CHAPTER 37

RECREATIONAL VEHICLE PARKS

9-37-010: PURPOSE:

The purpose of this chapter is to establish use and development standards for recreational vehicle parks to assure their compatibility with adjoining uses and to protect the welfare of the public. (Ord. 394, 8-7-2001)

9-37-020: SCOPE:

The requirements of this chapter shall apply to the use and occupancy of recreational vehicles in recreational vehicle parks within the city. Such requirements shall not be construed to prohibit or limit other applicable provisions of this title, this code, and other laws. (Ord. 394, 8-7-2001)

9-37-030: NEW RECREATIONAL VEHICLE PARKS:

No new recreational vehicle parks shall be created, nor shall any existing park be expanded in acreage or in the number of recreational vehicles allowed. (Ord. 394, 8-7-2001)

9-37-040: CONDITIONAL USE PERMIT REQUIRED:

No recreational vehicle park shall be established unless:
A.   Such use is allowed as a conditional use in the zone where it is located; and
B.   A conditional use permit has been issued for the use pursuant to the requirements of section 9-5-080 of this title and the development standards of this chapter. (Ord. 394, 8-7-2001)

9-37-050: DEVELOPMENT STANDARDS:

The development standards set forth in this section shall apply to any recreational vehicle park:
A.   Applicable Laws: Parks shall conform to all applicable laws, including, but not limited to, zoning, building, electrical, plumbing, health, and fire codes.
B.   Clearance: Each recreational vehicle shall be located at least fifteen feet (15') from adjacent recreational vehicles.
C.   Debris: Parks shall be maintained free of debris that may provide rodent harborage or breeding places for flies, mosquitoes, or other pests.
D.   Drainage: The site shall be designed and constructed to provide adequate surface drainage and isolated from any existing or potential health hazard or nuisance.
E.   Dust: Objectionable dust from exposed ground surfaces shall be prevented by use of appropriate ground cover and control measures. This shall include, but shall not be limited to, paving with cement or asphalt, covering with mulch, or cultivating with vegetative ground cover.
F.   Fence And Wall Repair: Fences and walls shall be maintained in good repair, including periodic repainting, as needed.
G.   Fittings: All utilities provided for each recreational vehicle lot shall have approved standard fittings to which a recreational vehicle can be easily connected.
H.   Flammable Materials: Flammable materials, including, but not limited to, gasoline, kerosene, oil, paper, plastic, cardboard, and wood, shall not be stored beneath or against a manufactured or mobile home.
I.   Infestation: Grounds, buildings, and structures shall be maintained reasonably free of pests, insects, poisonous spiders and rodent harborage and infestation. Extermination methods and other measures to control insects, spiders, and rodents shall conform with city and other applicable requirements. If the potential for infestation exists, all exterior openings in or beneath any structure shall be appropriately screened with wire mesh or other suitable materials.
J.   Tenure: No recreational vehicle shall occupy a recreational vehicle park for more than four (4) days in any sixty (60) day period.
K.   Maintenance: All buildings, parts of buildings, grounds, and equipment shall be maintained clean and in good repair.
L.   Paving: Any areas provided for parking shall be paved with concrete or asphalt and connected to the street.
M.   Street Surface: All streets shall be hard surfaced.
N.   Street Maintenance: Street surfaces shall be maintained free of cracks, holes, bumps, and similar defects. This shall not be interpreted, however, to prohibit speed bumps constructed in accordance with law.
O.   Weeds: Weeds shall be kept cut below six inches (6") high all year long, both within the park and on surrounding public property to the edge of any adjoining street. (Ord. 394, 8-7-2001)

9-37-060: RESPONSIBILITIES OF OWNERS:

A.   Applicable Laws: The owner of each recreational vehicle park shall comply and ensure compliance of other persons with the provisions of this chapter and other applicable laws concerning the recreational vehicle park or part thereof.
B.   Inspection: The park owner shall make at least one daily inspection of the entire park to ensure compliance with law. Park guest restrooms and washing facilities shall be inspected more than once each day, if necessary, to ensure compliance with this requirement.
C.   Maintenance: The park owner shall maintain all buildings, rooms, equipment, and premises, including public areas abutting streets and sidewalks in a clean and sanitary condition. Restroom equipment shall be maintained in adequate amounts, including, but not limited to, toilet paper, hand towels, and hand soap.
D.   Repair: The park owner shall maintain in good repair all equipment and facilities provided by the park owner.
E.   Placement: The park owner shall supervise the safe and proper placement of each recreational vehicle on its lot.
F.   Connections: The park owner shall ensure that all connections and disconnections from any recreational vehicle to sewer, water, gas, electric, or other utility service governed by this chapter are made and maintained correctly and in compliance with applicable laws.
G.   Register: The park owner shall maintain a current register of park occupants. The register shall be readily available to any authorized person inspecting the park. A detailed map identifying each lot shall be available.
H.   Notify: The park owner shall notify park occupants of all applicable provisions of this chapter, including occupant duties and responsibilities. (Ord. 394, 8-7-2001)

9-37-070: RESPONSIBILITIES OF PARK GUESTS:

A.   Applicable Laws: Each park guest shall comply with all applicable requirements of this chapter and other applicable laws.
B.   Placement: Each park guest shall ensure that his or her recreational vehicle is correctly and safely placed on the lot.
C.   Connections: Each park guest shall ensure that all connections and disconnections from his or her recreational vehicle to any utility are made and maintained in compliance with requirements of this chapter and other applicable laws.
D.   Pets: No owner or person in charge of a dog, cat, or other animal shall permit it to run at large or defecate on park property. (Ord. 394, 8-7-2001)
