ARTICLE XXXV

R-SMH, RESIDENTIAL SUBDIVIDED MANUFACTURED HOME DISTRICT

Sec. 35.01.- Statement of purpose.

These districts are composed of areas containing manufactured home dwelling sites and/or single-family dwellings on individually owned parcels of ground and designed to accommodate manufactured homes for more or less permanent duration, single-family dwellings, as well as other compatible uses which provide related services. Such areas shall be well suited for residential purposes; commercial and office uses other than those incidental to the principal use are prohibited. These districts encourage a suitable living environment for family life by including among the permitted uses such facilities as schools and churches and preserve the openness of the areas by requiring that certain minimum yard and area standards be met.

Sec. 35.02. - Permitted uses.

In all R-SMH districts, no building or land, except as otherwise provided in this article, shall be erected or used except for the following specified uses:

(a)

Class A, B manufactured homes. No class C or D will be permitted.

(b)

Single-family dwellings.

(c)

Accessory uses.

(d)

Shipping container homes meeting general requirements of section 35.06.

Sec. 35.03. - Conditional uses.

(a)

Nonprofit public or private facilities such as schools, churches, parks, and recreational facilities.

(b)

Home occupations as defined in subsection 4.38(c) of this article.

(c)

Family child-care home, with the following limitations:

There shall be a maximum of ten (10) children allowed in the home of which no more than six (6) shall be unrelated to the care provider. No more than four (4) children under twelve (12) months of age nor more than six (6) children under six (6) years of age, including the provider's own or related children, shall be kept in the home.

No person may be employed that is not a resident of the premises.

3.

Otherwise fully complies with the provisions of a home occupation as provided in section 2.01 of this Code.

Residential care facilities.

Sec. 35.04. - Building site area.

(a)

Building site area: The minimum building site area shall be:

• For manufactured home dwelling unit or single-family dwelling: Six thousand (6,000) square feet*.

• For any permitted use other than manufactured home dwelling unit or single-family dwelling: Fifteen thousand (15,000) square feet.

(b)

Building site width: The minimum lot width at the building setback line shall be:

• For a manufactured home dwelling or single-family dwelling: Sixty (60) feet*.

• For any other permitted use: One hundred (100) feet.

(c)

Building site coverage: The maximum building site coverage by all buildings shall be forty (40) percent.

(d)

Building height limit: No structure shall exceed thirty (30) feet in height.

Sec. 35.05. - Setback requirements.

(a)

Manufactured home dwelling unit, single-family dwelling, or other permitted use, other than accessory structure:

• Front yard: Twenty (20) feet*.

• Side yard: Eight (8) feet*.

• Rear yard: Twenty (20) feet*.

* Unless otherwise set forth on a recorded plat approved prior to the adoption of this zoning designation.

(b)

Accessory structure:

• Shall meet the requirements of section 4.24-Accessory buildings, of this Code.

Sec. 35.06. - General requirements.

(a)

Every manufactured home dwelling unit shall be equipped with foundations and tie-downs intended to secure such units against movement. settling and overturning for the protection of life and property. Said foundation shall consist of a concrete slab, concrete ribbons or concrete piers. The proposed method of support and tie-downs shall meet the minimum standards set for manufacturers and shall be approved by the codes administrator prior to a building permit being issued. Failure to properly construct the support shall be cause for revocation of the building permit until such time that the concrete foundation passes inspection. No final inspection shall be performed until tie-downs and underpinnings have been installed.

(b)

All manufactured homes dwelling units shall be underpinned in a safe, attractive manner.

(c)

Each manufactured home dwelling unit site shall be provided with a stand consisting of either a solid concrete slab or two (2) concrete ribbons of a thickness of size adequate to support the maximum anticipated loads during all seasons.

(d)

Each manufactured home dwelling unit or single-family dwelling shall be provided with two (2) off-street parking spaces.

(e)

Parking for all other permitted uses shall meet the requirements of section 9.01-Off-street parking requirements, of this Code.
