CHAPTER 17

56 PARKING AND ACCESS

17.56.010 Applicability.

   Subject to the provisions of Section 17.64.020 of this Code, the requirements and provisions of this Article shall apply to all new uses, and change of use in a building, except that Small Residential Uses, as defined in Section 17.56.050, that are on a single lot are exempt from the following sections:
-   17.56.140--Parking area design standards.
-   17.56.150(C); (D); (E) and (F)--Drive access design requirements.

17.56.020 Definitions.

   A.   Access Management Standards - The adopted City of Casa Grande Access Management Standards as set forth in Exhibit B to Resolution No. 5427, as may be amended from time to time.
   B.   Director - The Casa Grande Planning and Development Director or their assignee.
   C.   Floor Area - The gross floor area of a building or outdoor patio.
   D.   Large Residential Uses- Residential buildings containing 3 or more dwelling units or Group Homes with more than 10 residents.
   E.   Non-Residential Uses - Buildings containing uses other than residential or mixed commercial-residential buildings which shall be treated as a Non-Residential Use.
   F.   Small Residential Uses - Residential buildings containing no more than 2 dwelling units or Group Homes with 10 or less residents.

17.56.030 Parking space minimum requirements.

   A.   Minimum number of spaces required for all residential uses. All residential uses are subject to the minimum parking requirements found in Table 17.56.030.A.
   B.   Minimum number of spaces for all Non-Residential Uses. All Non-Residential Uses are subject to the minimum parking requirements found in Table 17.56.030.B.
   C.   Maximum number of parking spaces provided. Developments, other than Small Residential Uses, shall provide no more than 200% of minimum parking required on site. This provision shall not apply to parking lots existing at the time of adoption of this ordinance.
   D.   Bicycle, scooter and similar alternative modes of transportation parking. Developments, other than Small Residential Uses, shall provide appropriate parking facilities for bicycles, electric scooters and similar types of alternative modes of transportation equal to 5% of the vehicle parking required but in no case less than can accommodate four such vehicles. Provision of said parking shall be in addition to the provision of motor vehicle parking.

One (1) space for each rental truck and/or trailer stored on site;

Food Service and Entertainment
1 space per 150 square feet of floor area and outside seating area.
Uses include: Bars and taverns, fast food restaurants, restaurants, private club or lodge, entertainment (commercial).
Hospitality and Lodging
1 space per guest room PLUS the required number of parking spaces to support any Ancillary Hospitality and Lodging Uses as specified below.
Uses include: Hotels, motels, bed and breakfast, extended stay properties.
Ancillary Hospitality and Lodging Uses
Restaurants, food service and bars within hotels
One (1) space per 200 square feet of floor area.
Public assembly or conference areas
One (1) space for each six (6) seats based upon design capacity.
Other commercial, service use or office areas
One (1) space per 400 square feet of commercial floor area.

Uses include: Movie theaters, auditoriums, performing arts centers, religious institutions, museums, other assembly and gathering structures.
Manufacturing and Industry
1 space per 750 square feet of floor area (first 20,000 square feet);

1 space per 1000 square feet of additional floor area between 20,000 - 100,000 square feet);
PLUS
1 space per 1500 square feet of additional floor area over 100,000 square feet
OR
One (1) space per employee on the shift with the highest number of employees, whichever is greater.
Office space within a manufacturing or industrial use shall be calculated at one (1) space per 400 square feet of floor area.
Building area dedicated exclusively to warehousing/storage within a manufacturing or industrial use shall be calculated at one (1) space per 1,500 square feet of floor area.
Manufacturing or industrial uses with verifiable unique manufacturing characteristics that would require fewer parking spaces than those otherwise required by this table may propose alternative parking ratios, based on the unique characteristics of that industry. Use of the alternative parking standards shall require:
   1. Approval by the Director;
   2. Demonstration that there is adequate room on the site to provide the standard parking required if such parking is needed in the future; and
   3. A recorded agreement between the City and the property owner, verifying that the property owner will provide additional on-site parking, if needed due to future employee and/or customer parking demand as determined by the City.
Warehousing and Distribution Centers
One (1) space per 1,000 square feet of gross floor area for first 150,000 square feet;
PLUS
One (1) space per 2,000 square feet of additional gross floor area between 150,001 and 500,000 square feet;
PLUS
One (1) space per 2,500 square feet of additional gross floor area over 500,000 square feet.
Medical
1 space per 200 square feet of medical clinic
PLUS
One (1) space per in-patient bed.
Uses include: Hospitals, medical clinics, dental clinics, vision clinics, physician/chiropractor/psychiatrist/psychologist/therapist offices.
Recreation
1 space per 250 square feet of floor area and outdoor play field, unless otherwise specified below.
Uses include: Recreation centers, golf courses, court clubs (racquetball, tennis, etc.), dance halls, skating rinks, bowling alleys, other indoor or indoor/outdoor recreation

17.56.040 Parking space design requirements.

   A.   Compliance with design requirements. All parking spaces provided for any use shall meet these design requirements, in addition to parking requirements for specific uses set forth in other Articles of this Chapter.
   B.   Parking dimensions. All parking spaces provided for any use shall meet the dimension requirements found in Table 17.56.040. Further clarification about required parking space dimensions is provided in Figures A-C.

17.56.050 Accessible parking space requirements and design standards.

   A.   Requirement to provide accessible parking spaces. Parking facilities required to comply with the requirements of this code, shall include the provision of accessible parking in conformance with this section. An accessible parking area shall consist of accessible spaces and access aisles as set forth by this section.
   B.   Number of accessible spaces required. The minimum number of accessible parking spaces provided for each development shall meet the requirements of Table 17.56.050.

   C.   Additional accessible parking standards for healthcare uses. All off- street parking areas for the following uses must also conform with the following standards for accessible space provision:
   1.   General health care facilities: employee and visitor parking must comply with the standard accessible space requirements set forth in Table 17.56.050.
   2.   Outpatient facilities: Not less than 10% of the total parking spaces provided shall be accessible spaces.
   3.   Spinal cord injury facilities: Not less than 20% of the total parking spaces provided shall be accessible spaces.
   D.   Number of van-accessible spaces required. Van-accessible spaces shall be provided at a ratio of one space per every six required accessible spaces.
   E.   Equitable distribution of covered spaces. In a parking garage, or parking area with shade canopies, the ratio of covered to uncovered accessible parking spaces shall not be less than the ratio of covered to uncovered spaces non-accessible parking spaces.
   F.   Accessible space design. Accessible spaces must meet minimum parking dimensions set forth in Table 17.56.040. In addition to these space dimension requirements, all spaces must also conform to the following requirements:
   1.   All single accessible spaces must be serviced by a single side access aisle with a minimum width of five feet. The single side access aisle must have a minimum width of eight feet when adjacent to a van-accessible space.
   G.   Accessible space placement. Accessible parking spaces shall be located on the shortest route of travel to an accessible building entrance.
   1.   The route of travel from accessible spaces shall not cross lanes for vehicular traffic unless demonstrated that such an arrangement is not practical on the site.
   2.   Where crossing lanes for vehicular traffic, the route of travel shall be designated and marked by a crosswalk with a minimum width of four feet.
   3.   In facilities with multiple accessible building entrances with adjacent on-site parking, accessible parking spaces shall be dispersed and located at the shortest available distance from accessible entrances.
   H.   Grading requirements. Accessible parking spaces shall be located on a surface with a not exceed a 2% slope.
   I.   Surfacing requirements. All accessible parking areas must be paved with a surface which allows for unimpeded travel by individuals with disabilities.
   J.   Signage and identification requirements. Accessible spaces shall be identified through the use of signage conforming to the following requirements:
   1.   Accessible parking spaces shall be prominently identified with paint on all four sides of the parking stall in conformance with striping standards for all parking spaces.
   2.   Accessible parking spaces shall feature the international wheelchair symbol displayed on the ground at the entry of the space.
   3.   The color scheme of all painted features shall be distinct and in contrast from that of standard non-accessible parking spaces.
   4.   Access aisles shall be identified by painted diagonal striping.
   5.   Each accessible parking space shall be identified by a sign which meets the size and height requirements of the American Disabilities Act (ADA) and identifies van accessibility when appropriate.
   K.   Conversion of standard parking stalls to accessible stalls. Parking areas that do not have sufficient accessible parking to meet code requirements shall be permitted to combine and convert up to 10% of the non-accessible standard spaces into accessible spaces. Said conversion shall be allowed even if it results in fewer total parking spaces being available than those required for the use.

17.56.060 Electric vehicle charging spaces and design standards.

   A.   Electrical vehicle charging spaces. When parking facilities are required by this code, spaces restricted to electric power vehicles are encouraged to be provided in conformance with this section. A restricted electric vehicle parking area shall consist of parking spaces and infrastructure associated with electric vehicle charging. Parking spaces provided for electric vehicles shall be counted in meeting minimum parking requirements.
   B.   Number of electric vehicle charging spaces provided. All sites required to provide greater than 25 parking spaces according to Section 17.56.030 are strongly encouraged to provide electric vehicle charging spaces on site. All spaces dedicated for electric vehicles for all developments are encouraged to meet the preferred number of spaces set out in Table 17.56.060.

   C.   Electric vehicle charging infrastructure classifications. The following grade of charging infrastructure shall be provided in conjunction with electric vehicle charging spaces:
   1.   Non-Residential Uses: All charging infrastructure provided shall be 208/40V Level 2 or Level 3 charging stations. No Level 1 charging outlets may be used to satisfy the requirements of this section.
   2.   Residential uses: Charging infrastructure may be provided at any infrastructure class, with a minimum of one (1) space dedicated for a 208/40V Level 2 or Level 3 charging station.
   D.   Electric vehicle parking space design. Electric vehicle charging spaces shall conform to the following design standards:
   1.   All spaces must include a minimum of one outlet, connector or charging station capable of providing sufficient electrical charge to operate an electric vehicle.
   2.   The addition of electric vehicle infrastructure must not reduce the size of the parking space as required in Section 17.56.040.
   3.   Electric vehicle charging infrastructure shall not be placed in a manner which restricts pedestrian movement throughout the site.
   4.   Electric vehicle charging spaces shall meet striping, grading and lighting requirements set forth for non-accessible parking spaces in this ordinance.
   E.   Electric vehicle parking space placement. Electric vehicle charging spaces shall be placed in compliance with the following requirements:
   1.   All electric vehicle spaces must be located on the same site as the principal use.
   2.   Developments providing more than one (1) electric vehicle charging space are encouraged to make spaces contiguous on site to reduce infrastructure costs and improve wayfinding.
   F.   Electric vehicle charging infrastructure requirements. All installed charging infrastructure shall meet the following requirements:
   1.   Charging outlets and connecting devices shall be placed no less than 36 inches and no greater than 48 inches above the ground.
   2.   All cords attached to charging infrastructure shall be retractable or have area to hang cord and/or connector above the ground.
   3.   All infrastructure shall be protected by curb or wheel stop greater than 24 inches from charging infrastructure to protect from vehicle strikes.
   4.   Design of charging infrastructure shall be appropriate with the design of the structures on the site.
   5.   All infrastructure must comply with local and state codes and meet all relevant standards of the Americans with Disabilities Act (ADA).
   G.   Signage and identification requirements. Electric vehicle charging spaces shall be identified utilizing signage conforming to the following requirements:
   1.   Each electric vehicle charging space shall be identified by a sign which clearly demarcates that the space is reserved for electric vehicle use.
   2.   For sites requiring greater than four (4) electric vehicle spaces, wayfinding signage shall be provided to guide users to available electric vehicle charging spaces.
   H.   Electric vehicle charging space parking restrictions. Except when built for a single-family or two-family residential use, electric vehicle charging spaces shall be reserved for the parking and charging of electric vehicles only.

17.56.070 Parking area design standards.

   A.   Backing into street right-of-way prohibited. Off-street parking spaces and off-street loading berths shall be designed to be accessed from an internal access drive that meets the requirements of Sections 17.56.080(C) and (D) of this Chapter and not directly into a public street.
   B.   Striping. All on-site parking spaces shall be marked with painted lines not less than 4 inches wide.
   C.   Grade. The grade elevation of any parking area shall not exceed 3%.
   D.   Surfacing requirements. All areas intended to be used for parking, internal site circulation, and/or drive aisles shall be paved and designed to a specification appropriate to the type and volume of anticipated traffic. All surfaced areas shall consist of one or more of the following hard materials:
   1.   Asphalt
   2.   Concrete
   3.   Other hard and dust-free surface approved by City Planning and Development Director
   E.   Prohibited parking. Vehicle parking on private property shall only occur on parking lots that are paved in accordance with this Article and zoned for the intended use. Parking of vehicles in areas other than approved parking lots, or areas of a lot that are specifically designated for parking or vehicle display, shall be prohibited.
   F.   Curbing and parking setback requirements. All off-street parking areas, driveways and internal circulation areas shall meet the following requirements:
   1.   All on-site parking stalls which abut property lines shall be designed and constructed such that parked vehicles shall not protrude over property lines. A 6-inch curb, pre-cast concrete curb stop, or an alternative perimeter barrier approved by the Director, shall be installed a minimum of 3 feet away from property lines to avoid protrusion over property lines.
   2.   A 6-inch curb shall be installed a minimum of 3 feet away from the edge of all on-site parking stalls and any adjacent structure, wall, or fence to limit vehicle damage to the adjacent building, wall or fence.
   G.   Lighting requirements. Any lighting installed to illuminate an off-street parking area shall meet the following requirements:
   1.   Lighting across the site will be designed in compliance with Chapter 15.48 of this code.
   2.   Lighting will reflect light away from adjacent properties and public right-of-ways.
   3.   Lighting will utilize full cut-off fixtures to conform to City's outdoor lighting standards.
   4.   Specific lighting designs will be determined in conjunction with the review of the Major or Minor Site Plan to ensure that an adequate level of site security is created.
   H.   Screening requirements. All developments with off-street parking lots with greater than 10 spaces shall be screened from the view of adjacent public streets through the use of a 3-foot wall adjacent to the parking area. Wall design should be architecturally compatible with the building(s) located on the site.

17.56.080 Drive access design requirements.

   A.   Access required. No development shall be approved unless the area to be developed meets the following requirements:
   1.   Has access to an existing public or private street.
   2.   The street providing access to development has been deemed to be of sufficient width and construction standard to accommodate anticipated traffic load and trips.
   3.   Driveway access shall comply with the Access Management Standards.
   B.   Drive access location and spacing requirements. Drive accesses shall meet the following requirements for access location and spacing found in the Access Management Standards:
   1.   The number of access points provided shall be sufficient to handle anticipated travel to and from the development and allow adequate emergency access.
   2.   Access spacing shall meet the driveway spacing requirements.
   3.   Drive access points for Non-Residential Uses shall meet the minimum corner and intersection clearance requirements.
   4.   The location of drive access points shall meet all requirements for driveway coordination along roadways.
   C.   Drive access width. Access drives shall not have a width of less than 24 feet when 2-way traffic is allowed, and a width of no less than 12 feet in width for 1-way traffic. Specific driveway widths shall be determined in conjunction with a Traffic Impact Analysis where such an analysis is required.
   D.   Internal circulation requirements. Internal drives shall be designed to provide access to all required parking spaces and to provide adequate circulation between each access point on the site.
   E.   Adequacy confirmed by Traffic Impact Assessment. The adequacy of access drive and internal circulation design shall be determined through the Traffic Impact Analyses Procedures as detailed in the Access Management Standards.
   F.   Allowed alterations to access standards.
   1.   Exceptions. The standards in this section may be relaxed or altered by the City Traffic Engineer if shown during the review of an access request and/or applicable Traffic Impact Analysis that an alternative design can be used without jeopardizing the public's health, safety, and welfare.
   2.   Appeals - The decision of the City Traffic Engineer on an exception request can be appealed to the Planning Commission and City Council in accordance with Section 6.7 of the Access Management Standards.

17.56.110 Applicability.

   This Article shall only apply to Small Residential Uses as defined in Section 17.56.020.

17.56.120 Small residential parking.

   A.   Parking structures and garage spaces. Off-street parking requirements may be met with parking spaces located in a garage structure or on a surface parking area. Garages used to meet minimum parking space requirements shall not be converted into space which can no longer provide parking until adequate provisions are made to comply with the parking requirements found in this Chapter.
   B.   Tandem parking spaces allowed. Tandem parking spaces, defined as one vehicle being parked fully behind another vehicle prohibiting free ingress and egress of the vehicle may be counted to meet requirements of this Chapter.

17.56.130 Small residential parking area and driveway access standards.

   A.   Access required. No development shall be approved unless the proposed site has frontage on and access to an existing public street or alley, or access to the same via a recorded access easement of adequate width.
   B.   Drive access location and spacing requirements. Drive accesses shall meet the requirements for access location and spacing found in the Access Management Standards.
   1.   No more than one access point per dwelling unit, except for the following exceptions:
   a.   Circular drives which meet requirements of Section 17.56.130(1).
   b.   Approval from the Director for secondary access.
   2.   Driveway spacing and corner clearances shall meet the requirements of the Access Management Standards.
   C.   Backing into local street. Small Residential Uses may have driveways that allow vehicles to back directly into local streets.
   D.   Driveway access width. Driveway access width shall be greater than 12 feet but not exceed 36 feet in width. Exceptions may be approved by the City Traffic Engineer.
   E.   Driveway and parking area lot coverage. Driveways and paved areas designed for parking may not exceed 50% of the area designated as the front yard setback.
   F.   Surfacing requirements. Driveway pavement shall consist of one or more of the following materials:
   1.   Asphalt
   2.   Concrete
   3.   Pavers
   4.   Crushed rock, or another dust-free aggregate surface, limited to 40% of the parking area
   5.   Other hard and dust-free surface approved by the Director
   G.   Prohibited parking. Vehicle parking shall only occur on areas that are surfaced in accordance with this Article.
   H.   Low volume driveway access. Low volume driveway access areas serving RV gates or similar access points may be constructed of crushed rock or other similar dust-free surfaces approved by the Director.
   I.   Driveway grade. The grade elevation of any parking area or driveway shall not exceed three percent (3%).
   J.   Circular drives allowed. Single-Family Residential uses are allowed to have two access points when used in a circular drive pursuant to the following conditions:
   1.   Drive access points shall be separated by a minimum of 20 feet, measured to closest points of each drive.
   2.   The width of each circular drive access shall not exceed 24 feet at the property line.
   3.   Drive area for vehicle use exceeds no more than 50% of the front yard setback of the property.
   4.   Parking space requirements are met with the design of the drive.

17.56.140 Applicability.

   This Article shall only apply to Large Residential Uses as defined in Section 17.56.020.

17.56.150 Parking structures and garage spaces.

   Up to a maximum of 80% of the required off-street parking spaces may be met with parking spaces located in a garage structure.

17.56.160 Parking location.

   Each dwelling unit shall have parking spaces available within 300 feet measured along a pedestrian route.

17.56.170 Parking area and access drive maintenance.

   It shall be the responsibility of the property owner to maintain the parking spaces, accessways, striping, landscaping, required fencing and buffering in good repair and in compliance with the City approved plan.

17.56.180 Applicability.

   This Article shall only apply to Non-Residential Uses as defined in Section 17.56.020.

17.56.190 Parking area and drive access requirements.

   A.   Parking screening. All parking areas abutting residentially zoned, or used, property shall be subject to the following screening requirements:
   1.   Parking areas shall be screened from the view of the abutting residentially zoned, or used, property, using a decorative wall, view-obscuring fence, or another material approved by the Director.
   2.   Said screening wall or fence shall be no less than 5 feet, nor more than 6 feet, in height unless an alternative height has been found to be appropriate and approved by the Director.

17.56.200 Parking area and drive maintenance standards.

   A.   Maintenance responsibility. It shall be the responsibility of the owner of the property to maintain the following features in a manner that complies with this code and/or in compliance with the approved Major/Minor Site Plan for the development: the parking space, accessways, striping, landscaping and required fencing and buffering.
   B.   Off-site parking maintenance responsibility. All off-site and/or shared parking shall be subject to legal agreements which clearly identify the parties which are responsible for maintaining the parking space, accessways, striping, landscaping and required fencing and buffering in compliance with this code.

17.56.210 Off-street queueing requirements.

   A.   Minimum stall count and dimension requirements for drive-thru facilities. Drive-thru facilities shall comply with the standards outlined in Table 17.56.210. Drive-thru queue length shall be measured from the center of the last service window. Queue length for car wash uses shall be measured from the stop line prior to entrance to vehicle space inside car wash building. Queue length for ATMs shall be measured from the actual ATM.
   B.   Interference with street or parking areas prohibited. The stall dimensions and minimum stall requirements shall be met without interfering with through streets, internal circulation drives or parking areas.
   C.   Queueing lane width requirements. All drive-thru lanes shall have a minimum width of 10 feet. Drive aisles used for internal site circulation, parking lot access or traffic distribution shall not be used as drive-thru lanes nor be counted toward any requirement for drive-thru lane dimensions.

17.56.220 Off-street loading berth requirements.

   A.   Number of berths required. All commercial, office and industrial uses shall provide off-street truck loading/unloading berths in accordance with Table 17.56.220.

   B.   Off-street loading berth design requirements. Unless otherwise specified in these zoning regulations, all off-street loading facilities shall meet the following standards:
   1.   The first loading berth shall be at least 70 feet in length and additional berths required shall be at least 45 feet in length.
   2.   All loading berths shall be at least twelve feet in width and provide at least fourteen feet of overhead clearance, exclusive of aisle and maneuvering space.
   C.   Loading berth allowed locations. All off-street loading facilities shall meet the following requirements for placement on a site:
   1.   May occupy any part of interior side or rear setbacks and may not enter front or exterior side setbacks.
   2.   Shall not be located closer than 50 feet to any residential zoned or used property unless separated from that zone by a masonry wall not less than eight feet in height.
   3.   Sufficient room for turning and maneuvering vehicles shall be provided on the site so that vehicle cross property lines only by driving forward.
   D.   Backing into street right-of-way. No loading berth may be accessed by backing in from street right-of-way or backing into street right-of-way. Loading berths must be accessible with vehicle fully contained within site.

17.56.230 Short term parking spaces.

   Parking spaces designated for short term usage, such a food pick-up, shall be counted as meeting minimum code requirements.

17.56.240 Parking location.

   Each parking spaces shall be located a maximum distance of 500 feet, measured along a pedestrian route, from the building(s} they are intended to serve.

17.56.250 Alternative parking arrangements allowed.

   Parking requirements for uses outlined in this section may be reduced or met off-site via:
   1.   Off-site parking facilities
   2.   Joint use parking agreements
   3.   On-street parking
   4.   Payment of an in-lieu fee

17.56.260 Off-site parking requirements.

   A.   Off-site parking permitted. Off-site parking to meet the required spaces outlined in this chapter is permitted under the following conditions:
   1.   Any off-site parking which is used to meet the requirements of this section, other than off-site parking facilities in the Downtown General Plan land use category or uses qualifying for Joint Use Parking in accordance with 17.56.270, shall require the approval of a Conditional Use Permit and shall be subjected to all conditions listed in this section.
   2.   Reasonable pedestrian and vehicular access is required to be provided from off-site parking facilities to the principal use being served.
   3.   Off-site parking facilities shall not be located more than 500 feet from the site of the principal use being served.
   B.   Off-site parking agreements required. The site used for meeting the off-street parking requirements of this chapter shall be under:
   1.   The same ownership as the principal use being served, or
   2.   Public ownership, or
   3.   An appropriate legally binding agreement or easement that ensures parking is available for the duration of the use.

17.56.270 Joint use parking requirements.

   A.   Joint use parking permitted. Off-site parking to meet the required spaces outlined in this chapter is permitted for the following uses:
   1.   Churches and auditoriums within 300 feet of approved commercial uses
   2.   Adjacent uses which are eligible to utilize shared parking factor table
   B.   Churches and auditoriums eligible for shared use. Up to 80% of the parking spaces required by this section for a church or auditorium incidental to a public or parochial school may be supplied by the off-street parking facilities of general retail, office, and business service uses, other uses which realize at least 80% of their parking demand during daytime hours, or other uses as allowed by the Director.
   C.   Compatible adjacent uses eligible to utilize shared parking factor table. Uses which typically have off-setting demands in parking use throughout daily operation may complete joint use parking agreements using the shared parking factors outlined in Table 17.56.270. When 2 adjacent sites are eligible for such an agreement, each site may divide its minimum required parking stalls by the factor identified in Table 17.56.270. All agreements leveraging the parking factor tool must meet all other relevant conditions for joint use in this section. This arrangement is designed to promote shared parking between compatible uses in new construction.

   D.   Conditions required for joint use parking. All joint use parking arrangements are subject to the following conditions:
   1.   The building or use for which the application is being made to utilize the off-street parking facilities provided by another use shall be located within 300 feet of the parking facilities.
   2.   The applicant shall demonstrate that there is no substantial conflict in the hours of operation between the two buildings or uses which will impede adequate parking provision for which the joint use parking arrangement is proposed.
   3.   A properly drawn legal agreement executed by the parties concerned for a joint use of off-street parking facilities, shall be approved by the Director and recorded with the County Recorder.
   4.   Joint use parking arrangements shall be binding with both properties for the duration of both original principal uses.

17.56.280 Use of on-street parking to meet parking requirements.

   A.   Replacement of off-street required spaces with on-street and public spaces permitted. Uses may utilize on-street parking spaces and spaces in public parking lots to meet minimum required number of off-street spaces if the following conditions are met:
   1.   Use is located within the Downtown General Plan land use category.
   2.   All spaces are located within 1,000 feet of the principal use.
   3.   Reasonable access is provided for pedestrians from the on-street parking space or public parking lot to the principal use.
   4.   The required number of accessible parking spaces are provided either on-site or in adjacent street parking.
   5.   Parking arrangement is in accordance with parking plan approved by the Director.
   B.   Total allowed replacement of required spaces with on-street parking. If all conditions are met to allow off-street parking to be replaced with on-street and public spaces, the following number of required spaces may be met by on-street and public spaces:
   1.   Residential uses may utilize on-street and public spaces for up to 50% of required parking spaces.
   2.   All Non-Residential Uses may utilize on-street and public spaces for up to 100% of required parking spaces.
   C.   Exemptions for small existing non-residential structures. All non-residential structures under 7,500 square feet in floor space, existing at the time of adoption of this ordinance, may use on-street parking that complies with this section to comply with the minimum parking standards outlined in this chapter.

17.56.290 In-lieu fee structure for reduced parking minimums.

   A.   In-lieu fee structure for reduced parking minimums permitted. Parking space minimum requirements may be reduced if an in-lieu fee is approved by the City Traffic Engineer and the Director. An in-lieu fee must meet the following conditions:
   1.   In-lieu fee shall be established by City Council.
   2.   The in-lieu fee paid for each space shall be dedicated to the future provision of public parking in the Downtown General Plan land use category.
   3.   Agreement for in-lieu fee structure at a particular site must demonstrate that reduced parking will not cause adverse impacts on surrounding properties and parking areas, nor cause adverse impacts on the safety, health or general welfare of surrounding community.
   4.   All in-lieu fees must be paid in-full before issuance of the building permit for principal use.
