CHAPTER 1255

HD, Historic District

1255.01 PURPOSE.

   This district is intended to serve as the historic center of the City. A limited range of retail, service, craft, community activities, governmental, and religious uses are permitted. Development standards recognize the special parking, pedestrian, building location, and building characteristics needs of an established and growing historic district.

1255.02 PERMITTED USES.

   Land and structures in the HD, Historic District may be used for the following purposes only.
   (a)   Retail businesses that are directly associated with the historic theme of the district along with limited souvenir type commodities sold either indoors or outdoors.
   (b)   Personal service establishments that are directly associated with the historic theme of the district conducted within a completely enclosed building.
   (c)   The display, sale, and demonstration of crafts and trades directly associated with the theme of the district done either indoors or outdoors.
   (d)   The hosting of community activities either indoor or outdoor.
   (e)   Government buildings and post office constructed with an exterior theme compatible to the theme of the historic district.
   (f)   Restaurants, taverns, catering establishments, and other food services associated with a community activity served either indoors or outdoors.
   (g)   Limited commercial and public recreation establishments.
   (h)   Bakery or confectionery shops.
   (i)   Fraternal or social club or lodge.
   (j)   Bed and breakfasts, hotels and motels limited to a maximum of six rooms available for rent.
   (k)   Churches, synagogues, or other similar places of worship and customary related uses.
   (l)   Essential public service equipment.
   (m)   Accessory uses, buildings and structures customarily incidental to the above uses.
   (n)   Other uses which are determined by the Zoning Administrator to be similar to the above uses and which meet the intent of this district.

1255.03 DISTRICT REGULATIONS.

   Buildings and structures shall not be located, erected, or enlarged unless the following requirements are met and maintained.
   (a)   Minimum lot area and width - None required.
   (b)   Minimum required building setbacks.
      (1)   Front yard - None required except along the perimeter of the district then a minimum of ten feet shall be required.
      (2)   Side yard and rear yard - None required, except that all buildings and structures within the district shall be no less than ten feet from any other building or structure.
   (c)   Maximum lot coverage - 40 percent.
   (d)   Maximum building height - 35 feet.
   (e)   Dumpsters shall be located at the most distant point from the main pedestrian areas and shall be screened as required by Section 1258.07(l).

1255.04 ADDITIONAL REGULATIONS.

   (a)   The off-street parking regulations of Chapter 1260 shall not apply.
   (b)   Signs shall be regulated by Chapter 1259.
   (c)   All buildings and structures shall require site plan approval by the Hart Historic District Commission prior to submittal to the Planning Commission.
   (d)   Landscaping shall be as regulated by Section 1243.22.
   (e)   All buildings and structures shall have a historical facade that is comparable to those in the district as approved by the District Commission and Planning Commission.

1255.05 DEVELOPMENT PLAN REVIEW PROCEDURE.

   (a)   The Planning Commission may require, in reviewing a plan, independent professional studies, including, but not limited to, traffic studies, soil borings, and/or floodplain determinations to evaluate the suitability of the plan.
   (b)   Prior to reaching a finding, the Commission shall conduct a development plan review hearing, subject to the notice requirements of Section 1242.06.
