CHAPTER 16

13 - OLD TOWN DISTRICTS

16.13.010 - OTR Old Town residential district.

A.

Intent and Purpose. It is recognized that certain mature residential areas located near the original subdivisions of the village have a development pattern that is distinct from the suburban style of residential development in most areas of the village. The OTR Old Town residential district is established for the purpose of maintaining the historic pattern of development in and facilitating context-sensitive redevelopment of certain mature residential areas. The regulations are intended to stabilize and preserve existing residential neighborhoods within and adjacent to the Old Town subarea as designated by the comprehensive plan.

B.

Permitted Uses. The following uses are permitted within the OTR district:

1.

Single-family dwellings;

2.

Public park or playground.

C.

Special Uses. The following uses are special uses within the OTR district:

1.

Two-unit dwellings;

2.

Churches, subject to all applicable supplemental review standards as provided in Section 16.13.030;

3.

Electric substations and gas regulator stations that are screened from view from all public rights-of-way;

4.

Hospital, nursing home, and educational, philanthropic or religious institution on a site of not less than five acres, provided not more than 50 percent of the site area shall be occupied by buildings and the buildings shall be set back from all required yard setback lines an additional foot for each additional foot of building height;

5.

Nursery, pre-kindergarten, day care, special and other private school, providing the same is owned and operated by an eleemosynary institution, corporation or agency;

6.

Public building erected by any governmental agency;

7.

Public or private school having a curriculum equivalent to a public elementary, middle, or high school and having no rooms regularly used for housing or sleeping purposes;

8.

Village historic preservation status, defined in Chapter 16.04;

9.

Accessory wind energy systems, as defined in Chapter 16.04, and as an accessory use operated for educational purposes only in accordance with all applicable supplemental review standards as provided in Section 16.18.020(E).

10.

Accessory child day care home occupations conducted in a single-family dwelling for which:

a.

There are not more than two employees who are not members of the immediate family residing on the premises;

b.

The use extends into more than 25 percent of the total square footage of the principal structure in which the child day care is provided; or

c.

Child day care is provided for more than six but not more than 12 children, including the family's natural or adopted children, and all persons under the age of 14 years.

D.

Accessory Uses. Accessory buildings and uses are permitted within the OTR district in accordance with the standards for the R-1, R-2, and R-3 districts as listed in Section 16.18.020.

E.

Lot Size Requirements. The following minimum lot size requirements shall be provided within the OTR district:

1.

All lots created within the OTR district after the effective date of this section shall be provided with not less than six thousand (6,000) square feet.

2.

Any lot legally established by plat or law prior to the effective date of this section that has less than six thousand (6,000) square feet may nevertheless be used for any permitted use in the OTR district, provided that all newly constructed or reconstructed improvements comply with the setback, lot coverage, height, and parking requirements of this section.

F.

Setback Requirements. The following minimum yards shall be provided within the OTR district:

1.

Front yard: Fifteen (15) feet.

2.

Secondary front yard: Ten feet.

3.

Side yard: Six feet.

4.

Rear yard: Fifteen (15) feet.

G.

Maximum Lot Coverage. The total lot area occupied by any principal building(s), and accessory building(s), together with all impervious surfaces shall not exceed 60 percent. The total roofed building coverage of the total lot area shall not exceed 30 percent.

H.

Maximum Building Height. All buildings and other structures erected within the OTR district shall not exceed 30 feet in height and shall not exceed two and one-half stories.

I.

Parking Requirements.

1.

Single-family detached dwelling: Two fully enclosed spaces per dwelling unit plus two driveway spaces.

2.

Two-unit dwelling: Two fully enclosed spaces per dwelling unit plus two driveway spaces.

3.

All other uses: See parking requirements in Chapter 16.32 of this title.

16.13.030 - Supplemental review standards.

A.

Supplemental review standards for the granting of a special use permit to allow a church.

1.

A community church is a facility that occupies a building space of less than seven thousand (7,000) square feet or is located on a property that is less than two acres in size and has the following requirements.

a.

The front yard setback is 30 feet, side yard setback is ten feet and rear yard setback is 30 feet for a community church.

b.

The parking requirements for a community church are one parking space per each four seats located in the main auditorium.

2.

A regional church is a facility that occupies a building space of greater than seven thousand (7,000) square feet or is located on a property that is greater than two acres in size and has the following requirements.

a.

The front yard setback is 50 feet, side yard setback is20 feet and rear yard setback is 50 feet for a regional church.

b.

The parking requirements for a regional church are one parking space per each three seats located in the main auditorium.
