14 - TOWNHOUSE, MULTIFAMILY AND ROWHOUSE RESIDENTIAL DISTRICTS
A.
Intent and Purpose. The R-4 single-family attached townhouse dwelling residential district is intended for moderate-density housing consisting primarily of townhouses, in areas designated as appropriate by the comprehensive plan.
B.
Permitted Uses. The following uses are permitted within the R-4 district:
1.
Townhouses;
2.
Single-family detached dwellings;
3.
Home occupations, as an accessory use operated in accordance with the provisions of Section 16.18.020(A)(6);
4.
Public or private parks and playgrounds.
C.
Special Uses. The following uses are special uses within the R-4 district:
1.
Two-unit dwelling;
2.
Community churches; a community church is a facility that occupies a building space of less than seven thousand (7,000) square feet or is located on a property that is less than two acres in size;
3.
Electric substations and gas regulator stations;
4.
Golf course, except private commercial miniature course and driving tees; operated for commercial purposes;
5.
Hospital, nursing home, and educational, philanthropic or religious institution on-site of not less than five acres, provided not more than 50 percent of the site area shall be occupied by buildings and provided the building be set back from all required yard setback lines an additional foot for each additional foot of building height;
6.
Nursery, pre-kindergarten, day care, special and other private school, providing the same is owned and operated by an eleemosynary institution, corporation or agency;
7.
Privately operated lake, swimming pool, recreational facility or tennis court on site of not less than five acres;
8.
Public buildings erected by any governmental agency;
9.
Public or private school having a curriculum equivalent to a public elementary, middle, or high school and having no rooms regularly used for sleeping purposes; and
10.
Village historic preservation status, defined in Chapter 16.44.
D.
Lot Size Requirements. The following minimum lot size requirements, measured in square feet (lot area) and feet (lot width), shall be provided within the R-4 district:
In addition to the minimum lot area requirements set forth herein, double frontage lots shall contain an additional lot depth of 12 feet for the entire width of the lot to accommodate a landscaped buffer area.
E.
Density. There shall be no more than eight dwelling units per acre for the net buildable area of the parcel.
F.
Setback Requirements. The following minimum yards, measured in feet, shall be provided within the R-4 district:
A minimum separation of twenty-five (25) feet is required between townhouse buildings.
For the purpose of side yard regulations, a single-family attached dwelling (townhouse) shall be considered as one building occupying one lot.
G.
Maximum Lot Coverage. The total lot area occupied by any principal building(s), and accessory building(s), together with all impervious surfaces shall not exceed sixty percent (60%). On an existing lot of record with a lot width of less than 40 feet, concrete stoops not exceeding five feet wide by five feet long and sidewalks not exceeding three feet in width shall not be counted toward the maximum sixty percent (60%) coverage. Total roofed building coverage of the total lot area shall not exceed thirty percent (30%).
H.
Maximum Building Height. No buildings or other structures erected within the R-4 district shall exceed 30 feet in height or two and one-half stories.
I.
Maximum Floor Area Ratio. In the R-4 district, the maximum allowable floor area ratio shall be five-tenths for all uses.
J.
Maximum Building Length. No townhouse building shall contain more than five single-family attached dwelling units.
K.
Parking Requirements for Permitted Uses. The following are the minimum parking requirements within the R-4 district.

It is recognized that certain townhouse residential areas located near the southeastern corner of the village have a development pattern that is distinct from the suburban style of residential townhouse development elsewhere in the village. The R-4-A single-family attached townhouse dwelling residential district is established for the purpose of maintaining the historic pattern of development in, and facilitating context-sensitive redevelopment of, these certain townhouse residential areas.
B.
Permitted Uses. The following uses are permitted within the R-4-A district:
1.
Townhouses;
2.
Single-family detached dwellings;
3.
Home occupations, as an accessory use operated in accordance with the provisions of Section 16.18.020(A)(6);
4.
Public or private parks and playgrounds.
C.
Special Uses. The following uses are special uses within the R-4-A district:
1.
Two-unit dwelling;
2.
Community churches; a community church is a facility that occupies a building space of less than seven thousand (7,000) square feet or is located on a property that is less than two acres in size;

D.
Lot Size Requirements. The following minimum lot size requirements shall be provided within the R-4-A district:
1.
All lots created within the R-4-A district after the effective date of this section shall be of a size not less than twelve thousand (12,000) square feet and shall have a minimum lot width of 80 feet.
2.
Any lot established prior to the effective date of this section that has less than twelve thousand (12,000) square feet and/or a lot width of less than 80 feet may nevertheless be used for any permitted use in the R-4-A district, provided that all newly constructed or reconstructed improvements on such lot comply with the setback, lot coverage, height, and parking requirements of this section.
E.
Setback Requirements. The following minimum yards, measured in feet, Setback Requirements. The following minimum yards, measured in feet, shall be provided within the R-4-A district:
1.
Front yard: Twenty (20) feet.
2.
Secondary front yard: Ten feet.
3.
Side yard, on the side of the dwelling unit directly abutting or connected to another dwelling unit on an adjacent lot: Zero feet.
4.
Side yard, on the side of the dwelling unit not abutting or connected to another dwelling unit on an adjacent lot: Five feet.
5.
Rear yard: Fifteen (15) feet.
F.
Maximum Lot Coverage. The total lot area occupied by any principal building(s), and accessory building(s), together with all impervious surfaces, shall not exceed sixty-five (65) percent. Concrete stoops not exceeding five feet wide by five feet long and sidewalks not exceeding three feet in width shall not be counted toward the maximum coverage. Total roofed building coverage of the total lot area shall not exceed 30 percent.
G.
Maximum Building Height. No buildings or other structures erected within the R-4-A district shall exceed 30 feet in height or two and one-half stories.
H.
Maximum Building Length. No townhouse building shall contain more than ten single-family attached dwelling units.
I.
Parking Requirements for Permitted Uses. The following are the minimum parking requirements within the R-4-A district:
1.
Single-Family Detached Dwelling: Two fully enclosed spaces per dwelling unit, plus two driveway spaces.
2.
Two-Unit Dwelling: Two fully enclosed spaces per dwelling unit, plus two driveway spaces.
3.
Single-Family Attached Dwelling (Townhouse):
a.
For new townhouse dwellings constructed on a property located in the R-4-A district, two driveway spaces and a garage that includes at least one fully enclosed parking space must also be constructed on that property.
b.
If a townhouse dwelling existing as of June 3, 2014, in the R-4-A district has a garage, it must be maintained in good condition and may only be removed or converted to living space if it is replaced with a garage that includes at least one fully enclosed parking space.
c.
If a townhouse dwelling existing as of June 3, 2014, in the R-4-A district has a driveway accommodating less than two parking spaces, it must be maintained in good condition and may only be removed if it is replaced with a driveway that accommodates at least one parking space.
d.
If a townhouse dwelling existing as of June 3, 2014, in the R-4-A district has a driveway accommodating two or more parking spaces, it must be maintained in good condition and may only be removed if it is replaced with a driveway that accommodates at least two parking spaces.
4.
All Other Uses: See "parking requirements" section of this title.

Permitted Uses. The following uses are permitted within the R-5 district:

Multiple dwellings (including condominiums, apartments, and senior housing).
C.
Special Uses. The following are special uses within the R-5 district:
1.
Community churches; a community church is a facility that occupies a building space of less than seven thousand (7,000) square feet or is located on a property that is less than two acres in size;
2.
Electric substations and gas regulator stations;
3.
Golf course, except private commercial miniature course and driving tees operated for commercial purposes;
4.
Hospital, nursing home, and educational, philanthropic or religious institution on site of not less than five acres, provided not more than 50 percent of the site area shall be occupied by buildings and provided further than the building shall be set back from all required yard setback lines an additional foot for each additional foot of building height;
5.
Nursery, pre-kindergarten, day care, special and other private school, providing the same is owned and operated by an eleemosynary institution, corporation or agency;
6.
Privately operated lake, swimming pool, recreational facility or tennis court on site of not less than five acres;
7.
Public building erected by any governmental agency;
8.
Public school, elementary, middle and high or private school having a curriculum equivalent to a public elementary, middle, or public high school and having no rooms regularly used for housing or sleeping purposes; and
9.
Village historic preservation status, defined in Chapter 16.44.
D.
Lot Size Requirements. The following minimum lot size requirements measured in square feet (lot area) and feet (lot width), shall be provided within the R-5 district:
* Multiple-family developments in the R-5 district must provide a minimum net buildable lot area of 4,356 square feet per dwelling unit.
E.
Density. There shall be no more than ten dwelling units per acre for the net buildable area of any parcel within the R-5 district.
F.
Setback Requirements. The following minimum yards, measured in feet, shall be provided within the R-5 district:
There may be two or more related buildings on a lot, provided that:
1.
The required yards to be maintained around the lot perimeter are not less than thirty (30) feet; and
2.
Buildings are separated by a horizontal distance that is at least equal to the height of the highest building.
G.
Maximum Lot Coverage. The total lot area occupied by any principal building(s), and accessory building(s), together with all impervious surfaces shall not exceed sixty (60) percent.
H.
Maximum Building Height. No building erected within the R-5 district shall exceed forty (40) feet in height or three stories.
I.
Maximum Floor Area Ratio. In the R-5 district, the maximum allowable floor area ratio for buildings shall be one and eight-tenths.
J.
Parking Requirements for Permitted Uses. The following are the minimum parking requirements within the R-5 district.

Permitted Uses. The following use is permitted within the R-6 district: rowhouses.

Special Uses. The following are special uses within the R-6 district:
1.
Public building erected by any governmental agency; and
2.
Village historic preservation status, defined in Chapter 16.44.
D.
Lot Size Requirements. The following minimum lot size requirements, measured in square feet (lot area) and feet (lot width), shall be provided within the R-6 district:

Setback Requirements. The following minimum yards, measured in feet, shall be provided within the R-6 district:
For the purpose of side yard regulations, a rowhouse shall be considered as one building occupying one lot.
F.
Maximum Lot Coverage. The total lot area occupied by any principal building(s), and accessory building(s), together with all impervious surfaces shall not exceed sixty-five (65) percent. Total roofed building coverage of the total lot area shall not exceed thirty-five (35) percent.
G.
Maximum Building Height. No buildings or other structures erected within the R-6 district shall exceed thirty-two (32) feet in height or two and one-half stories.
H.
Maximum Floor Area Ratio. In the R-6 district, the maximum allowable floor area ratio shall be six-tenths for rowhouses. In the R-6 district, the maximum allowable floor area ratio shall be five-tenths for other buildings.
I.
Maximum Building Length. No rowhouse building shall contain more than five single-family attached dwelling units and no building shall have a length (linear frontage) of more than one hundred thirty-five (135) feet.
J.
Parking Requirements for Permitted Uses. The following are the minimum requirements for parking within the R-6 district:

Maximum Floor Area Ratio. In the R-6 district, the maximum allowable floor area ratio shall be six-tenths for rowhouses. In the R-6 district, the maximum allowable floor area ratio shall be five-tenths for other buildings.

Maximum Building Length. No rowhouse building shall contain more than five single-family attached dwelling units and no building shall have a length (linear frontage) of more than one hundred thirty-five (135) feet.
J.
