ARTICLE VII

DISTRICT REGULATIONS

Section 7.1 - Table of permitted uses.

The following table identifies what uses are permitted without special exception, permitted with conditions, and permitted by special exception in the various zoning districts. The uses are listed on the vertical axis and the zoning districts are listed on the horizontal axis. If a specific use is not listed on the table below, the use shall be considered a prohibited use unless and until an applicant applies for and receives a similar and compatible use permit consistent with this code; provided, however, if a use, device, business, or activity is prohibited by these land development regulations, the Code of Ordinances, or Florida law, an owner may not seek a similar and compatible use permit. Empty cells signify a prohibited use. Cells containing an "X" signify a permitted use. Cells containing an "SE" signify a use permitted by special exception. Cells containing an "X", a number and a letter (e.g., "X3") signify a permitted use with conditions; the conditions are outlined in the legend. Cells containing an "X" or "SE" and a number (e.g., "X4" or "SE4") signify a permitted use or special exception with conditions; the number is associated with a section number (e.g., section ) in the legend, and the section number refers to a location in this chapter (appendix) that contains the conditions associated with the permitted use or special exception.

Permitted use: Defined as a use allowed without exception within a particular zoning district.

Special exception: A special exception may be granted by the city council provided the required appropriate conditions and safeguards have been met. The conditions are listed in the supplementary district regulations (article IX of this appendix) of the Code of Ordinances.

Per section 18-267 of the City of Dunnellon Code of Ordinances, unless authorized by special event permit or otherwise exempted within chapter 18, article IX of the city Code of Ordinances, mobile food dispensing vehicles may only be permitted to operate within three 300 feet of the center line of U.S. Highway 41 in the following zoning districts:

B-2 community business.

B-3 central business.

B-4 general business.

Cell towers are only allowed on property owned, leased, or otherwise controlled by the city provided a license or lease authorizing such antenna or tower has been approved by the city, and minimum requirements of the Code can be met.

A medical marijuana treatment center dispensary may not be located within 500 feet of the real property that comprises a public or private elementary school, middle school, or secondary school unless the city approves the location through a formal proceeding open to the public at which the city determines that the location promotes the public health, safety, and general welfare. Per state law, all medical marijuana treatment center dispensary zoning requirements shall be identical to those for pharmacies except for the distance requirements stated above which are not applicable to pharmacies.

Section 7.2 - District uses definitions.

Adult entertainment establishment includes the terms "adult arcade amusement centers," "adult photographic studio," and any business establishment whose primary business stock in trade is dependent upon the activities relating to specified sexual activities or specified anatomical areas. Adult entertainment establishment also means an adult theater, an adult bookstore, or an adult performance establishment operated for commercial or pecuniary gain, regardless of whether such establishment is licensed under chapter 10 of the Code of Ordinances. An establishment with an adult entertainment license pursuant to chapter 10 shall be presumed to be an adult entertainment establishment. For purposes of this definition, the term "operated for commercial or pecuniary gain" shall not depend upon actual profit or loss. An establishment which has a business tax receipt shall be presumed to be operated for commercial or pecuniary gain.

Airport means any area of land or water designed and set aside for the landing and takeoff of aircraft, including all necessary facilities for passengers and the housing and maintenance of aircraft.

Alcoholic beverage establishment means a commercial establishment selling, dispensing, serving or providing alcoholic beverages for on- premises consumption. These establishments include bars, nightclubs and cocktail lounges. These establishments may also sell packaged alcoholic beverages to customers for off-premises consumption.

Animal rescue organization means a humane society or not for profit corporation who operates a charitable rescue under section 501(c)(3) of the Internal Revenue Code and whose mission includes the rescue, care, or adoption of animals, and which does not obtain animals from a breeder or broker for payment or compensation.

Apartment house. Same as multiple dwelling.

Assembly of electronic components means an establishment where electronic components are assembled into a semi-finished or finished product.

Assisted living facility means a residential facility providing 24-hour personal care for the elderly and which may include memory care services and limited nursing. Residents occupying this type of facility require assistance for daily activities such as preparation of meals, bathing, and other personal care. These facilities include a common dining area for residents. Units typically include one or two beds per unit. Every two beds shall count as a residential unit for the purpose of density calculations. Assisted living facilities are allowed in residential districts, except for the R-3 and R-5 districts. This category does not include nursing homes, congregate care facilities, adult day care facilities, community residential homes or transitional recovery facilities.

Automotive repair, minor means an establishment that provides minor service and maintenance of the ancillary systems of a vehicle including such services as:

(1)

Sales and services of spark plugs, batteries and distributor and ignition systems;

(2)

Sales, service and repair of tires, but not re-capping or re-grooving;

(3)

Replacement of mufflers, tailpipes, water hoses, fan belts, brake fluid, light bulbs, fuses, floor mats, windshield wipers and blades, grease retainers, wheel bearings, mirrors and the like;

(4)

Radiator cleaning, flushing and fluid replacement;

(5)

Washing and polishing and sale of automotive washing and polishing supplies;

(6)

Greasing and lubrication;

(7)

Providing and repairing fuel pumps, oil pumps, and lines;

(8)

Minor adjustment and repair of carburetors;

(9)

Emergency repair of wiring;

(10)

Minor motor adjustment not involving removal of the head or crankcase; or

(11)

Warranty maintenance and safety inspections.

Automotive supply store means an establishment engaged in the retail sale of new automobile tires, batteries and other automobile parts and accessories and may include minor vehicle repairs.

Automotive cleaning/detailing services means a facility engaged in furnishing automobile washing, waxing, polishing, detailing, tinting and or similar services, except repairs.

Automotive rental sales means premises, or a portion of premises, occupied by an establishment engaged in renting automobiles.

Automotive sales (new or used) means an establishment engaged in the retail sale of new and or used automobiles. These establishments frequently maintain repair departments and carry stocks of replacement parts, tires, batteries and automotive accessories.

Automobile wrecking means the dismantling or disassembling of used motor vehicles or trailers, or the storage, sale or dumping of dismantled, partially dismantled, obsolete or wrecked vehicles or their parts.

Automotive wrecking yard means the dismantling or wrecking of used motor vehicles or trailers, or the storage, sale or dumping of dismantled or wrecked vehicles or their parts.

Bakery store means an establishment engaged in the retail sale of bakery products. These products may be made on the premises.

Bar or saloon means any place devoted primarily to the retailing and drinking of malt, vinous, or other alcoholic beverages, or any place where any sign is exhibited or displayed indicating that alcoholic beverages are obtainable for consumption on the premises.

Bed and breakfast means a residential structure or portion thereof where short-term lodging rooms are provided to overnight guests for commercial purposes.

Boat store means an establishment engaged in the retail sale of new and used motorboats and other watercraft, marine supplies and outboard motors.

Bowling center means an establishment known to the public as a bowling alley. These establishments may sell meals and refreshments.

Building material sales means an establishment engaged in the selling of equipment and supplies for all types of construction directly to consumers, as well as to contractors, and not for resale. These establishments may also sell home furnishings and garden sales.

Carpet and upholstery cleaning means establishments engaged in cleaning carpets and upholstered furniture at a plant.

Cemetery means land used or intended to be used for the burial of the dead and dedicated for cemetery purposes, including columbarium, crematories, mausoleums and mortuaries when operated in conjunction with and within the boundaries of such cemetery.

Check cashing/cash advance business means a business within a building, room, space, establishment or portion thereof where checks are cashed in exchange for a percentage fee, or where short-term cash advances are provided, with interest charged, including those against future paychecks. This does not include state or federally chartered banks, savings associations, credit unions, industrial loan companies, or businesses providing loans in exchange for vehicle titles as collateral.

Church means an institution that people regularly attend to participate in or hold religious services, meetings and other activities.

Club, private means associations and organizations of a fraternal or social character, not operated or maintained for profit. The term "private club" shall not include casinos, nightclubs, bottle clubs, or other institutions operated as a business.

Club, night means a restaurant, dining room, bar, or other similar establishment providing food or refreshments wherein paid floorshows or other forms of paid entertainment are provided.

Commercial vehicle means any vehicle designed, intended or used for transportation of people, goods, or things, other than private passenger vehicles and trailers for private nonprofit transport of goods and boats.

Coin-operated laundry (standalone) means an establishment engaged in the operation of coin- operated or similar self-service laundry and dry cleaning equipment.

Coin-operated laundry (accessory use) means an amenity commonly found in apartment complexes and motels.

College/university means colleges and universities furnishing academic courses and granting post-secondary academic degrees. The requirement for admission is at least a high school diploma or equivalent general academic training.

Commercial outdoor baseball batting facility means an establishment engaged in the commercial operation of one or more outdoor baseball batting cages. This facility may also include indoor accessory recreation facilities.

Commercial photograph (art and graphic design service) means an establishment engaged in providing commercial photography, art or graphic design services for advertising agencies, publishers, and other business and industrial users.

Commercial recreation, indoor means an establishment that provides indoor amusement or entertainment, including such activities as theatrical productions, ballrooms, bowling alleys, arcades, artificial rock climbing and similar recreational activities conducted as a commercial enterprise. It does not include any shooting ranges or any activity involving firearms.

Commercial recreation, outdoor means an establishment which provides outdoor recreation, amusement, and/or entertainment, including but not limited to the following: miniature race car track, bumper boats, equestrian facility, amusement park, and skateboard park. This definition shall not include an outdoor rifle or pistol range or other range where firearms are discharged.

Commercial watercraft rental means any establishment renting or leasing any form of self-propelled watercraft, including but not limited to, jet propelled personal watercraft and boats.

Community education center means a facility designed to provide educational opportunities to persons of all ages, including academic, vocational, and recreational and leisure time programming. Programs include but are not limited to vocational training, basic literacy training, vocational /recreational programs, adult high school courses, short courses, community forums, and nontraditional training programs for all ages.

Community residential home means a single family residential dwelling licensed to serve clients of the state department of children and family services, which provides a living environment for a maximum of 14 unrelated residents (as defined in F.S. § 419.001(10)(a) who operate as the functional equivalent of a family, including such supervision and personal care by supportive staff that meets the physical, emotional and social needs of the residents. For purposes of this subsection, the term "resident" means any of the following: A frail elder as defined in F.S. § 400.618(9), a physically disabled or handicapped person as defined in F.S. § 760.22(7)(a), a developmentally disabled person as defined in F.S. § 393.063(12), a non-dangerous mentally ill person as defined in F.S. § 394.455(18), or a child as defined in F.S. § 39.01(14), 984.03(9) and (12), and 985.03(8). This category shall not include a facility defined as an assisted living facility or transitional recovery facility.

Computer sales maintenance and repair means an establishment engaged in the maintenance and repair of computers and computer accessory equipment.

Conference center means a facility used for conventions, seminars, workshops, or other similar activities, including food preparation and eating facilities for the use of participants, as well as compatible accessory facilities.

Congregate care facility means a residential facility housing elderly residents who do not require full time personal care or assistance for preparation of meals, bathing and similar daily activities. These facilities may provide common dining facilities and part time personal care assistance. Units may include a kitchen and one or two bedrooms. For the purpose of density calculations, units with a kitchen shall count as one dwelling unit, and units without a kitchen shall be counted on the basis of each bedroom and bed counting as 0.5 dwelling units. This category does not include nursing homes, assisted living facilities, adult day care facilities, community residential homes or transitional recovery facilities.

Construction/farm equipment sales and rental means an establishment engaged in sales or renting of construction and farm equipment.

Construction service establishment means the office of a business engaged in the construction, addition, alteration, repair or development of land or buildings. The business may include the storage of equipment and material used in that business. This category includes building contractors such as plumbers, electricians, and mechanical contractors.

Dance art/music studio means an establishment engaged in operating dance, art, and music studios or schools.

Daycare facility means an establishment which provides child care for more than five children not remaining overnight and not related by blood or marriage or adoption to the operator, and which receives payment, fee or grant for any of the children receiving care, whether or not operated for profit. The term includes nursery schools, pre-kindergartens, but does not include family day care homes as defined in F.S. § 402.302.

Dental laboratory means an establishment engaged in making dental products such as dentures, artificial teeth and orthodontic appliances.

Department store means an establishment under single ownership engaged in the retail sale of a variety of merchandise.

Drive-in or drive-through restaurant means any place or premises used for sale, dispensing or serving of food, refreshments or beverages to customers who order, pay for and receive their order while in a motor vehicle. Outside seating and walk up service windows are allowed as accessory uses.

Drive-in theater means a lot with facilities for showing motion pictures to customers seated in automobiles.

Dwelling means any building, or part thereof, occupied in whole or in part, as the residence or living quarters of one or more persons, permanently or temporarily, continuously or transiently, with cooking facilities.

Dwelling, group means a building, or part thereof, in which several unrelated persons or families permanently reside, but in which individual cooking facilities are not provided for the persons or families. "Group dwelling" may include a fraternity house, sorority house, convent, monastery or private club in which one or more members have a permanent residence. Group dwelling shall not be deemed to include any uses that occupied on a transient basis.

Dwelling, multiple means a space, area or portion of a building designed for and occupied by more than one family as a dwelling, with cooking facilities for the exclusive use of each family.

Dwelling, one-family means a dwelling occupied not otherwise than by one family.

Dwelling, two-family means a dwelling occupied not otherwise than by two families.

Drive-through facility (non-restaurant) means any portion of a building or structure from which business is transacted, or is capable of being transacted, directly with customers located in a motor vehicle during such business transactions.

Driving range means a golf practice facility consisting of an area approximately 100 yards wide by 300 yards in length with artificial mats or grass tees. Ancillary uses may include the following: practice bunkers, practice putting greens, sales office and or golf pro shop, coin operated vending machines and a snack bar.

Drugstore means an establishment engaged in the retail sale of prescription medicines, cosmetics, toiletries, novelty items, food and alcoholic beverages.

Dry cleaning plant means an establishment engaged in supplying laundered or dry cleaned industrial work uniforms and related work clothing, such as protective apparel; laundered mats and rugs and dust control items, such as treated mops, rugs, mats, dust tool covers, and cloths. Laundered wiping items may belong to the industrial launderer and be supplied to users on a rental basis, or they may be customers' own goods.

Electronics store means an establishment engaged in the retail sales of radios, television sets, record players, stereo equipment, sound reproduction equipment, and other consumer audio and video electronic equipment. These establishments also sell appliances, computers, software, musical instruments, records and prerecorded tapes. These establishments may also do installation and minor repair work.

Equipment rental and leasing means an establishment engaged in renting or leasing equipment as well as selling supplies.

Establishments with simulated gaming devices means any establishment which offers one or more simulated gaming devices, which are unlawful under chapter 18 of the Code of Ordinances and are a prohibited use in the city.

Farm means land used for growing agricultural products and/or raising of livestock including related structures and activities. The term "farm" shall exclude the raising of swine or other livestock fed from garbage. Concentrated commercial farming operations, such as but not limited to dairies, feed lots, pig parlors and chicken farms, are strictly prohibited within the city limits of the city.

Farm/horse farm means land used for raising, breeding, training and selling of horses, including related structures and activities.

Farmers' market means a permanent activity held within a building, structure or open area where groups of individual sellers offer goods such as vegetables, fruits and seafood to the public.

Fast food restaurant means an enclosed establishment that offers quick food service, already prepared and held for service or prepared quickly. Orders are taken at a counter and not at individual tables. These establishments may include drive through and outside seating facilities as an accessory use to the enclosed restaurant.

Financial institution means an institution engaged in deposit banking or closely related functions. Financial institutions may include the main office, branch facilities and a drive through facility.

Flea market means an occasional or periodic sales activity held within a building, structure or open area where groups of individual sellers offer goods, new and used for sale to the public, not to include private garage sales.

Full service station (also known as a filling station or automobile service station) means buildings or premises where the primary purpose of the operation is the supplying and dispensing at retail (or in connection with a private operation where the general public is excluded for the use of the facilities) of motor vehicle fuel and oil but where grease, tires, batteries, and automobile accessories may be supplied and dispensed at retail as a secondary purpose, as well as minor automobile repairs. This shall not include major mechanical overhauling or paint and bodywork. These establishments may provide groceries and beverages as an accessory use.

Funeral home and/or crematory means a building or portion of a building occupied by an establishment engaged in preparing the dead for burial, conducting funerals and or cremating the dead, and may include emergency ambulance service.

Furniture store means an establishment engaged in the sale of household furniture. These stores may also sell home furnishings, major appliance and floor coverings.

Garage, private means an accessory structure designed or used for inside parking of self-propelled private passenger vehicles by the occupants of the main building. A private garage attached to or a part of the main structure is to be considered part of the main use. An unattached private garage is to be considered as an accessory building.

General business service means an establishment engaged in the rendering services other than administrative, professional or clerical operations to business establishments on a contract or fee basis. These services include products that are displayed, sold, rented leased repaired and delivered.

Golf course (public, private) means an establishment engaged in the operation of golf courses and country clubs.

Grocery store means a store, commonly known as a supermarket, engaged in the sale of canned foods, fresh foods and dry goods, such as tea, coffee, spices, sugar, flour, fresh fruits, vegetables, meats, fish, poultry and beverages.

Group housing means housing where up to six unrelated persons reside within the same structure and which otherwise meet the definition of a community residential home in F.S. § 419.001.

Guesthouse means a dwelling unit in a building separate from and in addition to the main residential building on a lot, intended for intermittent or transient occupancy by a gratuitous guest.

Hairstyling shop means an establishment engaged in furnishing hairstyling and related services to both male and female clients. These establishments are commonly known as barber shops and beauty shops.

Hardware store means an establishment engaged in the retail sale of basic hardware products, such as tools, paint and glass house wares and cutlery.

Home decorating use means an establishment engaged in the sale of draperies, curtains, and upholstery and floor coverings. This establishment may also do installation work outside the store for its customers.

Horse racing, including track operations means promotion of racing activities, including racetrack operations, racing stables, racehorse training and the sale of horses.

Hospital means a facility where medical or surgical care is given to non-ambulatory and ambulatory patients and overnight accommodations are provided. These facilities include related activities such as laboratories; outpatient services, training facilities and emergency care services.

Hotel/convention center means a facility offering transient lodging accommodations to the general public with all rooms or suites having direct access through the inside of a building. A hotel may contain the following: restaurants, kitchen facilities, and exhibition space, meeting rooms, entertainment and recreational facilities.

House of worship. Same as church.

Junkyard means a place, structure or lot where junk, waste, discarded, salvaged, or similar materials such as old metals, wood, slush, lumber, glass, paper, rags, cloth, bagging, cordage, barrels, containers, etc., are bought, sold, exchanged, baled, packed, disassembled, or handled, including auto wrecking yards, used lumber yards, house-wrecking yards, and yards or places for storage or a handling of salvaged house-wrecking and structural steel materials. This definition shall not include pawnshops and establishments for the sale, purchase, or storage of usable secondhand cars, clothing, salvaged machinery, used furniture, radios, stoves, refrigerators, or similar household goods and appliances, nor shall it apply to the processing of used, discarded, or salvaged materials as part of manufacturing operations.

Kennel means any place or premises where three or more dogs over six weeks of age are kept for pay or for sale.

Laundry and dry cleaning pickup establishment means establishments designed for the convenient and efficient pick up and or drop off of laundry or dry cleaning by the customer. No actual laundry or dry cleaning service or work is performed on the premises except for the collecting and distributing activities, as well as pressing or finishing work.

Laundry and dry cleaning service means an establishment engaged in the commercial operation of a laundry and dry cleaning service. A laundry and dry cleaning service includes delivery and pickup service.

Library means an institution providing library services, such as the circulation of books and other materials for reading, study and reference.

Liquor store package means an establishment engaged in the sale of packaged alcoholic beverages, such as beer, wine and liquor for consumption off the premises.

Lodginghouse or lodging facility means a building, or part thereof, utilized for transient occupancy other than a motel or hotel, where sleeping accommodations are provided without provisions for cooking by guests but which may or may not provide meals for guests and which also may serve as the residence of the operator. This term includes guesthouses, bed and breakfast, boarding houses, rooming houses and the like.

Maintenance and cleaning service means an establishment engaged in furnishing building, cleaning and maintenance services such as window cleaning, janitorial service, floor waxing and office cleaning.

Major household repair establishment means an establishment engaged in the repair of furniture, office equipment, yard equipment and home appliances.

Manufactured home or modular home means a dwelling unit fabricated in a manufacturing facility for installation or assembly at the building site, bearing a seal certifying that it is built in compliance with the federal manufactured housing construction and safety standards (24 CFR 3280) HUD code. Manufactured homes include modular homes as defined by F.S. ch. 553, pt. 1.

Manufactured mobile home sales means establishments engaged in the retail sale of new and used manufactured and mobile homes. These establishments also sell related items for the manufactured and mobile homes.

Manufacturing, heavy, means a use involving the basic processing of material or products predominately from extracted or raw materials, or a use engaged in storage of, or manufacturing process using flammable or explosive materials, or storage or manufacturing process that potentially involve hazardous or commonly recognized offensive conditions. This use is prohibited in the city.

Manufacturing, light, means a use involving the manufacturing, predominately from previously prepared materials, of finished products or parts, including processing, fabrication, assembly, treatment, packaging, incidental storage, sales and distribution of such products, but excluding basic industrial processing. This use is prohibited in the city.

Marijuana. All parts of any plant of the genus Cannabis, whether growing or not; the seeds thereof; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its seeds or resin, including low-THC cannabis.

Medical and dental office means a building or portion of a building wherein general or specialized medical and dental services are offered by licensed practitioners. This definition includes an establishment operating as a clinic for a physician or dentist.

Medical laboratory means an establishment engaged in providing professional analytic or diagnostic services to the medical profession or to the patient on prescription of a physician.

Medical marijuana treatment center. A facility licensed by the state department of health to cultivate, process, transport, or dispense marijuana or marijuana delivery devices.

Medical marijuana treatment center dispensary. A facility that is operated by a medical marijuana treatment center or other organization or business holding all necessary licenses and permits from which marijuana, cannabis, cannabis-based products, or cannabis plants are delivered, purchased, possessed, or dispensed for medical purposes and operated in accordance with all local, federal and state laws. Physicians authorized by state law to order low-THC cannabis, as defined in Florida Statutes, for patients' medical use are not included in the definition of medical marijuana dispensary.

Miniature golf means a golf course consisting of a minimum of 18 miniature golf holes consisting of artificial turf and related entertainment and visual effects. All golf holes shall be approximately 25 to 30 feet long. Ancillary uses may include the following: a sales office and or shop, coin-operated vending machines and a snack bar.

Mini warehouse (self-service storage facility) means a building consisting of individual small self- contained units that are leased or owned for the storage of business and household goods or contractor's supplies.

Minor household repair establishment means an establishment engaged in minor repairs of household and personal items such as television sets, radios, jewelry, clocks and shoes.

Mobile food dispensing vehicle means any vehicle, cart, and/or trailer that is a "public food service establishment" as defined by F.S. ch. 509, and that is self-propelled or otherwise movable from place to place and includes self-contained utilities, including, but not limited to, gas, water, electricity, or liquid waste disposal.

Mobile home means a detached single-family dwelling unit with the following characteristics:

(a)

Designed for long term occupancy and containing sleeping accommodations, flush toilet, a tub or shower bath, and kitchen facilities, with plumbing and electrical connections provided for attachment to outside systems;

(b)

Manifestly designed for transportation after fabrication on streets or highways on its own wheels; and

(c)

Arriving at the site where it is to be occupied as a dwelling complete, including major appliances and furniture, and ready for occupancy except for minor and incidental unpacking and assembly operations, location of jacks or other temporary or permanent foundations, connection to utilities, and the like. A travel trailer is not to be considered as a mobile home.

Mobile home park means a premises where lots are offered for rent for the parking and accommodation of mobile homes for living and sleeping purposes, including any land, building, structure, or facility used by the occupants of mobile homes on such premises. No part of any park shall be used for non-residence purposes except such uses that are required for the direct services and well-being of park residents and for the management and maintenance of the park in accordance with this said ordinance. This section shall not be deemed to prohibit the operation of a sales office within the park where such office is situated within a mobile home located in said park and connected to pertinent utilities; provided, however, that such sales office may only be utilized for the purpose of selling mobile homes located in the said mobile home park.

Mobile home subdivision means a parcel of land meeting the requirements for subdivision under regulations of the city where lots are sold to mobile home owners for the purpose of placing mobile homes on such lots for living and sleeping purposes, including any land, building, structure, or facility used for common purposes by the residents of such mobile home subdivision. A mobile home subdivision must meet the standards of Ordinance 71-3, Code of Subdivision Regulations, City of Dunnellon, Florida.

Model manufactured home center means premises or a portion of premises designed to display a maximum of six new model manufactured homes per acre with a total aggregate not to exceed 18. Orders will be taken on site so duplicate or custom made manufactured homes can be fabricated at a manufacturing facility. Each model manufactured home shall include landscaping, skirting and a furnished interior.

Modular home. See definition of manufactured home.

Motel means a building, or part thereof, in which sleeping, and/or living accommodations are offered to the public primarily on a short term or transient basis, with access to the individual units from the exterior of the building and parking facilities for use by guests near their quarters.

Motion picture theaters (except drive-in) means commercially operated theaters engaged in the indoor exhibition of motion pictures.

Multifamily dwelling means a building containing three or more dwelling units.

Multipurpose facility means a facility that consists of a large flat floor space with oval shaped portable and permanent seating for such events as sporting and entertainment events, conventions and trade shows.

Museum/art gallery/antique gallery means an establishment engaged in the nonprofit or profit operation of museums, art galleries and antique galleries.

Nursery and garden sales means an establishment engaged in selling trees, plants, seeds, mulches, soil conditioners, fertilizers, garden tools, and other garden supplies. These establishments primarily sell products purchased from nursery farms, but may sell some plants which they grow on-site.

Nursery farm means an establishment having as the principal purpose of business the production of horticultural products for the purpose of non-retail sales in bulk quantities to persons who intend resale of the products so bought. Horticultural nursery farms do not include horticultural nursery sales.

Nursery school means a place for the day care and/or instruction of four or more children not remaining overnight and not related by blood or marriage to the operator.

Nursing home means a building where residents are provided with full time nursing services, as defined by F.S. ch. 464, pt. 1, on a 24-hour basis and the number of beds are licensed by the agency for health care facilities. Nursing homes are regulated in this code as a non-residential use. Nursing homes do not include assisted living facilities, congregate care facilities, adult day care facilities, community residential homes or transitional recovery facilities.

Outside sales means the display and sales of items.

Package store means a place where alcoholic beverages are dispensed or sold in containers for consumption off the premises.

Packing and crating means an establishment engaged in packing, crating and otherwise preparing goods for shipping.

Park/open space area means a tract of land within the city that is dedicated for recreation activity and which is maintained as public property.

Parking means the temporary, transient storage of private passenger motor vehicles used for personal transportation, while their operators are engaged in other activities. It shall not include storage of new or used cars for sale, service, rental, or any other purpose other than specified above.

Parking lot/garage, commercial means a parking facility that charges a parking fee and serves as the primary use on the lot.

Parking lot, commercial means a parking lot that is the primary use of a lot and charges a fee for parking.

Parking lot, surplus means a parking lot that serves a business located on a different lot and provides only surplus parking spaces not required to comply with the minimum number of parking spaces required for the business use that it serves.

Pawn Shop means a shop where a pawnbroker conducts business. Such a business involves providing loans to people with personal items as collateral; engaging in the business of purchasing goods for consignment or trade; and may have a public display containing the term "pawn," "pawnbroker," "pawnshop," or a sign historically identified with pawns.

Pest control service means an establishment engaged in disinfecting dwellings and other buildings, and in termite, insect, rodent and other pest control, generally in dwellings or other buildings.

Pet, household means an accessory use and are permitted in all zones. Household pets shall not be considered to include poultry, cattle, horses, ponies, pigs, lambs, sheep, goats or other animals normally raised for food and all such animals are specifically prohibited in residential zones.

Pharmacy means an establishment engaged in the retail sale of prescription drugs and nonprescription medicines. Accessory uses are limited to the sale of medical equipment and supplies.

Photocopying and duplicating services means establishments engaged in reproducing text, drawings, plans, maps, or other copy, by blueprinting, photocopying, mimeographing or other methods of duplication other than printing or microfilming.

Photo finishing laboratory means an establishment engaged in developing film and in making photographic prints and enlargements for the trade or for the general public.

Physical fitness center means an establishment engaged in operating health clubs, spas, and similar facilities featuring exercise and other active physical fitness conditioning, whether or not on a membership basis. Also included are establishments providing aerobic dance and exercise classes. Such facilities include uses such as game courts, exercise equipment, locker rooms, Jacuzzis and or saunas, tanning facilities and pro shops.

Pitch and putt facility means a par-three golf course consisting of a minimum of nine holes and a maximum of 18 holes. A pitch and put facility shall be a minimum of five acres and a maximum of 30 acres. Ancillary uses may include the following: practice bunkers, practice putting greens, sales office and or golf pro shop, coin operated vending machines and a snack bar.

Playground equipment sales, outdoor, means the display and sale of completely assembled and finished playground equipment sets on a continuous basis outside of a completely enclosed building.

Poultry means any chickens, turkeys, ducks, geese or guinea fowls.

Poultry market means a commercial establishment or place where live poultry or fowls are kept and prepared for sale, including killing or cleaning.

Prepackaged software services means an establishment engaged in the design, development and training of prepackaged computer software.

Print shop means a retail establishment that provides duplicating services using photocopy, blueprint, and offset printing equipment, including collating of reports.

Private club means those associations of a fraternal or social character not operated or maintained for profit. The term shall not include casinos, nightclubs, bottle clubs or other institutions operated as a business, which would be governed by chapter 10 of the city's Code of Ordinances.

Professional and business office means a building or portion of a building wherein services are performed involving predominantly administrative, professional or clerical operations. It is characteristic of a professional or business office that retail or wholesale goods are not displayed or delivered from the premises. A professional and business office includes but is not limited to insurance companies, travel and employment agencies, stockbrokers, architects, engineers, attorneys, accountants, real estate agencies, advertising agencies, finance companies and title agencies.

Public and semipublic uses means a use owned or operated by a public entity such as federal, state, county or city government or agency thereof. Semi-public uses include uses owned or operated by special districts, community-development districts and similar entities. Semi-public uses do not include facilities owned by property owner associations.

Public parking means a parking area for public use on city or county-owned properties within a lot or garage/deck either free of charge or paid by a rate established by owner. Public parking shall meet the design requirements of Code of Ordinances (Code) appendix A, Zoning, section 5.2 and the landscaping requirements of Code sections 74-108 and 74-109. Parking garages/decks shall be prohibited in single-family residential districts.

Public transportation terminal means premises, or a portion of premises, occupied by an establishment engaged in providing public use passenger transportation by railway, highway or water, normally for a fee or a charge. Public transportation terminals may include maintenance facilities and or freight transportation, which is incidental and accessory to the principal use of passenger transportation services.

Radio/TV broadcasting facility means an establishment engaged in broadcasting audio and visual programs to the public, as well as the location of transmitters on the property.

Recreation facility, indoor, means a building used for active and passive recreation activities such as basketball, volleyball and community events. This facility may not be used for commercial related activities.

Recreational vehicle sales means an establishment engaged in the retail sale of new and used motor homes, recreational trailers and campers.

Recycling center means a building in which used materials are separated and processed prior to shipment to others who will use those materials to manufacture new products.

Recycling collection point means an incidental use that serves as a neighborhood drop off point for temporary storage of recoverable resources. No processing of such items would be allowed. This facility would generally be located in a shopping center parking lot or in other public or quasi-public areas, such as churches and schools.

Recycling plant means a facility that is not a junkyard or an automobile wrecking yard and in which recoverable resources, such as newspapers, magazines, books and other paper products, glass, metal products, plastic products, automobile parts and other products are recycled, reprocessed and treated to return such products to a condition in which they may again be used for production. This does not include a junk yard or an automobile wrecking yard.

Repair garage means a building, or portion thereof, other than a private garage or service station, designed or used for repairing, equipping or servicing of motor vehicles, including both minor and major mechanical overhauling, and paint and body work. The definition for a repair garage may also include an establishment contracting with other businesses to maintain (wash, wax, polish, detail and tint) a fleet of vehicles.

Research and testing laboratory means premises, or portion of premises, occupied by an establishment engaged in research and testing on a commercial basis, normally on a contract basis for a fee or charge, or nonprofit organization primarily engaged in research and the dissemination of information for the public health or welfare.

Residence-gallery means a single structure that houses both an antique or art gallery and a residential unit used by the proprietor of that gallery. No more than one employee not living on the premises shall be allowed and no more than 20 percent of the total square footage of the residence shall be allowed for the use as a gallery. Parking and signage requirements shall be governed by article IX of this appendix.

Residence office means a single structure that houses an office and a residential unit used by the proprietor of that office. No more than one employee not living on the premises shall be allowed and no more than 20 percent of the total square footage of the residence shall be allowed for use as an office. Parking and signage requirements shall be governed by article IX of this appendix.

Restaurant (enclosed) means a building or room, not operated as a dining room with a hotel, where food is prepared and served for pay for consumption on the premises, or for takeout in an enclosed container. A dining room in connection with a hotel is an accessory use. A restaurant is not considered a fast food restaurant or drive in /through restaurant or refreshment stand.

Restaurant means a building or room, not operated as a dining room in connection with a hotel, where food is prepared and served for pay for consumption on the premises.

Roadside food fruit and vegetable sales means a premises, or a portion of premises, occupied by an establishment engaged in the selling of fruit and vegetables displayed outdoors directly to consumers on the premises and not for resale.

Schools, public and private, means elementary and secondary schools furnishing academic courses, ordinarily for kindergarten through grade 12. This includes only school related buildings and grounds. A facility offering only pre-kindergarten and kindergarten education is considered a day care facility.

Security systems service means an establishment engaged in monitoring and maintaining security systems devices, such as burglar and fire alarms. These establishments may also sell or install the security systems, which they monitor and maintain.

Self service station/convenience store means an establishment where motor fuel is pumped into a motor vehicle by a person other than the service station personnel, and may include a retail establishment offering for sale food products prepackaged or prepared when ordered, household items and other goods commonly associated with a grocery store.

Single-family dwelling means a building containing only one dwelling unit.

Specialty retail store:

Apparel and accessory store means an establishment engaged in the sale of apparel and accessory items, such as uniforms, raincoats, sports apparel and umbrellas.

Bookstore means an establishment engaged in the sale of new and used books, magazines and pertinent accessories.

Camera and photographic supply store means an establishment engaged in the sale of cameras, film, and other photographic supplies and equipment, as well as film developing.

Florist means an establishment engaged in the sale of cut flowers and plants.

Food store means an establishment specializing in the sale of foods such as dairy products, candy, health food, coffee, tea, meats, seafood, fruits, vegetables and beverages.

Gift, novelty and souvenir shop means an establishment engaged in the sale of combined lines of gifts and novelty merchandise, souvenirs, greeting cards, holiday decorations and art supplies.

Hobby, toy and game shop means an establishment engaged in the sale of toys, games, and hobby and craft kits and supplies.

Jewelry store means an establishment engaged in the sale of any combination of lines of jewelry, such as rings, bracelets, broaches, and watches.

Miscellaneous retail store means an establishment engaged in the retail sale of specialized lines of merchandise, such as stamps, pets, coins and optical items.

Music store means an establishment engaged in the sale of records and prerecorded audiotapes, videotapes, disks and other pertinent accessories.

Shoe store means establishments engaged in the sale of footwear, including athletic footwear. These establishments also stock accessory items, such as hosiery, gloves and handbags.

Solar farm means lands containing multiple ground mounted solar panels, ancillary equipment, and buildings used for the collection, storage, and transmission of solar power as electricity by commercial and/or public enterprises. Such facilities shall be ten acres or more in size and capable of generating a minimum of one-megawatt of power per hour.

Sporting goods store means an establishment engaged in the sale of sporting goods, sporting equipment, and bicycles, bicycle parts and accessories.

Stationery store means an establishment engaged in the sale of stationery, such as paper and paper products, postcards and paper novelties. These establishments may also sell additional lines of office type supplies, such as accounting and legal forms, handbooks, and office forms and supplies.

Speech and language center/school means an establishment associated with a hospital or public or private school that provides speech and language rehabilitation services in a classroom setting to communicatively impaired children and adults. In addition, the establishment may also provide accessory services in the form of outpatient treatment of children and adults recovering from a stroke, head trauma, or other injury and disease processes that affect speech and learning functions.

Stable means a building where animals are kept for hire, sale, boarding, riding or show.

Swimming pool sales (enclosed) means an establishment housed in a completely enclosed building, engaged in the retail sale of swimming pools, spas, hot tubs, swimming pool chemicals and accessories.

Swimming pool sales (outdoor sales) means an establishment engaged in the retail sale of swimming pools, spas, hot tubs, swimming pool chemicals and accessories in which some or all to the swimming pools, spas or hot tubs are displayed in an outdoor display area or outdoor display and sales area.

Tattoo or body piercing establishment means an establishment at which:

(a)

The skin of a human body is marked:

(1)

By piercing in or otherwise applying coloring matter so as to form indelible or lasting marks or figures; or

(2)

By the production of scars.

(b)

The human body is penetrated, or a hole is made in the human body, to place jewelry or other objects for nonmedical purposes. Provided, an establishment at which a mechanized, pre-sterilized ear piercing system is used to penetrate the outer perimeter or lobe of the ear or both is not a body-piercing establishment.

Temporary commercial amusement means a transient activity which does not require the construction of a permanent structure or involve the use of any premises for an extended period by an establishment engaged in the commercial operation of such activity for a profit, fee, admission charge or other similar means of compensation. Temporary commercial amusements include circuses, carnivals, rodeos and similar promotional enterprises of a transient nature.

Tent means any structure or enclosure the roof of which and/or one-half or more of the sides, are of silk, cotton, canvas, fabric or a light material.

Tourist camp or park means a lot of ground upon which three or more single-family camp cottages or tents are located and maintained for the accommodation of transients, whether or not a charge is made.

Tourist court means a group of attached or detached dwellings which are provided primarily for transient guests, including auto courts, motels and motor lodges.

Tourist home means a building, or part thereof, other than a motel or hotel, where sleeping accommodations are provided for transient guests, with or without meals, and which also serves as a residence of the operator.

Trailer, travel or camping means a vehicular, portable structure built on a chassis, designed to be used as a temporary dwelling for travel, recreational, and vacation purposes which:

(a)

Is identified on the unit by the manufacturer as a travel trailer;

(b)

Is not more than eight feet in body width; and

(c)

Is of any weight provided its body length does not exceed 29 feet, or is of any length provided its gross weight, factory equipped for the road, does not exceed 4,500 pounds.

Transient or transient occupancy means a [temporary] residential dwelling.

Transitional/recovery facility means:

(a)

A facility providing lodging for persons progressing from treatment or incarceration for alcoholism, drug addiction, criminal conduct, delinquency, mental or emotional illness or similar condition, with the intention of returning its residents to normal participation in community life; or

(b)

A building that provides housing and a living environment for the persons who have demonstrated a tendency towards alcoholism, drug abuse, anti-social or criminal conduct, and is operated to facilitate their re-integration into the community, but does not provide treatment for alcohol or drug abuse (commonly referred to as a "halfway house").

This category shall not include a facility or dwelling defined as an assisted living facility; hospital, medical/dental office or community residential home.

Truck/freight terminal means a building or area in which freight brought by truck is assembled and or stored for routing or re shipment, or in which semi-trucks are parked or stored.

Truck rental and sales means an establishment engaged in the short term or extended-term rental of trucks and semi-trailers or in the sale of trucks and semi-trailers. This category may also include the rental or sale of horse trailers.

Two-family dwelling means a building containing only two dwelling units.

Use means the purpose for which land or a structure thereon is designated, arranged or intended to be occupied or utilized, or for which it is occupied or maintained.

Use of land means use of water surface and land under water to the extent covered by zoning districts, and over which the county has jurisdiction.

Use, first permitted in "X" district means a use which in the sequence of successively less restricted districts occurs as a permitted use for the first time in the "X" district.

Use, non-residential means a use permitted in a specific residential zoning district, which is not residential in character.

Use, residential means a use for living or sleeping of persons, not institutional in character, such as a one-family, two-family or multiple dwelling, hotel, motel, tourist home, lodginghouse, villas, bungalow court.

Used merchandise store means an establishment engaged in the sale of used merchandise, antiques and secondhand goods such as clothing, and shoes, furniture, books, office furniture, records, and store fixtures and equipment, as well as items associated with a pawn shop.

Vehicles means motor vehicles defined in F.S. § 320.01.

Vehicle storage area means the parking and storage of recreational vehicles, vessels, and camping vehicles in multifamily developments that shall be regulated in accordance with the supplementary district regulations section of this code.

Veterinarian office means an establishment in which animals are provided veterinarian services by a trained veterinarian. A veterinarian office may include grooming and boarding facilities.

Video arcade—stand-alone means a building utilized for amusements, such as games.

Video arcade—accessory means a game room located within an establishment such as a movie theater or restaurant that is the principal use.

Videotape store means an establishment engaged in renting recorded videotapes and disks to the general public for personal or household use.

Vocational professional school means an establishment engaged in furnishing non-academic instruction and trade courses.

Warehouse means a building used for the storage of goods and materials.

Warehousing and distribution means a building used or engaged in the storage, wholesale and distribution of manufactured products, supplies and equipment.

Section 7.3 - Similar and compatible use determinations.

A use proposed in a zoning district, which is not specifically listed in the zoning regulations or table of permitted uses in this article as a permitted use or special exception, may be allowed if the proposed use is similar and compatible with the uses specifically allowed as permitted or by special exception within the same zoning district. An applicant has the burden of proving by competent substantial evidence that a proposed use is "similar and compatible" with permitted or special exception use or uses within a zoning district. The proposed use is similar and compatible if:

(a)

It is consistent with the comprehensive plan;

(b)

It falls within the same density or intensity requirements of the zoning district;

(c)

It promotes the intent and purposes of the zoning district;

(d)

It has substantially similar public safety (fire and police), transportation, water, solid waste, and other infrastructure impacts; and

(e)

It is not in conflict with and would not adversely affect other allowed or existing uses of surrounding properties.

The application fee for similar and compatible use determinations shall be the same as that for special exception applications. If the applicant proposes that the use is similar and compatible to that of a special exception use, the applicant shall pay two application fees, and the city can consider both applications at public hearings concurrently. Public hearings shall be held before the planning commission and city council on the application. A similar and compatible use determination decision shall be in writing by development order pursuant to state law.
