ARTICLE XX

INTERPRETATION, PURPOSE, VALIDITY, AND PENALTIES

Section 20.1 - Interpretation.

In interpreting and applying the provisions of this code they shall be held to be a minimum requirement for the promotion of the health, safety, morals, and general welfare. It is not intended by this code to interfere with, abrogate or annul any easements, covenants or agreements between parties; provided, however, that where the regulations of this code on a stated point are more restrictive than regulations on the same point as contained in any other law or code, the provisions of this code shall govern; and where the regulations of the other law or code are more restrictive that those of this code, the other shall govern. To the extent of a conflict between the comprehensive plan and this code, the comprehensive plan shall control. The code may be more restrictive than the comprehensive plan. A conflict exists to the extent that the code permits development or other action that is less restrictive than required by the comprehensive plan.

Section 20.2 - Validity.

Should any article, section, paragraph, sentence, clause, phrase, or other part of this code be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the code as a whole, or any part thereof, other than the part so declared to be invalid.

Section 20.3 - Saving clause.

Any prosecution arising from a violation of any ordinance repealed by this code, which prosecution which may be started within one year after the effective date of this code in consequence of any violation of any ordinance repealed herein, which violation was committed prior to the effective date of this code shall be tried and determined exactly as if such ordinance had not been repealed.

Section 20.4 - Repeal, effective date.

All codes or parts of codes, in conflict with this code or inconsistent with the provisions of this code, are hereby repealed to the extent necessary to give this code full force and effect. This resolution shall become effective immediately upon its passage.

Section 20.5 - Penalties.

Any person, firm, or corporation, or anyone acting in behalf thereof, who shall violate or fail to comply with any of the provisions of this code, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished by fine and/or imprisonment as provided by the enabling act passed by the state legislature establishing this code. Each day that a violation of this code is continued or permitted to exist without compliance shall constitute a separate offense punishable upon conviction in the manner prescribed in this section.
