Ecorse City Zoning Code

ARTICLE 1

- TITLE AND PURPOSE

1.1.- Preamble.

Pursuant to the authority conferred to the City of Ecorse by the Michigan Zoning Enabling Act, Public Act 110 of 2006 of the State of Michigan, as amended, the city council of the City of Ecorse hereby adopts the following regulations on the use of land and structures for the purpose of promoting and protecting the public health, safety, convenience, and general welfare of the current and future inhabitants of the city. Provision is made herein for:

The conservation and protection of land resources while providing reasonable use and enjoyment by residents, businesses and industry thereby ensuring land uses shall be situated in appropriate locations and compatible with the existing or planned development of the surrounding area;

B.

To limit overcrowding of land and the ecosystem;

C.

To facilitate adequate and efficient provision for the transportation system, sewage disposal, water, energy, education, recreation, emergency services and other public service and facilities; and

D.

To retain and improve the quality of life in the city.

1.2. - Title.

This ordinance shall be known and may be cited as the City of Ecorse Zoning Ordinance, as amended and is referred to herein as the "ordinance."

1.3. - Purpose.

In accordance with the authority and intent of Michigan Zoning Enabling Act, Public Act 110 of 2006 as amended, the city desires to provide for the orderly development of the city, which is essential to the wellbeing of the community and which will place no undue burden upon developers, industry, commerce, or residents. The city further desires:

A.

To regulate the efficient and proper use of land and natural resources;

B.

To regulate the location, size and types of uses;

C.

To specify standards such as minimum area, maximum height, setbacks, bulk and the maximum number of families that may be housed in structures to ensure sufficient open space, sanitary conditions, safety and other protective measures;

D.

To regulate the density of development;

E.

To divide the city into districts and establishing the boundaries thereof;

F.

To provide for changes in the regulations, restrictions, and boundaries of such districts;

G.

To define certain terms used herein;

H.

To designate the use of certain state licensed residential facilities;

I.

To provide methods to adopt amendments;

J.

To provide for administration;

K.

To provide for the collection of fees to administer and enforce the regulations of this ordinance;

L.

To provide penalties for violations; and

M.

To provide for petitions, public hearings and appeals.

1.4. - Area of jurisdiction.

The provisions of this ordinance shall apply to all development, public and private, throughout the incorporated areas of the City of Ecorse, Wayne County, Michigan, to the extent permitted by law. The area of jurisdiction is referred to herein as the "city."

1.5. - Relationship to the master plan.

This ordinance is a tool used by the community to effectuate the recommendations of the City of Ecorse Master Plan, along with other planning documents, which serve as a guide to the long-term physical development of the city.
