CHAPTER 1117

Lots of Record

1117.01 DWELLING ON ANY LOT OF RECORD.

   In any district where dwellings are permitted, a single family detached dwelling may be erected on any lot of official record at the effective date of this Ordinance, irrespective of its area or widths, provided the applicable yard and other open space requirements satisfying the following requirements: that on lots of record which do not meet the minimum yard requirements for the corresponding district as of the effective date of this code, the minimum yard setback shall be determined by the proportional application of the requirements specified in that corresponding district. However, those modified setbacks shall not be greater than 50% of the minimum setback required in that district except as otherwise provided by this Code.

1117.02 NON-CONFORMING DWELLING UNITS.

   Any legally permitted dwelling unit existing within a non-residential district on the effective date of the adoption of this Code may continue as a dwelling use provided that the dwelling conforms with the regulations set forth in Chapter 1123, Non-Conforming Uses.

1117.03 LIMITATION OF ONE MAIN BUILDING ON LOT.

   (a)   Every building hereafter erected or structurally altered shall be located on a lot as herein defined, and in no case shall there be more than one main building on a lot except as specifically provided hereinafter in Section 1117.01.
   (b)   Where a proposed building/development is located on several lots of record, such parcels shall be consolidated prior to issuance of a Certificate of Zoning Compliance. Furthermore, all accessory structures shall be located on the same parcel as the principle use.
