1246.01 - Establishment.

(a)

For the purpose of this zoning code, the city is hereby organized into the following districts:

(1)

Conservation district:

C Conservation

(2)

Residential:

R-1 Single-family

R-EL Single-family estate lot

R-2 Multiple-family

(3)

Business:

B-1 Central business

B-2 Commercial/business

MU-1 Downtown mixed use

(4)

Manufacturing:

M-1 Light manufacturing

(5)

Public service:

IP Institutional and public services

(6)

Floodplain:

FP Floodplain overlay

(b)

The zoning districts and the minimum area that may constitute a separate or detached part of a zoning district shall be as follows:

(1)

Conservation district, ten acres;

(2)

R-1 Single-family residence district, five acres;

(3)

R-EL Single-family residence district, estate lot, five acres;

(4)

R-2 Multiple-family dwelling district, one acre;

(5)

Central business district, one acre;

(6)

Commercial/business district, one acre;

(7)

Downtown mixed use, one acre;

(8)

Light manufacturing district, five acres;

(9)

Floodplain overlay district, based upon current FEMA map.

1246.02 - Official zoning map.

(a)

The city is herby divided into zones, or districts as shown on the official zoning map which, together with all explanatory matter thereon, is hereby adopted. Said maps are made part of the Edwardsville Zoning Code and shall have the same force and effect as if the official zoning map, together with all notations, references and other information shown thereon, were fully set forth and described herein.

(b)

The official zoning map shall be identified by the signature of the mayor attested by the city clerk, and bearing the seal of the city under the following words:

"This is to certify that this is the Official Zoning Map referred to in Section 1246.02 in Ordinance No. 4779-3-95 of the City of Edwardsville, Illinois",

together with the date of adoption.

(c)

Changes made in district boundaries or other matter(s) as portrayed on the official zoning map, such changes shall be made on the map promptly after the amending ordinance is passed by the city council. No changes can be made on the official zoning map except only in conformity with the procedures set forth in the ordinance.

(d)

Regardless of the existence of published copies of the official zoning map, which may from time to time be made available to the public for a fee, the official zoning map of the city shall be located in the office of the administrator and shall be the final authority as to the current status of land use.

(e)

The official zoning map shall be annually published and reprinted no later than March 31 of each calendar year, pursuant to 65 Illinois Compiled Statutes, 5/11-13-19. In the event that the official zoning map becomes damaged, lost, destroyed or difficult to interpret because of the nature of number of changes or additions, the city council may by resolution adopt a new official zoning map which shall supersede the prior map. The new map may correct drafting or other errors or omissions in the prior official zoning map, but no such correction shall have the effect of amending the original official zoning map. Unless the prior map has been destroyed, or lost, the prior map or any significant parts thereof remaining shall be preserved, together with all available records pertaining to its adoption and amendment.

1246.03 - District boundaries.

When uncertainty exists with respect to the boundaries of the various districts as shown on the official zoning map, the following rules shall apply:

(a)

District boundary lines are either the centerlines of railroads, highways, streets, alleys or easements, or the boundary lines of sections, quarter sections, divisions of sections, tracts or lots, or such line extended, unless otherwise indicated.

(b)

In areas not subdivided into blocks and lots, wherever a district is indicated as a strip adjacent to and paralleling a street or highway, the depth of such strips shall be in accordance with the dimensions shown on the official zoning map measured at right angles from the centerline of the street or highway, and the length of frontage shall be in accordance with dimensions shown on the map from section, quarter section or division lines, or centerlines of streets, highways or railroad rights-of-way unless otherwise indicated.

(c)

Where a lot held in one ownership and of record on the effective date hereof is divided by a district boundary line, the entire lot shall be construed to be within the less restrictive district, provided that this shall not apply if it increases the less restrictive frontage of the lot by more than 25 feet.

1246.04 - Zoning of streets, alleys, public ways, waterways and rights-of-way.

All streets, alleys, public ways, waterways and railroad rights-of-way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately abutting upon such alleys, streets, public ways, waterways and railroad rights-of-way. Where the centerline of a street, alley, public way, waterway or railroad right-of-way serves as a district boundary, the zoning of such areas, unless otherwise specifically designated, shall be deemed to be the same as that of the abutting property up to the centerline.

1246.05 - Zoning of annexed land.

All territory which may hereafter be annexed to the city shall be zoned in any of the following ways:

(a)

Subject to all of the regulations of an R-1 single-family residential district until otherwise changed by an amendment to the zoning code, if so designated by council, attested by the city clerk only after such hearing and upon the adoption of a resolution or ordinance directing such execution, which resolution or ordinance must be passed by a vote of three-fourths of all members of the city council.

(b)

Any annexation agreement executed pursuant to this section and pursuant to the provisions of 65 Illinois Compiled Statues, 5/11-15-1-1 through 5/11-15-1-5, shall be binding upon the successor owners of record of the land which is the subject of the agreement and upon successor authorities of the city.

1246.06 - Status of annexed territory.

(a)

Any territory hereinafter annexed to the city shall automatically be in the zoning district category or categories herein established that are most similar to that zoning district or zoning districts the subject territory shall have enjoyed at the time of annexation under the Madison County, Illinois Zoning Ordinance as established, adopted and enacted therein until duly changed by an amendment to this title; except that the city council, with the advice of the plan commission, may annex any territory as any other district or districts herein established if all legal requirements for zoning the property at the time of annexation and the requirements for amending this title by the extensions of the zoning district provisions are met.

(b)

City zoning district categories as established herein and zoning districts as established in Madison County, Illinois Zoning Ordinance

shall be and are hereby declared to have the greatest similarity (in way of zone district permitted uses, accessory uses, variations, special use permits, area and bulk regulations, parking requirements and signs).
