80 - AMENDMENTS

18.80.010 - Initiation of proceedings.

Proceedings for an amendment to this title may be initiated by either of the following two means:

(1)

The verified petition of one or more persons or corporations interested in the proposed amendment, which petition shall be filed with the commission, and shall be accompanied by a fee in the amount set by fee resolution of the city council, no part of which shall be returnable to the petitioner; or

(2)

By resolution of the council or the planning commission.

18.80.020 - Hearing—Notice.

Upon initiation of an amendment proposal by any of the methods provided above and within thirty days after receipt of the proposal by the commission, the commission shall hold a public hearing in relation thereto. The hearing shall be held at a suitable place within the area and notice of its time and place shall be posted, not less than ten days prior to the date of the hearing, in three public buildings in the city. Additionally, if the hearing concerns a proposed amendment to the use district map involving an area of less than twenty acres, written notice shall be mailed not less than ten days prior to the hearing to the owners of all property proposed for reclassification and of all property within a three-hundred-foot radius thereof, using for this purpose the last known name of such owners as shown upon the records of the county treasurer.

Failure to send notices by mail to any property owner, where the address of such owner is not included in the county record, shall not invalidate any proceedings in connection with such amendment.

18.80.030 - Hearing—Adjournment.

The commission may adjourn any hearing in order to obtain additional information or to serve further notice upon such other property owners as it decides may be interested in said amendment. Persons previously notified and persons already heard need not be notified of the time of resumption of the hearing unless the commission so decides.

18.80.040 - Petition—Withdrawal.

Upon the consent of the commission, any petition for an amendment may be withdrawn upon the written application of a majority of all the persons who signed such petition. The council or the commission may cancel any proceedings for an amendment initiated by its own resolution of intent or request; provided, that such cancellation may be made only when such proceedings are before the commission for consideration, and provided that any hearing of which public notice has been given shall be held.

18.80.050 - Recommendation to council.

If, from the facts presented at the public hearing or on investigation by or at the instance of the commission, the commission finds that the public health, safety, peace, morals or general welfare warrant enactment of the proposed amendment, it shall recommend the amendment to the council for adoption. The decision of the commission, whether favorable or unfavorable to the proposed amendment, shall be reported to the council within ninety days of the filing of the petition for the proposed amendment with the commission.
