CHAPTER 17

04 - GENERAL PROVISIONS

17.04.010 - Title.

Title 17 of the Farmersville Municipal Code shall be known and may be cited as the "Farmersville Zoning Ordinance" and also as the zoning title.

17.04.020 - Adoption.

There is adopted, as provided in this title, a zoning title for the city, said title being a precise and detailed plan for the use of land based on the general plan of the city. This title is adopted pursuant to the provisions of Chapter 4 of Title 7 of the Government Code of the state of California.

17.04.030 - Purpose.

The zoning title is enacted in order to promote the public health, safety, comfort and general welfare, to provide a plan for sound and orderly development, and to ensure social and economic stability within the various zones established by the provisions of this title.

17.04.040 - Application.

The provisions of this title shall apply to all land and all owners of land within the incorporated limits of the city and shall be applicable not only to private persons, agencies, and organizations but also to all public agencies and organizations to the full extent that such provisions may now or hereafter be enforceable in connection with the activities of any such public agency or organization. In their interpretation and application, the provisions of this ordinance shall be held to be minimum requirements.

17.04.050 - Content.

The zoning title shall consist of zoning maps designating certain districts and a set of regulations controlling the uses of land, the density of population, the uses and locations of structures, the height and bulk of structures, the open space about structures, the external appearance of certain uses and structures, the areas and dimensions of sites, and requiring the provision of off-street parking, off-street loading facilities, landscaping, signage, accessory buildings and structures.

17.04.060 - Permitted and prohibited land uses.

A.

Table 1 in FMC Section 17.40.020 (residential land uses), Table 2 in FMC Section 17.56.020 (commercial land uses), Table 3 in FMC Section 17.60.020 (industrial land uses), generally identify permitted uses, permitted accessory uses, permitted temporary uses and uses permitted subject to the approval of a conditional use permit, or uses requiring some other permit or approval. Table 1 in FMC Section 17.40.020 (residential land uses) and Table 2 in FMC Section 17.56.020 (commercial land uses) also identify some land uses that are specifically not permitted or which are prohibited.

B.

Notwithstanding any other provision in this Title 17 of the FMC, any land use not listed in the tables identified in this section are prohibited unless the planning commission or zoning administrator, pursuant to this Title 17 of the FMC, are authorized to and do determine that the use is similar and no more detrimental than a listed permitted or conditional use.

C.

Notwithstanding any other provision in this Title 17 of the FMC, any use which is prohibited by state and/or federal law or which violates state and/or federal law is not permitted.

D.

It is unlawful and is hereby declared a public nuisance for any person owning, leasing, occupying or having charge or possession of any real property within the City of Farmersville to maintain such real property in such a manner that an unauthorized, non-permitted or prohibited land use exists thereon.

17.04.070 - Relationship to California Environmental Quality Act.

When a project is determined to be subject to the provisions of the California Environmental Quality Act (CEQA), the project shall be reviewed in accordance with the provisions of this title, California Public Resources Code section 21000 et seq., section 15000 et seq. of Title 14 of the California Code of Regulations (the CEQA Guidelines) and any additional environmental guidelines or regulations adopted by the City of Farmersville.
