CHAPTER 6

INDUSTRIAL ZONE

11-6-1: PURPOSE:

The Industrial Zone is established to provide for and encourage the grouping together of light industrial uses capable of being operated under such standards as to location and appearance of buildings and the treatment of the land about them, that they will be unobtrusive and not detrimental to surrounding commercial or residential uses. 11-6-2: PERMITTED USES:

The following uses are allowed in the I Zone:
   A.   Manufacturing, assembling, fabricating, processing, packing, repairing, or storage uses which have not been declared a nuisance by statute, resolution, or any court of competent jurisdiction and provided these uses shall not cause:
      1.   Dust, smoke, gas, fumes, noise, vibration, or odor beyond the boundaries of the site on which such use is conducted that is declared unduly hazardous or injurious to other properties in the vicinity or to the general public as shall be determined by the Commission,
      2.   Hazard of fire, explosion, or other physical damage to any adjacent building or plant growth.
   B.   Wholesale, warehousing, storage, and distribution;
   C.   Contracting equipment, maintenance or operating equipment of public agencies or public utilities or materials and equipment. of a similar nature including lumber, coal, sand and gravel yards;
   D.   Food processing;
   E.   Laundry and dry cleaning of an industrial character;
   F.   Broadcasting tower for radio or television;
   G.   Single-family home owned by industrial user on property. (Ord. 626, 10-7-2002)

11-6-3: SPECIAL USES:

The Planning Commission may, after proper notice and public hearing permit the following uses where such uses are deemed essential or desirable to the public convenience or welfare. The Commission shall have the authority to impose such conditions and safeguards as it deems necessary to protect the best interest of the surrounding property or neighborhood from damage, hazard, nuisance, or other detriment.
   A.   Boarding kennel;
   B.   Storage, for wholesale or for distribution in bulk, of any flammable liquid above or below ground;
   C.   Grain elevator and bulk storage such as for potatoes, hay and other similar uses;
   D.   Sewage treatment plant and similar facilities;
   E.   Railroad boxcars, motor vehicle cargo containers or other containers normally used for the shipment of freight, cargo or other items, by rail, ship or motor vehicular transportation, wherein the applicant desires to cause the same to be located upon property within the City for storage or other purposes. Said containers are specifically prohibited from being located within any other zone within the City;
   F.   Recycling collection center;
   G.   Auction establishments; 0203
   H.   Those uses allowed and special uses permitted in the Industrial Zone; except residential unless the use meets the requirements of subsection 11-6-2G;
   I.   Bulk storage of corrosive acid or alkali, creosote, fertilizer, fireworks, and highly combustible materials.
All other uses not mentioned but similar in nature to the special uses listed above may be considered under a special use permit upon permission of the City. (Ord. 626, 10-7-2002)

11-6-4: HEIGHT REGULATIONS:

Any building or structure or portions thereof hereafter erected shall not exceed five (5) stories or thirty feet (30'), whichever is greater unless permitted to exceed this height by special use permit. A special use permit shall be required to exceed this height. (Ord. 626, 10-7-2002)

11-6-5: SETBACK REQUIREMENTS:

The following are setback requirements for the Industrial Zone:
   A.   Front Yard: The front yard setback shall be a minimum of twenty feet (20') when a lot abuts, touches or adjoins, or is across the street from a residential district, otherwise no front yard setback is required.
   B.   Side Yard: The side yard shall be minimum of fifteen feet (15') when a lot abuts, touches or adjoins a residential district, otherwise no side yard setback is required.
   C.   Rear Yard: The rear yard shall be a minimum of fifteen feet (15') when a lot abuts, touches, or adjoins a residential district, unless abutting a six foot (6) setback is required along alley right of way, otherwise no rear yard setback is required. (Ord. 626, 10-7-2002)

11-6-6: AREA REQUIREMENTS:

There shall be a minimum lot size of one-quarter ('/,) acre unless allowed to be less by special use permit. (Ord. 626, 10-7-2002)

11-6-7: ACCESSORY USES:

Accessory uses are permitted. (Ord. 626, 10-7-2002)

11-6-8: OFF-STREET PARKING REQUIREMENTS:
