B.    A structure may be erected to a height over 45' provided buildings over 35 feet in height shall be subject to additional fire protection as determined by the city fire chief.
 

17.24.010 Purpose of provisions.

   The purpose of the B-1 Zone is to provide for the establishment of local centers for convenient retail or service outlets which deal directly with the consumer for whom the goods or services are intended. These centers are to provide services and goods primarily for the surrounding neighborhood and are not intended to draw customers from the entire community.

17.24.020 Principally permitted uses.

   For principally permitted uses in the B-1 Zone, see Table 17.16.030B in Chapter 17.16 of this code.

17.24.030 Conditionally permitted uses.

   Conditionally permitted uses in the B-1 Zone are as follows:
   A.   Bed and breakfast establishments that are located within a historical district or historical landmark as designated pursuant to Section 17.62.050 of this code;
   B.   Business, technical or vocational school;
   C.   Charity dining facilities, homeless shelters and similar services, subject to the development standards set forth in Section 17.68.120.D;
   D.   Convenience store with more than four gas pumps, subject to the development standards set forth in Section 17.68.120.D;
   E.   Day care center, subject to the development standards set forth in Section 17.68.120.D;
   F.   Mortuary;
   G.   Museum;
   H.   Tavern, bar or lounge.

17.24.040 Permitted accessory uses.

   Permitted accessory uses in the B-1 Zone are as follows:
   A.   Business signs, consistent with Section 17.58.050 of this title;
   B.   Trash receptacles, consistent with Section 17.58.050 of this title;
   C.   Accessory buildings as per Article II. of Chapter 17.52 and as approved by the planning and zoning commission;
   D.   Temporary buildings incidental to construction work.
   E.   Accessory residential uses, single family, when occupied by the owner or lessee, or watchman employed on the premises, and when such occupancy is directly associated to a developed and occupied permitted use, and is located within, or attached to, the principal building(s) of the permitted use. (No freestanding building, manufactured or mobile home, or recreational vehicle shall be permitted for such use.)

17.24.050 Access requirements.

   Access requirements in the B-1 Zone shall be as follows:
   A.   Access to commercial activities shall be allowed only from arterial streets or a street specifically designed for such development and shall meet the requirements of Sections 17.56.08017.56.100 of this title;
   B.   Commercial development which may not be able to meet the requirements of Sections 17.56.08017.56.100, and are requesting deviations from the noted standards, shall submit to the city engineer an engineer's report certified by a professional engineer addressing the following site conditions both present and future:
   1.   Traffic volumes;
   2.   Turning movements;
   3.   Traffic controls;
   4.   Site design;
   5.   Site distances;
   6.   Location and alignment of other access points.
   C.   Based upon the above data, the city engineer shall determine whether a deviation from the required standards is justified, and if so, what alternative requirements will be necessary.

17.24.060 Setbacks and height requirements.

   For setback and height requirements for the B-1 Zone, see Table 17.24.060 codified at the end of this chapter.

17.24.070 Lot width and area requirements.

   Lot width and area requirements for the B-1 Zone are as follows:
   A.   The minimum lot width shall be one hundred feet;
   B.   Minimum lot area shall be determined by building area, parking requirements and required setbacks.

17.24.080 Additional building and performance standards.

   Development of any parcel of land within the B-1 Zone shall be subject to all applicable requirements of Chapters 17.52 through 17.64 of this title.

17.24.090 Property in floodplains to comply with certain requirements.

   Any property located in the B-1 Zone and any floodplain as designated in Chapter 15.40, must comply with Chapter 15.40 requirements.

17.24.100 Purpose of provisions.

   The purpose of the B-2 Zone is to provide for low intensity, retail or service outlets which deal directly with the consumer for whom the goods or services are intended. The uses allowed in this district are to provide goods and services on a community market scale and located in areas which are served by arterial street facilities.

17.24.110 Principally permitted uses.

   For principally permitted uses in the B-2 Zone, see Table 17.16.030 B in Chapter 17.16 of this code.

17.24.120 Conditionally permitted uses.

   Conditionally permitted uses in the B-2 Zone are as follows:
   A.   Animal hospital, clinic or kennel, subject to the development standards set forth in Section 17.68.120.D;
   B.   Automobile parking lot or garage (public or private);
   C.   Automobile repair services (major and minor), subject to the development standards set forth in Section 17.68.120.D;
   D.   Automobile washing establishments, subject to the development standards set forth in Section 17.68.120.D;
   E.   Bed and breakfast establishments that are located within a historical district or historical landmark as designated pursuant to Section 17.62.050 of this code;
   F.   Business, technical or vocational school;
   G.   Bus terminals;
   H.   Charity dining facilities, homeless shelters and similar services, subject to the development standards set forth in Section 17.68.120.D;
   I.   Commercial recreation with outside activity;
   J.   Convenience-food restaurants with drive-thru facilities, subject to the development standards set forth in Section 17.68.120.D;
   K.   Convenience store with more than four gas pumps, subject to the development standards set forth in Section 17.68.120.D;
   L.   Day care center, subject to the development standards set forth in Section 17.68.120.D;
   M.   Exterminator shop;
   N.   Liquefied petroleum gas storage and dispensing;
   O.   Self-storage facilities, subject to the development standards set forth in Section 17.24.170;
   P.   Swap meet, flea market;
   Q.   Tire sales, repair and mounting;
   R.   Wireless telecommunication facilities with a height greater than thirty-five feet, subject to the development standards set forth in Section 17.68.120.D.

17.24.130 Permitted accessory uses.

17.24.150 Setbacks and height requirements.

   Setback and height requirements for the B-2 Zone shall be as out in Table 17.24.150 codified at the end of this chapter.

17.24.160 Lot width and area requirements.

   Lot width and area requirements for the B-2 Zone shall be as follows:
   A.   The minimum lot width shall be one hundred and fifty feet except that corner lots shall have a minimum width of two hundred feet.
   B.   Minimum lot area shall be determined by building area, parking requirements and required setbacks.

17.24.170 Additional building and performance standards.

   A.   Development of any parcel of land within the B-2 Zone shall be subject to all applicable requirements of Chapters 17.52 through 17.64 of this code.
   B.   Self-storage facilities development standards:
   1.   On-site circulation, drive aisles, and parking:
   a.   A loading/unloading area, with a minimum width of ten feet shall be provided adjacent and parallel along the entire length of any building which has exterior access to an individual storage unit.
   b.   Refer to Section 17.56.080.C for drive aisle width.
   c.   Refer to Table 17.56.030.B for parking standards.
   2.   Setbacks: Setback requirements for self-storage facilities shall be as set out in Table 17.24.170 codified at the end of this chapter.
   3.   Elevations: Building elevations with no openings may be used in-lieu of, or in conjunction with the perimeter fencing.
   4.   Aesthetics and architectural standards:
   a.   Massing and scaling. The design of buildings shall avoid the appearance of a single, large, dominant building mass by using design techniques that include stepping back portions of the building facade, breaking up the mass into smaller elements and/or using material changes.
   b.   Wall articulation. Building exteriors visible from the perimeter of the site shall be designed to include architectural diversity and interest. Facades that are publicly visible from rights-of-way or adjacent private property, may not have blank, uninterrupted wall lengths exceeding fifty feet without including at least two of the following: change in plane, change in texture or masonry pattern, windows, trellis with vines, elevation changes, architectural embellishments and detailing, accentuated lighting, and color variations or an equivalent element that subdivides the wall into human scale proportions.
   i.   Side or rear walls that are publicly visible from rights-of-way or from adjacent private property, shall include false windows and door openings when actual doors and windows are not feasible because of the of the use of the building. Such false windows and door openings shall be defined by frames, sills and lintels, or similarly proportioned modulations of the wall.
   ii.   Encroachments. Awnings, eaves, overhangs, and light shelves may encroach up to three feet into any required yard but shall not be closer than two feet to any property line. Exception, the zoning administrator may approve minor building projections that extend into the required setback upon finding that the encroachment responds to functional requirements of the project, does not adversely affect the adjacent property, and complies with all requirements of the building code.
   5.   Landscaping.
   a.   On-site landscaped areas shall comply with 17.52.480.C.
   b.   When adjacent to residentially zoned or used properties, a landscape buffer that meets the following standards shall be provided:
   i.   Buffer shall be along the entire length of the property boundary adjacent to residentially zoned or used property.
   ii.   Width of the buffer shall be equal to the height of the perimeter buildings or fifteen feet whichever is greater.
   iii.   A minimum of one tree shall be provided per thirty feet of buffer area; said trees to be a minimum of fifteen-gallon size.
   iv.   The buffer area shall be covered with crushed and screened rock.
   v.   These standards may be modified by the Commission in conjunction with the review of the conditional use permit, or by the Director with the review of a site plan when a conditional use permit is not required, with a finding that said modification will maintain compatibility between the self-storage facility and the adjacent residentially zoned or used property.
   6.   Outdoor storage:
   a.   Shall be limited to operable and licensed vehicles, boats, and trailers.
   b.   Any outdoor storage of vehicles, boats, or trailers shall be in a defined area of the site that does not interfere with loading/unloading areas, drive aisles, fire lanes, or parking areas.
   7.   All refuse enclosures shall be constructed of masonry walls with gates. Said walls shall be a minimum of five feet in height.
   8.   Perimeter wall: Unless the building is being used as perimeter wall in accordance with 17.24.170.B.3, the entire site, other than landscape areas, shall be enclosed by a perimeter fence constructed of decorative concrete block with a minimum height of six feet.
   9.   No auctions, commercial sales, garage sales or similar activities shall be conducted on the premises other than in conjunction with an approved temporary use permit (TUP).

17.24.240 Setback and height requirements.

   Setback and height requirements for the B-3 Zone shall be as set out in Table 17.24.240 codified at the end of this chapter.

17.24.250 Lot width and area requirements.

   Lot width and area requirements in the B-3 Zone shall be as follows:
   A.   The minimum lot width shall be twenty-five feet;
   B.   Minimum lot area shall be determined by building area, parking requirements and required setbacks.

17.24.260 Parking requirements.

   Parking requirements within the B-3 Zone shall comply with all off-street parking requirements of this title except that on-street parking can be used to meet the required number of spaces or alternative means of providing parking can be approved by the city, such as off-street parking improvement districts.
