44 NEIGHBORHOOD CONSERVATION DISTRICT

17.44.010 Purpose of provisions.

   The NC District is intended as a means for property owners to initiate and to implement programs for the conservation or revitalization of their residential or commercial neighborhoods. The district takes affect through the adoption of a precise plan and set of regulations, called the neighborhood conservation plan, specifically intended, in each case, to facilitate maintenance and upgrading of the neighborhood, to encourage development of vacant or under-used lots, to minimize the adverse effects of incompatible mixtures of uses, and to encourage residents and owners to take positive steps for the improvement of their neighborhood area.

17.44.020 Process to initiate plan.

   A.   In General. In any NC District the regulations governing the uses of land and structures, the height of buildings and requirements for lot area, width and yards, shall be as set forth in the underlying zoning district except as may be expressly modified by the neighborhood conservation plan for that district. There will be a separate and specific neighborhood conservation plan for each NC District.
   B.   Initiation of an NC District. A petition requesting establishment of the district, bearing the signatures of the owners of not less than thirty percent of the property within the area proposed to be included in the NC District, may be submitted to the planning and zoning commission. The petition shall set forth the preliminary boundaries of the area proposed to be included.
   C.   Public Hearing. Upon initiation of proceedings as set forth in subsection B above, the planning and zoning commission shall call a public hearing for the purpose of explaining the purposes and operation of an NC District and to determine the degree of interest in the establishment of such district, as well as to receive any suggestions regarding the content of the neighborhood conservation plan or the boundaries of the NC District.
   D.   Planning and Zoning Commission Recommendation. Following the public hearing, the planning and zoning commission may recommend to the city council that the planning department, or the neighborhood under the auspices of the planning department, proceed with the preparation of a neighborhood conservation plan as set forth herein, and the planning and zoning commission shall recommend to the city council the boundaries of the proposed district; or it may recommend termination of the proceedings if it determines that the plan will not serve the purposes for which the district is intended.
   E.   The city council may, without further hearing, concur in the recommendation of the planning and zoning commission or make such recommendations that they may desire and so instruct the planning department.

17.44.030 Preparation of plan - Requirements.

   When so instructed by the city council, the planning department, or the neighborhood under the auspices of the planning department, shall prepare a neighborhood conservation plan which shall consist of a detailed plan of land uses and related regulations in a substantial conformity with the Casa Grande general plan and any other prevailing, adopted plans. A neighborhood conservation plan shall:
   A.   Indicate proposed changes, if any, to permitted land uses within the NC District;
   B.   Contain a schedule of proposed changes, if any, to density, coverage, height, and other requirements applicable to buildings or structures;
   C.   Contain specific regulations for the remodeling of existing buildings and structures, application of performance standards and application of site plan review procedures;
   D.   Contain proposals for social services, if any, to be furnished in the area and plans for capital improvements, if any, by all public agencies and utilities in the area.

17.44.040 Process to establish.

   Upon completion of the neighborhood conservation plan, the planning department shall notify the planning and zoning commission which shall:
   A.   Set a date for a public hearing on the plan and establishment of the district as provided for in Articles VIII. and IX. of Chapter 17.68;
   B.   Reproduce, and make available, the plan in the proposed district at least thirty days prior to the established public hearing date.
