ARTICLE XVI

TREES

Sec. 102-118.- Standards adopted.

The City of Belleair Bluffs hereby adopts the Habitat Management and Landscaping Ordinance presently in effect, and as hereinafter amended, of Pinellas County, and the rules, regulations and specifications of tree removal, planting, use and protection shall be governed by the Pinellas County Ordinance. Should there be a conflict between the city's code and that of Pinellas County, the city's code shall prevail.

Sec. 102-118.1. - Pruning, corner and height clearance.

Every owner of any tree, bush or shrub overhanging any street right-of-way or sidewalk within the city shall prune the branches so that such branches shall not obstruct the light from any street lamp or obstruct the view of any street intersection or impede the access of pedestrians or vehicles and shall maintain a clear space of 8 feet above the surface of the sidewalk and 14 feet above the surface of roadways. Said owner shall remove all dead, diseased, or dangerous trees or broken or destroyed limbs which constitute a menace to the safety of the public.

The city shall have the right to prune any tree, bush, or shrub on private property when it interferes with the proper spread of light along the street from a streetlight, interferes with the visibility of any traffic control device or sign or impedes pedestrian traffic. The city shall also have the right to prune any tree, bush or shrub overhanging any street right-of-way or sidewalk so that such branches shall not impede the access of pedestrians or vehicles in order to maintain a clear space of 8 feet above the surface of the sidewalk and 14 feet above the surface of roadways.
