GENERAL PROVISIONS

§ 27-101 Short Title.

This chapter shall be known and may be cited as the "Carroll Valley Borough Zoning Ordinance."

§ 27-102 Authority.

1. 
Statutory Authority. Section 601 of the Pennsylvania Municipalities Planning Code[1] (Act of 1968, P.L. 805, No. 247, as reenacted and amended) provides that the Carroll Valley Borough Council may enact and amend a zoning ordinance to implement community development objectives established by the Borough Council. The Southwest Adams Joint Comprehensive Plan has been adopted by the Borough Council and establishes specific policies and community development objectives that the Borough Council seeks to implement through the adoption of the Carroll Valley Borough Zoning Ordinance.

Applicability. This chapter requires that, within the Borough of Carroll Valley, in the County of Adams and the Commonwealth of Pennsylvania, no land, body of water, or structure shall hereafter be used or occupied and no structure or part thereof shall hereafter be erected, constructed, reconstructed, moved, or structurally altered unless in conformity with all the regulations and procedures herein specified for the zoning district in which such land, body of water, or structure is located.

§ 27-103 Purposes.

1. 
General Purposes. The Carroll Valley Borough Zoning Ordinance is designed to promote, protect, and facilitate any or all of the following:
A. 
The public health, safety, morals, and general welfare.
B. 
Coordinated and practical community development and appropriate density of population.
C. 
Emergency preparedness and operation.
D. 
Provision of adequate light and air.
E. 
Access to solar energy, police protection, vehicle parking and loading spaces, transportation, water service, sewer service, schools, recreation facilities, and public grounds.
F. 
Provision of a safe, reliable, and adequate water supply for domestic, commercial, agricultural, and industrial use.
G. 
Preservation of the natural, scenic, and historic values in the environment and the preservation of forests, wetlands, aquifers, and floodplains.
H. 
Prevention of overcrowding of land, blight, danger, and congestion in travel and transportation.
I. 
Prevention of loss of health, life, or property from fire, panic, or other dangers.
J. 
Provision for the residential use of land within Carroll Valley Borough for various dwelling unit types encompassing all basic forms of housing and including single-family dwellings, two-family dwellings, multifamily dwellings, and mobile home parks.
K. 
Accommodation of reasonable overall community growth, including population and employment growth and economic development.

This chapter provides the legal basis and framework for future development and redevelopment in Carroll Valley Borough. Its provisions are guided by the policies and community development objectives established in the Southwest Adams Joint Comprehensive Plan.
