have been received from the Planning Board.

B.

At least 15 days' notice of the time and place of a public hearing to be held by the Planning Board shall be published in a newspaper of general circulation in the city.

C.

A land use amendment may be initiated by city commission, a petition of interested property owners or authorized agents of such owners for a change in land use of any land.

D.

Fees for Land Use Plan amendments shall be established by resolution of the City Commission.

Sec. 102-22. - Compliance with other standards and provisions required.

A.

The Comprehensive Land Use Plan regulations have been adopted with the understanding that the statutes, rules, regulations and directives of the federal government, State of Florida, County of Pinellas and the Southwest Florida Water Management District shall govern their specific areas of concern. The following areas of legislative activity are acknowledged without specific reference to the respective code sections:

(1)

United States government: Clean Air Act, Clean Water Act, Fair Housing Act, Flood Control and Federal Flood Insurance Regulations and Floodplain Designations.

(2)

State of Florida: Comprehensive Land Use Plan rules and regulations, coastal zone construction, Coastal Water Management Act, Coastal Protection Trust Fund, flood control and Florida Administrative code.

(3)

County of Pinellas: Rules and regulations regarding water supply, sewage and trash disposal, motor vehicle regulations for traffic control, recycling trash, water conservation and reuse, hurricane preparedness plan and hurricane evacuation routes and the Pinellas Aquatic Preserve Management Program regulations.

(4)

Southwest Florida Water Management District: Rules and regulations regarding water usage, conservation of water, surface water retention, water runoff and flood regulations.

B.

The City of Belleair Bluffs has adopted and reconfirms the standards as stated in the Florida Building Code as published by the International Building Code Congress. See Chapter 68, Building Construction, § 68-1, of the Code of the City of Belleair Bluffs, for the description of the current code to be used. These regulations govern the erection, construction, enlargement, alteration, repair, moving, removing, conversion, demolition, occupancy, equipment, use, height, area and maintenance of any building or structure in the City of Belleair Bluffs.

C.

All records pertaining to the provisions of this code shall be maintained in the office of the City Clerk and shall be open for public inspection.
