32 - R-M MULTIPLE FAMILY RESIDENTIAL ZONE
Sections:
To provide residential areas which can accommodate a suitable mixture of more intensive land uses, including multiple family dwellings, community facilities and offices, compatible with the surrounding area and consistent with the general plan. This district provides for two multiple family residential base zones: RM-2.5 and RM-4.0. Properties designated with these zones may be developed in accordance with development standards contained in this chapter and consistent with policies contained in the general plan.

The uses permitted in the R-M zone shall be those specified in the residential land use table (Chapter 17.40) and subject to the special conditions accompanying those tables.

No principal building shall exceed three stories or thirty feet height, except as provided in Chapter 17.88.

The following minimum requirements shall be observed:
A.
1.
Lot Width:
a.
Corner Lot: Seventy feet,
b.
Interior Lot: Sixty feet;
2.
Exceptions to this requirement are as follows: Any lot facing a cul-de-sac or a curved street having a radius of less than one hundred feet at the property line shall have a minimum frontage of at least fifty feet measured along the front property line.
B.
Front Yard Setback: Fifteen feet (also applies to portable carports);
C.
Side Yards Setback:
1.
Interior Side—One Story: Five feet;
2.
Interior Side Over One Story: Ten feet;
3.
Street Side of Corner Lot: Ten feet (also applies to portable carports);
D.
1.
Rear Yard Setback: Ten feet.
2.
Exceptions to this requirement are as follows:
a.
Churches, public buildings, schools, parks and playgrounds shall have a minimum rear yard setback of twenty feet;
b.
Swimming pools, spas, jacuzzis, ponds or other similar structures shall have a minimum setback of five feet;
c.
Accessory structures such as cabanas, deck covers, shall have a minimum setback of one foot providing drainage runoff is directed away from adjacent property.
E.
1.
Lot Area:
a.
Nine thousand square feet for apartments;
b.
Eight thousand four hundred square feet for duplexes.
2.
Maximum Coverage: Seventy percent of lot area including parking.
3.
Exceptions to this requirement are as follows:
a.
Any legally created lot not meeting the minimum lot area requirements, may be occupied by any use permitted by this chapter if all yard setback and minimum dwelling size requirements are met.
b.
Lodges, clubs, public and private schools, clinics, hospitals, rest homes, nursing and convalescent homes shall have a minimum lot area not less than ten thousand square feet.
F.
Density.
1.
RM-2.5: The maximum density shall be one dwelling unit per one thousand seven hundred square feet of lot area. For lots of at least 0.6 acre in size there shall also be a minimum density of twenty units per acre (in addition to the maximum density of one thousand five hundred square feet of lot area per dwelling) unless the applicant can demonstrate that a lesser density will achieve affordability standards contained in the Farmersville Housing Element.
2.
RM-4.0: One dwelling unit per 4,000 square feet of lot area.

A.
Access From a Public Street. There shall be an open access from the street to a rear dwelling of not less than ten feet in width. When two rows of dwelling groups face each other, the minimum distance between shall be twenty feet in width.
B.
Distance Between Buildings on Property:
1.
One Story: Ten feet;
2.
Two Story: Fifteen feet.
C.
All uses are subject to the provisions of Chapters 17.76, 17.80 and 17.84.
D.
Plot plan approval by zoning administrator required for all uses requiring a building permit with a value in excess of fifty dollars. For projects with three or more units, site plan approval by planning commission required.
E.
All driveways and parking areas are to be paved.
F.
Minimum apartment size shall be:
1.
One bedroom, one bath shall be five hundred seventy-five square feet of living area, not to exceed twenty-five percent of units on parcel;
2.
Two bedroom, one bath shall be seven hundred fifty-five square feet of living area, not to exceed fifty percent of units on parcel;
3.
Three bedroom, two bath unit shall be nine hundred sixty square feet of living area.
G.
Minimum duplex size shall be nine hundred sixty square feet per unit.
H.
One garage or carport shall provide one and one half covered spaces for each apartment, and two covered spaces for each single-family or duplex unit. A garage or carport shall not be converted for other uses unless an equivalent number of covered parking spaces (in a garage or carport) is provided elsewhere within the buildable portion of the lot.
I.
Multi-family development projects shall be limited to a maximum of forty units on any given site.
J.
Multi-family developments shall be required to enter into a maintenance agreement with the city, prior to occupancy. The maintenance agreement shall be reviewed and approved by the planning commission.
K.
A traffic study shall be required for all multi-family residential projects of twenty units or greater.
