31.23 Historic

Area

31.23.010 Intent

It is the intent of this Article to provide areas, sites, landmarks or structures within any established zoning district to be officially designated as having historical significance for the benefit of interested owners and the general public and to protect against destruction or encroachment upon such areas, sites, landmarks or structures; to encourage uses which will lend support to their continuance, preservation, conservation and improvement, in a manner appropriate to the preservation of the historic heritage of the Town of Glenrock, Wyoming; to prevent the creation of environmental influences adverse to such purpose; and to ensure that new construction and uses within such areas or sites shall be in keeping with the character of the area or site to be preserved and enhanced.

31.23.020 Historic Significance Criteria

  1. Areas, sites, landmarks or structures will be considered for historic overlay of designation only if they meet one (1) or more of the following criteria:
    1. Associated with an historical event or time which has local, statewide, regional or national impact.
    2. Associated with a figure of local importance who had an impact on the settlement of Glenrock or Converse County; who made a substantial contribution to the local business economy, local building or construction industry or figured prominently in acquiring statehood for Wyoming.
    3. Associated with a figure of local, state, regional or national importance who had an impact locally, on a statewide basis, regionally or nationally, in the fields of energy development, agriculture or ranching, government, the arts, architecture, the transportation industry or the entertainment industry.
    4. Structures that were constructed fifty (50) or more years previous to the year the application for historic overlay zoning is submitted.
    5. An example of an architectural style which is unique locally or on a statewide basis or which is one of a few remaining examples of an architectural style on a local or statewide basis.
    6. The first known structure(s) to be used for a particular purpose on a local or statewide basis.
    7. Established as having been committed to the same use over a period of fifty (50) or more years on a business, industrial, governmental or commercial basis.
  2. In order to maintain high standards for historical designation and to meet the intent of this Section, no structure shall be considered for historic area designation if it has been so structurally altered that its historical integrity has been destroyed. This opinion will be based upon information available to the Planning Commission, Historical Commission and the Wyoming State Historical Preservation Office.

31.23.030 Preparation Of Proposals For Historic Areas

  1. Proposal for historic areas may be prepared by any interested property owners, the Governing Body or the Historical Commission with the written consent of the property owners. The Governing Body and the Historical Commission will work with the owners of the property or structures under consideration and may request advice and assistance of historical associations and other organizations or individuals qualified by interest, training and experience in preparing said proposals.
  2. Each proposal shall contain the following information:
    1. Proposed boundaries drawn to include all properties within the area proposed for historic area designation to include both sides of the streets and to divide the proposed historic area zone from other areas at rear lot lines, alleys or other points where subdivisions will create minimum interference. Internal boundaries may divide the proposed historic area into sub-areas as appropriate for regulatory purposes.
    2. Proposed boundaries for transitional areas drawn to include any surrounding areas which are visually related to the proposed historic area designation for regulatory and protective purposes, provided said areas may create a potentially adverse environmental influence on the proposed historic area.
    3. A report establishing and defining the historical and cultural features of the area or structure(s) and features of substantial pubic objectives for conservation, development or redevelopment. Said report shall include:
      1. An analysis of the area or the structure’s local, state, regional or national historic importance. Period of construction (if known), historical importance or prominence of persons associated with the area or structure(s), condition, present use and other matters relating to planning or regulating future development such as location on lot(s), location of yard(s) and other open spaces, access to the interior of the block and off-street parking provided. In addition to the general analysis, two (2) specific and detailed classifications shall be established:
        1. A classification of individual areas and structure(s) of substantial public interest with maps, photographs and other data indicating the public importance of preservation and particular features it is desired to preserve.
        2. A classification of existing areas, structures, premises and uses which may have an adverse effect on the desired character of the area or structure(s) including those adjacent to or near and visually related to the other area or structure(s) with maps, photographs and other data indicating the reasons for such classification.
      2. An analysis of lands not occupied by structure(s) including lands near and visually related to the proposed historic area. In addition, public lands, ownership, use and location shall be located.
      3. Recommendation concerning detailed regulations to be applied within the area or for the structure(s) and transitional areas, to supplement or modify general regulation set forth herein, including permitted and prohibited principal and accessory uses and structure(s), minimum lot and yard requirements, maximum lot coverage by all buildings, maximum height of structures, off-street parking and loading requirements, control of exterior character of buildings and sites and control of additions to or removal of existing buildings.
      4. If applicable, plans for public action in or adjoining the proposed historic area and likely to affect its character or development.

31.23.040 Procedures

  1. The above information shall be submitted to the Planning Commission. The Planning Commission shall forward a copy of the information to the Historical Commission for review for compliance with the Historical Significance Criteria and all appropriate adopted town plans, policies and regulations.
  2. Within thirty (30) working days of receipt of the proposal, the Planning Commission shall forward their recommendation to the Historical Commission. The Historical Commission shall then recommend approval or denial of the proposed historic area and shall state the reasons for its decision in writing. If approval is recommended, the Historical Commission may suggest regulations or guidelines to apply in the proposed area and any proposed transitional areas.
  3. The proposal, the review of the Planning Commission and the recommendation of the Historical Commission shall then be forwarded to the Governing Body. The Governing Body shall consider the above information at a public hearing to be held at a regularly scheduled council meeting after consideration of the proposal and recommendation of the Historical Commission. Comments from the owner(s) and other interested persons shall be heard at the public hearing. The Governing Body shall, within fifteen (15) calendar days of the hearing, recommend written approval or deny the proposed historic area; and, if approved, the regulations and guidelines which shall apply to the historic area and any transitional area.

31.23.050 Removal Of Historic Area Designation

The historic area designation may be removed from any area, site or structure(s) upon application to and approval of the Governing Body if it is proven by the owner(s) that:

  1. strong reasons exist which make it no longer feasible for the owner(s) to adhere to historic area guidelines established for the area, site or structure(s); or
  2. the site, area or structure(s) have deteriorated so that the site, area or structure(s) is no longer safe.
