§ 155.050 CLASSIFICATION OF LAND USE ZONES.

   (A)   All areas within the urban growth boundary of the city are divided into land use zones. The use of each lot, parcel, and tract of land is limited to the uses permitted by the applicable land use zone, and shall be determined based on the city zoning map and the provisions of this chapter.
   (B)   In order to carry out the purpose and provisions of this chapter, land within the city will be classified in one of the following zones:
      (1)   Residential Zone (R-1); and
      (2)   Community Commercial Zone (CC).

§ 155.051 ZONE MAPS.

   (A)   Consistency with land use zoning map.
      (1)   The boundaries of each of the land use zones contained within this subchapter shall coincide with the land uses zone boundaries identified on the city’s official zoning map, retained by the City Recorder.
      (2)   A certified print of the adopted land use zone map, and any map amendments, shall be maintained by the city. Said map by this reference is made a part of this chapter.
   (B)   Applicability of zoning requirements. All land within the land use zone boundaries identified on the official zoning map is limited to the uses defined in this chapter.
   (C)   Land use zone map amendments.
      (1)   All amendments to the city land use zoning map shall be made in accordance with the provisions of §§ 155.385 through 155.389.
      (2)   The city shall make available for public inspection an up-to-date copy of the revised land use zone map so that it accurately portrays changes of zone boundaries or classification, as applicable.

§ 155.052 DETERMINATION OF ZONE BOUNDARIES.

   (A)   Where uncertainty exists regarding the specific location of a zone boundary, an application for determination of zone boundaries may be submitted to the city.
   (B)   An application shall include the material and information required at § 155.282(D)(2). In considering the application, the city will use the Type II procedures at § 155.284 and will apply the following criteria:
      (1)   Boundaries indicated as approximately following the centerline of streets shall be construed to follow such centerlines;
      (2)   Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines;
      (3)   Boundaries indicated as approximately following city limits shall be construed as following such city limits;
      (4)   Boundaries indicated as following public utility easements shall be taken to be midway between the utility casement boundaries;
      (5)   Boundaries following shorelines shall be taken to follow the ordinary high water line. Boundaries following the centerlines of streams, rivers, or other bodies of water shall be taken to follow said centerline and no matter how the centerline should shift, the boundary would remain the centerline as shifted;
      (6)   Boundaries indicated as parallel to or extensions of features indicated in divisions (B)(1) through (B)(5) above shall be so construed; and
      (7)   Where a zone boundary divides a lot, the boundary location shall be determined based on the criteria above (divisions (B)(1) through (B)(6) above), if applicable, or, if they are not applicable, by a survey conducted by a registered professional land surveyor licensed in the state.

§ 155.053 ZONING OF VACATED PROPERTY.

   Where a public right-of-way is officially vacated, the zoning requirements applicable to the property of which the vacated area becomes a part automatically applies to the vacated property.
