401. - Official zoning district map.

A.

Map status. The official zoning district map described in this section, a reduced copy of which is attached to this code and the originals thereof which are on file at the city hall of the City of Hedwig Village and in the office of the city secretary of said city, and bear the signatures of the city secretary and the mayor, shall be as much a part of this code as if the information contained therein was set out in full in this code.

B.

Procedures.

(1)

Adoption and amendment of the official zoning district map shall be in accordance with the provisions of this zoning code.

(2)

Two copies of the map shall be filed with the city secretary, one of which shall be prominently displayed and available for public inspection. Any amendments to the map shall be considered amendments to this code, as soon as the same are properly enacted, the two maps in the office of the city secretary shall be properly changed.

C.

District boundaries. The boundaries of each of the zoning districts of the city are legally described as follows:

1.

Business district B. That portion of the area within the corporate limits as the same was on the ground and existed on date of incorporation along the north boundary line thereof and more particularly described as follows:

BEGINNING at the northeast corporate corner, said point being the intersection of the west right-of-way line of Voss Road with the south right-of-way line of Katy Highway;

THENCE west, following the curves and angles of the new south right-of-way line of Katy Highway to the northwest corporate corner, said point being the intersection of the south right-of-way line of Katy Highway with the east right-of-way line of Bunker Hill Road;

THENCE south along said east right-of-way line of Bunker Hill Road to the southwest corner of a 6.881 acre, more or less, tract now or formerly owned by Horst Mehl and the northwest corner of a 0.863 acre, more or less, tract now or formerly owned by F.C. Kuhlman;

THENCE in an easterly direction along the south line of tracts now or formerly owned by said Horst Mehl, W.L. Farmer, Elizabeth Cooperwood, E.C. Kolbe, O.B. Glass, and Alvin R. Petrick and continuing along in the same direction to the west line of Echo Lane;

THENCE east across Echo Lane to the east line of Echo Lane where it intersects the southeast corner of the Carl Sakwitz tract;

THENCE along the south line of the Carl Sakwitz tract to the southeast corner of the Carl Sakwitz tract;

THENCE north along the east line of the Carl Sakwitz tract and continuing along the east line of the E.G. Watson tract to a point where the line intersects the south line of the tracts formerly owned by Egon H. Muller, Walter J. Riedel, Selma Kunze, Emma Pack, Helen Smith, Rudolph G. Riedel, and E.C. Kuhlman, same being the northeast corner of the E.G. Watson tract;

THENCE east along the south line made by the Egon H. Muller, Walter J. Riedel, Selma Kunze, Emma Pack, Helen Smith, Rudolph G. Riedel, and E.C. Kuhlman tracts to the east right-of-way line of Hillendahl-Piney Point Road in the west line of the school tract;

THENCE north along said west line of school tract to its northwest corner;

THENCE east along the north line of said school tract to its most northerly northeast corner in the west line of a 3.6 acre tract now or formerly owned by F.C. Kuhlman;

THENCE south along said west line of F.C. Kuhlman 3.6 acre tract to its southwest corner;

THENCE east along the south line of said Kuhlman 3.6 acre tract to its southeast corner and the most southerly northeast corner of said school tract;

THENCE south along the east line of said school tract and the west line of a 8.98 acre, more or less, tract now or formerly owned by Ira C. Corbin to the north right-of-way line of Corbin Road;

THENCE in a northeasterly direction, following the north right-of-way line of Corbin Road to the most northerly southeast corner of said Ira C. Corbin 8.98 acre tract;

THENCE east along the south lines of tracts now or formerly owned by Tom D. Ruland, Andrew J.D. Fuller, W.D. Baird, and R.H. Stuart tracts and the north line of Vernon L. Miller 2.365 acre tract to the west line of the L.J. Riedel 6.5 acre tract;

THENCE south along said west line of L.J. Riedel 6.5 acre tract to the center line of Hunters Branch;

THENCE in a northeasterly direction, following the meanders of the center line of Hunters Branch to the west right-of-way line of Voss Road;

THENCE north along said west right-of-way line of Voss Road to the PLACE OF BEGINNING.

a.

Business district B-1.

BEGINNING at the intersection of the south right-of-way line of Katy Highway and the west right-of-way line of Echo Lane, being the northeast corner of district B-1 and the northwest corner of district B-4;

THENCE westerly along said south right-of-way line of Katy Highway, same being a part of the north outside perimeter line of district B, a distance of 1,760 feet, more or less, to the northwest corner of the residual 12.0555 acre Target tract of land as described in deed recorded in Volume 7422, Page 167, Real Property Records, Harris County, Texas, same being the northwest corner of district B-1 and the northeast corner of district B-3;

THENCE southerly along the west line of said tract of land 806.35 feet, more or less, to a point in the east-west outside perimeter line of district B, same being the southeast corner of district B-3 and the southwest corner of district B-1;

THENCE easterly with the south outside perimeter line of district B to its intersection with the west line of Echo Lane, said point being the southeast corner of district B-1 and the most westerly southwest corner of district B-4;

THENCE northerly along the west line of Echo Lane to the PLACE OF BEGINNING.

b.

Business district B-2

BEGINNING at the intersection of the south right-of-way line of Gaylord Drive and the east right-of-way line of Brogden Road, said point being the northeast corner of district B-2;

THENCE westerly along said south right-of-way line of Gaylord Drive to its intersection with the west line of school tract, same being a point in the outside perimeter line of district B, said point also being the northwest corner of district B-2;

THENCE southerly with the west line of said school tract, same being a part of the outside perimeter line of district B to its intersection with the north right-of-way line of Corbindale Road, said point being the most westerly southwest corner of district B-2, same also being a corner of district B;

THENCE in a northeasterly direction along the said north right-of-way line of Corbin Road, a curve to the left, to the most northerly southeast corner of a 8.98 acre tract owned or formerly owned by Ira C. Corbin, same being a part of the outside perimeter line of district B;

THENCE east along the south lines of tracts owned or formerly owned by Tom D. Ruland, Andrew J.D. Fuller, W.D. Baird and R.H. Stuart tracts and the north line of Vernon L. Miller 2.365 acre tract to the west line of the L.J. Riedel 6.5 acre tract, same being a part of the south outside perimeter line of district B;

THENCE south along said west line of L.J. Riedel 6.5 acre tract, same being a part of the outside perimeter line of district B, to the center line of Hunters Branch;

THENCE in a northeasterly direction, following the meanders of the center line of Hunters Branch, same being an outside perimeter line of district B to its intersection with the east right-of-way line of Brogden Road, said point being the southeast corner of district B-2;

THENCE northwesterly and northerly along said east right-of-way line of Brogden Road to the PLACE OF BEGINNING.

c.

Business district B-3.

BEGINNING at the intersection of the south right-of-way line of Katy Highway and the east right-of-way line of Bunker Hill Road, said point being the northwest corner of district B and of district B-3 and the northwest Corporate corner;

THENCE south along said east right-of-way line of Bunker Hill Road to the southwest corner of a 6.881 acre more or less tract now or formerly owned by Horst Mehl and the northwest corner of a 0.863 acre more or less tract now or formerly owned by F.C. Kuhlman, same being the west outside perimeter line of district B, said point being the southwest corner of district B and of district B-3;

THENCE in an easterly direction along the south line of tracts now or formerly owned by Horst Mehl, W.L. Farmer, Elizabeth Cooperwood, E.C. Kolbs, O.B. Glass and Alvin R. Petrick, same being a part of the outside perimeter line of district B, to the southwest corner of the residual 12.0555 acre Target tract of land as described in a deed recorded in Volume 7422, Page 167, Real Property Records, Harris County, Texas, said point being a point in a south outside perimeter line of district B, said point also being the southeast corner of district B-3 and the southwest corner of district B-1;

THENCE northerly along the west line of said tract of land, described in a deed recorded in Volume 7422, Page 167, Real Property Records, Harris County, Texas, to the northwest corner of said tract in the south right-of-way line of Katy Highway, said point being a point in an outside perimeter line of district B, said point also being the northeast corner of district B-3 and the northwest corner of district B-1;

THENCE westerly along said south right-of-way line of Katy Highway, same being a part of the north outside perimeter line of district B to the PLACE OF BEGINNING.

d.

Business district B-4.

BEGINNING at the northeast Corporate corner, said point being the intersection of the west right-of-way line of Voss Road and the south right-of-way line of Katy Highway, said point being the northeast corner of district B and district B-4;

THENCE west following the curves and angles of the new south right-of-way line of Katy Highway, same being a part of the north outside perimeter line of district B, to its intersection with the west right-of-way line of Echo Lane, said point being a point in a north outside perimeter line of district B and being the northwest corner of district B-4 and the northeast corner of district B-1;

THENCE southerly along said west right-of-way line of Echo Lane to its intersection with the south right-of-way line of Gaylord Drive, said point being a point in a part of the south outside perimeter line of district B and being the most westerly southwest corner of district B-4 and the southeast corner of district B-1;

THENCE east across Echo Lane to the east line of Echo Lane where it intersects the southeast corner of the Carl Sakwitz tract, same being a part of the outside perimeter line of district B;

THENCE along the south line of the Carl Sakwitz tract, same being a part of the outside perimeter line of district B;

THENCE north along the east line of the Carl Sakwitz tract and continuing along the east line of the E.G. Watson tract, same being a part of the outside perimeter line of district B, to a point where the line intersects the south line of the tracts formerly owned by Egon H. Muller, Walter J. Riedel, Selma Kunze, Emma Pack, Helen Smith, Rudolph G. Riedel and E.C. Kuhlman, same being a part of the outside perimeter line of district B, and same being the northeast corner of the E.G. Watson tract;

THENCE east along the south line made by Egon H. Muller, Walter J. Riedel, Selma Kunze, Emma Pack, Helen Smith, Rudolph G. Riedel, and E.C. Kuhlman tracts, same being a part of the outside perimeter line of district B, to the east right-of-way line of Hillendahl-Piney Point Road in the west line of the school tract;

THENCE north along the west line of the school tract, same being a part of the outside perimeter of district B, to its northwest corner;

THENCE east along the north line of said school tract, same being a part of the outside perimeter of district B, to its northerly northeast corner in the west line of a 3.6 acre tract now or formerly owned by F.C. Kuhlman;

THENCE south along the west line of said F.C. Kuhlman tract, same being a part of the outside perimeter line of district B, to its southwest corner, same being a corner in district B;

THENCE east with the south line of said Kuhlman 3.6 acre tract, same being a part of the outside perimeter line of district B, to its southeast corner and the southerly northeast corner of said school tract, same being a corner in district B;

THENCE south along the east line of said school tract, same being a part of the outside perimeter of district B, to its intersection with the south right-of-way line of Gaylord Drive, said point being the northwest corner of district B-2;

THENCE easterly along the south right-of-way line of Gaylord Drive to its intersection with the east right-of-way line of Brogden Road;

THENCE south along the west right-of-way line of Brogden Road to the center line of Hunters Branch;

THENCE in a northeasterly direction, following the meanders of the center line of Hunters Branch to the west right-of-way line of Voss Road;

THENCE north along said west right-of-way line of Voss Road to the PLACE OF BEGINNING.

2.

Single-family dwelling district A. All of the area within the corporate limits of the City of Hedwig Village save and except that designated as single-family dwelling district C and business districts B-1, B-2, B-3 and B-4.

3.

Single-family dwelling district C. All of the area within the subdivision, Memorial Village Estates, as a plat thereof is recorded in Volume 101, Page 53, of the Map or Plat Records of Harris County, Texas.

D.

Rules for construing boundaries. In the event that any uncertainty exists with respect to intended boundaries of various districts as herein described or shown on the official zoning district map, the legal descriptions of said districts as herein set out shall apply; however, if uncertainty exists even after reference to the legal descriptions as herein set out, the following rules shall apply:

(1)

The district boundaries are the center lines of streets, alleys, waterways and rights-of-way, unless otherwise indicated. Where designation of a boundary line of the zoning district map coincides with the location of a street, alley, waterway or right-of-way, the centerline of such street, alley, waterway or right-of-way shall be construed to be the boundary of such district.

(2)

Where the district boundaries do not coincide with the location of streets, alleys, waterways and rights-of-way, but do coincide with lot lines, such lot lines shall be construed to be the boundary of such district.

(3)

Where the district boundaries do not coincide with the location of streets, alleys, waterways and rights-of-way or lot lines, the district boundary shall be determined by the use of the scale shown on the zoning district map.

(4)

Boundaries indicated as approximately following the city limits shall be construed as following the city limit lines.
