Exceptions and Modifications
§ 228-235 Exceptions to height limitations.

Penthouses or roof structures for the housing of elevators, stairways, tanks, ventilating fans, air conditioning equipment or similar equipment required to operate and maintain the building, fire or parapet walls, skylights, steeples, flagpoles, chimneys, smokestacks, water tanks, or silos may be erected above the height limits prescribed in this chapter.
§ 228-236 Exceptions to area requirements.
A single family dwelling may be constructed in a district where permitted on any lot shown on a recorded subdivision plat or any lot of official record as of November 25, 1958, the owner of which does not own any adjoining lot or adjacent land, provided that in the opinion of the Board of Adjustment, the lot area and proposed yard spaces satisfy as closely as possible the lot and yard requirements of this chapter for the district in which such lot is located. Where the owner of a substandard size lot owns adjacent lots or parcels of land, such lots or parcels shall be considered as a single lot, and the area and yard space provisions of this chapter shall hold.
§ 228-237 Exceptions to yard requirements.

A.
Recognizing that there are trends in home planning and lot arrangement to secure the full benefit of sunlight, prevailing winds and other amenities which may necessitate variation in the front, side and rear yard requirements of this chapter, such variation may be permitted in the case of isolated homes, groups of homes or neighborhood layouts, provided that the site plans thereof are first approved by the Planning Board.
B.
Where a lot is situated between two lots, each of which is developed with a main building which projects beyond the established front building line and has been so maintained since November 25, 1958, the minimum front yard requirement of such lot may be the average of the front yards of the existing buildings. Where a lot adjoins one lot developed as described above and a vacant lot, the minimum front yard requirement of such lot may be the average of the front yard of the existing building and the established front setback line.
C.
Where an existing dwelling is on a lot the width of which is less than the minimum prescribed for the district in which such lot is situated, the minimum side line requirements for the erection of a garage or carport shall be five (5) feet.
D.
The following features may project into a required yard

1.
Eaves, cornices, cantilevers, chimney or roof overhang not to extend more than 2 feet from a single family dwelling. In no event shall such a projection be closer than 5 feet to a property line.

Ramps, lifts or similar devices for handicap access.

Landings or platforms no greater than 25 square feet in area.
