CHAPTER 5

COMMERCIAL ZONE

11-5-1: PURPOSE:

The purpose of the commercial zone is to establish distinct zones regulated to fulfill general retail needs and travel or highway related service requirements within the community and cultural needs of the community. (Ord. 626, 10-7-2002)

11-5-2: PERMITTED USES:

The following uses are allowed in the C zone:
Those uses allowed in the R-1/R-2 district.
Accessory uses to the uses allowed.
Automobile sales and service.
Automobile sales lot.
Automobile service stations.
Boarding and rooming houses.
Bowling alley, dance hall or similar commercial establishments for public gatherings or recreational use.
Clinics.
Club or lodge.
Commercial and private off street parking lots for passenger automobiles.
Cultural facilities.
Government or public utility facilities of a nonindustrial character.
Mortuaries.
Nursery schools, schools for students of art, dancing, dramatics, music, business, or secretarial work.
Professional offices/financial.
Radio, television and FM broadcasting stations.
Recreational vehicle park.
Restaurants and other eating establishments.
Retail stores and personal service shops, including shopping centers.
Taverns or lounges.
Theater, indoor.
Trailer sales and rental. (Ord. 626, 10-7-2002; amd. Ord. 652, 8-21-2006)

11-5-3: SPECIAL USES:

The planning commission may, after proper notice and public hearing, permit the following uses where such uses are deemed essential or desirable to the public convenience or welfare. The commission shall have the authority to impose such conditions and safeguards as it deems necessary to protect the best interests of the surrounding property or neighborhood from damage, hazard, nuisance or other detriment:
Auction establishment.
Automobile and truck repair shop.
Boarding kennel.
Commercial storage buildings for belongings and effects.
Drive-in theater.
Hospital.
Recycling collection center.
Rest and convalescent home.
School, public.
All other uses not mentioned but similar in nature to the special uses listed above may be considered under a special use permit upon permission of the city. (Ord. 626, 10-7-2002)

11-5-4: HEIGHT REGULATIONS:

Any building, structure, or portion thereof hereafter erected, shall not exceed thirty feet (30') in height unless approved by variance. A variance shall be required to exceed this height. Provided, however, this height restriction shall not apply to utility poles, traffic signs and/or traffic lights. Utility poles, or traffic lights and signs exceeding seventy feet (70') shall require a review and approval by city council by variance. This exemption only applies to utility poles, signs and lights on public rights of way placed there by the state highway department or public utility. (Ord. 686, 1-21-2014)

11-5-5: SETBACK REQUIREMENTS:

   A.   No front or side yard shall be required, except that when a building or group of buildings abuts upon a residential district, a yard shall be provided on the side of a lot abutting the residential district having a width of not less than ten feet (10').
   B.   There shall be a rear yard with a depth of not less than fifteen feet (15') when abutting upon a residential zone. The rear yard may be used for off street parking and loading.
   C.   Residential uses within this zone shall have the same setback and side yard and fence requirements as set forth in the R-1/R-2 zone. (Ord. 626, 10-7-2002)

11-5-6: AREA REQUIREMENTS:

There shall be no minimum lot sizes except that residential uses shall have the same area requirement as set forth in the R-1/R-2 zone. (Ord. 626, 10-7-2002)

11-5-7: ACCESSORY USES:

Accessory uses are permitted if constructed either at the same time or subsequent to the main building. Such uses shall be limited to two (2) stories in height and shall not encroach upon required setback areas. (Ord. 626, 10-7-2002)

11-5-8: OFF STREET PARKING REQUIREMENTS:

Off street parking requirements are defined in chapter 12 of this title. (Ord. 626, 10-7-2002)
