Sec. 3.01.- Establishment of districts.

For the purpose of this ordinance, the City of Henderson is hereby divided into zoning districts, designated as follows:

R-1 Low density residential district
R-2 Medium density residential district
R-3 Medium to high density residential district
R-4 Multi-family residential district
R-5 Medium density residential district
PUD Planned unit development district
R-MH Residential mobile home district
R-O Residential/office district
NB Neighborhood business district
GB General business district
CBD Central business district
HC Highway commercial district
M-1 Light industrial district
M-2 Heavy industrial district
AG Agricultural district
Riverfront zones
RF-1 Recreation, active and passive
RF-2 Light commercial
RF-3 Green space
District zones (see Articles XXXI, XXXII and XXXIII)
ARD Audubon residential district zone (Article 31)
ACD Audubon commercial district zone (Article 32)
GDZ Gateway district zone # 1 (Article 33)

Sec. 3.02. - Official zoning map.

The City of Henderson is divided into zoning classifications or districts as provided herein and as shown on the "Zoning Map Atlas of the City of Henderson, Kentucky," adopted on June 28, 1983, and as transferred to electronic format on the Henderson City-County Geographic Information System (HCCGIS) in 2002. The zoning map serves as the official record of the status for all zoning classifications, districts, or zones for land within the City of Henderson and shall be kept in electronic data bases that are maintained by the Henderson City-County Planning Commission staff. This electronic depiction of the zoning boundaries, along with additional reference data in the GIS, constitutes the official zoning map for the City of Henderson. This zoning map shall be kept up-to-date to reflect the adopted mapping data and all of its amendments by the Board of Commissioners in accordance with KRS Ch. 100. This zoning map may be viewed by the general public at the offices of the Henderson City-County Planning Commission and on the GIS website www.hccgis.com. Although every effort has been made to accurately transfer zoning districts from the physical map to the GIS, the retired zoning map atlas shall be kept on file in the office of the Henderson City-County Planning Commission, noted prominently with its retirement date, and used only for historical reference to clarify any discrepancies that may be noted in the use of the GIS zoning map atlas.

Sec. 3.03. - Interpretation of zoning district boundaries.

The following rules shall be used to interpret the exact location of the zoning district boundaries shown on the official zoning map are:

(a)

Where zoning district boundaries indicated as approximately following the center lines of streets, alleys, highways or railroads, street right-of-way line shall be construed to be such boundaries.

(b)

Where a zoning district boundary approximately follows a property line or a series of property lines, such line is the boundary of the district.

(c)

Where a zoning district boundary approximately follows a stream or the shoreline of a body of water, that stream or shoreline as defined on the date this chapter is enacted, is the boundary of this district.

(d)

Where a zoning district boundary does not clearly follow any of the features mentioned above, its exact location on the ground shall be determined by measurement according to the official map scale.

(e)

Where a zoning district boundary approximately follows a contour or soil boundary as defined by the U.S. Army Corps of Engineers, U.S. Geological Survey or Soil Conservation District, such contour or soil boundary is the boundary of the district.

(f)

In any case where the exact location of a boundary is not clear, the city board of zoning adjustment shall use these rules to determine the exact location upon application by the enforcement officer for an original interpretation.
