The purpose of this chapter is to establish use and development regulations for public utility substations to ensure they are compatible with adjoining uses. (Ord. 394, 8-7-2001)
9-36-020: SCOPE:
The requirements of this chapter shall apply to any public utility substation within the city. Such requirements shall not be construed to prohibit or limit other applicable provisions of this title, this code, and other laws. (Ord. 394, 8-7-2001)
9-36-030: PERMITTED USE:
A public utility substation that conforms to the development standards of section 9-36-040 of this chapter shall be a permitted use in any zone. (Ord. 394, 8-7-2001)
9-36-040: DEVELOPMENT STANDARDS; PERMITTED USE:
The development standards set forth in this section shall apply to any public utility substation established as a permitted use:
A. Color: The substation shall be painted or constructed of materials with earth tone colors chosen by the utility provider from a list of colors approved by the community development department.
B. Fencing: The perimeter of the substation site shall be fenced if necessary for public safety or to minimize visual impact.
C. Landscaping: The perimeter of the substation site shall be landscaped in accordance with a landscaping plan approved by the community development department.
D. Location: Substations shall be located only as follows:
1. On private property and more than thirty feet (30') from any habitable structure.
2. Within the park strip of any fully constructed public street right of way.
3. On public streets where:
a. Full improvements have not yet been installed as shown on the city's master traffic and transportation plan; and
b. The applicant, via city form, agrees to relocate the substation at his expense to the park strip when the street is fully constructed.
4. No substation shall be located in the path of any planned street or trail as illustrated on the city's master traffic and transportation plan or parks and trails master plan.
E. Maximum Size: Maximum aboveground size shall be as follows:
1. If not located within the park strip of a fully improved street: nine feet (9') in any direction horizontally and six and one-half feet (61/2') vertically above the existing grade.
2. If located within the park strip of a fully improved street: five feet (5') horizontally parallel to the street by two feet (2') perpendicular to the street and fifty six inches (56") vertically above existing grade.
F. Visual Obstructions: The substation shall conform to visual obstruction regulations set forth in section 9-27-080 of this title. (Ord. 394, 8-7-2001)
9-36-050: CONDITIONAL USE PERMIT REQUIRED:
A public utility substation that does not conform to the development standards of section 9-36-040 of this chapter may be established in any residential, commercial, public facilities, or manufacturing zone subject to the issuance of a conditional use permit pursuant to the requirements of section 9-5-080 of this title and the development standards of section 9-36-060 of this chapter. 9-36-060: DEVELOPMENT STANDARDS; CONDITIONAL USE:
The development standards of section 9-36-040 of this chapter shall apply to any public utility substation established as a conditional use, except as modified by the following subsections:
A. Location: Public utility substations exceeding the size limits of subsection 9-36-040E of this chapter shall not be located in any park strip or front yard.
B. Maximum Size: A public utility substation located in a residential zone shall not exceed twelve feet (12') horizontally and ten feet (10') vertically above existing grade.
C. Maximum Height: No public utility substation shall exceed ten feet (10') in height. Height exceeding the limitations of subsection 9-36-040E of this chapter may be permitted only with a conditional use permit. (Ord. 394, 8-7-2001)
