Ordinance Amendments And Zone Changes

31.21.010 Changes

The Governing Body may from time to time after receiving a report thereupon by the Town Planning and Zoning Commission and after public hearings required by law amend, supplement or change the regulations or zones set forth herein or subsequently established. Any amendment, supplement or change may be initiated by the Commission or by petition of affected persons as hereafter provided:

  1. The purpose of the procedures established by this Article is to provide for appropriate and timely ordinance amendments and district zone changes. Any person, firm or corporation may propose a zone change for a single parcel or contiguous parcels and shall initiate such proceeding by filing with the Commission a proper and complete application for such change on such forms as may be prescribed by the Planning Commission and the payment of the fee provided in GTC 31.21.020.
  2. The application for a zoning change shall include the following:
    1. The applicant’s name, address and interest in the request and the name and address of every person represented by the applicant. In addition, the applicant shall file an affidavit signed by the owner(s) to attest that he is authorized and empowered to act for them in such proceedings.
    2. The proposed zoning change including a sufficiently accurate map that describes the area affected.
    3. A statement showing that present conditions require the proposed change to permit the proper utilization of the property in accordance with acceptable planning and zoning principles.
    4. A verified list of the names and addresses of the record owners of all properties lying within the proposed change area and of all properties and parts of which are within 200 ft., excluding the width of any intervening streets or alleys, of the proposed zone changes.

31.21.020 Fees

For the purpose of covering the cost of mailing notices, posting, making and printing maps, investigations, analyses, administrative and other expenses involved in the zone change, the following fees shall apply. All fees are payable preceding the stated actions and no refunds shall be made.

  1. R-1, R-2, MUR, MH and SR $25.
  2. CBD,GB, I and PUD $125.
  3. Public Land and Institutions No Fee.

31.21.030 Governing Body Action

Upon receipt of the Commission’s report and recommendation, the Governing Body shall hold a public hearing thereon after giving at least a thirty (30) day notice by publication in the official Town newspaper and mailing by first class notice to those property owners on the verified list. The Governing Body may thereupon take appropriate actions. The Governing Body must approve or disapprove all proposed zoning amendments or changes within ninety (90) days after the Governing Body has held the required public hearing.

31.21.040 Enforcement

It shall be the duty of the Town Zoning Officer to enforce the Town Zoning Ordinance. It shall be the duty of the Town Attorney to prosecute any violations brought to him by the Town Zoning Officer.

31.21.050 Zoning Officer

  1. There is hereby created the Office of the Zoning Officer. The Zoning Officer shall be the individual as designated by the Governing Body.
  2. The Zoning Officer shall have the following powers and duties:
    1. Administer rules and procedures which include the development of necessary forms, permits and procedures not described by this Ordinance;
    2. Receive all applications for variances, conditional uses, zone changes and amendments to this Ordinance, refer such applications to the proper agencies for review and submit to the Commission and the Governing Body all such applications together with the recommendations of the reviewing agencies and the recommendations of the Planning Office;
    3. Participate, when deemed appropriate, in public hearings or meetings before the Commission and the Governing Body on variances, Conditional Use Permits, zone changes or amendments to this Ordinance;
    4. Maintain the Official Zoning Map or maps showing the current zoning classification of all of the incorporated lands within the Town of Glenrock;
    5. Propose to the Commission and the Governing Body any changes to this Ordinance or the Official Zoning Map that, from time to time, may be desirable or necessary. All such changes shall be subject to the amendment procedures set forth in this Ordinance;
    6. Maintain such records and files as may be necessary in the efficient conduct of the above duties; and
    7. Administer the Flood Damage Prevention regulations of GTC 31.15.

31.21.060 Zoning Certificates

  1. No building shall be commenced, erected or altered; nor any building, electrical or plumbing permit issued by the Building Inspector until a Zoning Certificate has been issued by the Zoning Officer certifying that the proposed structure or structures comply with all of the provisions of this Ordinance. Excluded shall be any internal renovations which do not change the use of the structure. Zoning Certificates shall be required for the installation of all mobile homes.
  2. The Town Zoning Officer shall issue a Zoning Certificate for all changes in use that are declared use changes on the town building permit.

31.21.070 Manufactured Housing Application

It is the burden of the applicant to certify compliance with the requirements for manufactured housing. This can be completed through certification by the manufacturer that the unit meets the HUD standards and GTC 31.01.040 Lot Line, Rear definition. Glenrock will not be required to inspect any units to determine compliance with the HUD Code. Glenrock shall establish a reasonable fee for inspecting the installation of the units to determine that they comply with the criteria established in this Ordinance. Glenrock will issue permits for installation of manufactured housing and inspect installation, including GTC 31.01.040 Manufactured Home definition Parts H and I.
