CHAPTER 1153

Enforcement

1153.02 REVOCATION OF CERTIFICATE OF ZONING COMPLIANCE.

   Upon the determination of the Zoning Official, any Certificate of Zoning Compliance issued upon a false statement shall be void. Upon such determination, the Zoning Official shall provide notice of such determination to the owner and occupant of such property in the same manner as any notice of violation as described in this Code, currently described in section 1155.02, as may be amended from time to time. Any party affected by such determination shall have the right to appeal such determination to the Board of Zoning Appeals within ten days of receipt of such notice. Upon the timely filing of such appeal, the Board of Zoning Appeals shall schedule and conduct an administrative appeal hearing to hear and decide appeals where it is alleged there is an error in any interpretation, judgment, decision or determination made by the Zoning Official in the administration and enforcement of the provisions of these regulations. Any party aggrieved by a decision of the Board of Zoning Appeals may appeal within thirty days of the date of decision to the Court of Common Pleas of Hamilton County. Any person who shall proceed thereafter with such work or use without having obtained a new Certificate of Zoning Compliance, in accordance with these regulations, shall be deemed guilty of a violation thereof.

1153.03 SCHEDULE OF FEES.

   The Village Council shall by Ordinance, establish a schedule of fees for Certificates of Zoning Compliance, amendments, appeals, variances, conditional use permits, plan approvals, and other procedures and services pertaining to the administration and enforcement of this Code. The schedule of fees shall be posted in the office of the Zoning Official, and may be altered or amended only by the Village Council. Until all such appropriate fees, charges, and expenses have been paid in full, no action shall be taken on any application, appeal, or administrative procedure.
