(A) (1) This chapter cannot provide standards to fit every potential development situation. The city’s varied geography and complexities of land development require flexibility.
(2) This section, and §§ 155.465 through 155.470, and 155.485 through 155.488, provides that flexibility while ensuring that the purposes and intent of the development standards are met.
(B) (1) The purpose of a variance and this section, and §§ 155.465 through 155.470, and 155.485 through 155.488, shall be to prevent or to lessen such practical difficulties and unnecessary physical hardships which are inconsistent with the objectives of this chapter.
(2) A practical difficulty or unnecessary physical hardship may result from the size, shape, or dimensions of a site or the location of existing structures thereon, from geographic, topographic, or other physical conditions on the site or in the immediate vicinity.
(C) (1) The standards for non-conforming uses and development are intended to provide some relief from code requirements for older developments that do not comply.
(2) In §§ 155.485 through 155.488, a non-conforming structure or use applies to the entire structure when any part of said structure is found to be non-conforming.
