1305.01 - SHORT TITLE.

This article shall be known and may be cited as the "Comprehensive Plan of Huntington, West Virginia, 1963."

1305.02 - PURPOSE.

The purpose of this article is to establish a single unified code, consisting of all plans, reports and ordinances, plus supplemental details, as contained in the report of the City Planning Commission, entitled "Comprehensive Plan of the City of Huntington, West Virginia" that deal with the subject of planning and zoning, as a comprehensive guide for the future growth and development of the city.

1305.03 - ADOPTION.

The maps, charts, plans and reports which compose the Comprehensive Plan are on file in the office of the planning director in the City Hall, and are available for public inspection during all regular office hours of the director, and the same are hereby adopted as the "Comprehensive Plan Ordinance of the City of Huntington, West Virginia, 1963," which is hereby referred to, adopted by reference and made a part hereof as if fully set out in this article in accordance with W. Va. Code, § 8-11-4, and also in accordance with W. Va. Code, § 8-24-21.

1305.04 - CONTENTS.

The Comprehensive Plan consists of a descriptive report dated October, 1962, entitled "Comprehensive Plan of the City of Huntington, West Virginia", together with the provisions of the maps, charts, plans and ordinances which have heretofore or may hereafter be prepared concerning the following subject: zoning, subdivision control, thoroughfares, schools, parks, recreation and public areas and a separate plan entitled "Comprehensive Development Plan".

1305.05 - COMPLIANCE.

The layout, location, relocation, extension or widening of thoroughfares, the general design of neighborhoods and their street patterns, the use of land and the general locations of sites for schools, parks, recreational and other public uses, shopping centers and community facilities shall conform to the principles, policies and provisions of the Comprehensive Plan.

1305.06 - EFFECT.

Council and all municipal boards, commissions and all other agencies of the city shall be guided by and give consideration to the general policy and pattern of development set out in the Comprehensive Plan prior to the authorization, construction, alteration or abandonment of any public installation, required or necessitated in the interest of the physical development of the city.

1305.07 - CONTINUING AUTHORITY OF PLANNING COMMISSION.

The planning commission shall, from time to time, consider and review proposals with respect to changes in or amendments to the Comprehensive Plan and, upon conclusion of such consideration, including a public hearing thereon, shall certify to council their reports on such matters.

1305.08 - DUTIES OF PLANNING DIRECTOR.

The planning director shall keep on file for public inspection, during all regular office hours, two copies of the Comprehensive Plan, including maps, charts, plans and ordinances referred to in this article.

1305.09 - AMENDMENT.

The Comprehensive Plan of the city may be amended from time to time following a report thereon by the planning commission, prepared either upon the direction of council or upon its own initiative.

1309.01 - SHORT TITLE.

This article shall be known and may be cited as the "Thoroughfare Plan, A Section of the Comprehensive Plan of Huntington, West Virginia, 1963."

1309.02 - ADOPTION.

The Thoroughfare Plan and ordinance, maps, charts, plans and reports comprising the Thoroughfare Plan shall be kept on file in the office of the planning director in the City Hall and shall be available for public inspection and examination, the same being marked and designated as "The Thoroughfare Plan Ordinance," and the same is hereby adopted as the "Thoroughfare Plan Ordinance of the City of Huntington" and is hereby referred to, adopted by reference and made a part of this article as if fully set out in this article in accordance with W. Va. Code, § 8-11-4, and also in accordance with W. Va. Code, § 8-24-21.

1309.03 - CONTENTS.

The Thoroughfare Plan of the city consists of a map entitled "Thoroughfare Plan, Huntington, West Virginia, 1962," which shows the location of existing and proposed thoroughfares within the city and its immediate environs and is hereby declared to be a part of this article. Notations, references, indications and other details shown on the Thoroughfare Plan are as much a part of this article as if they were fully described in the text thereof.

1309.04 - DESIGNATION OF THOROUGHFARES; RIGHTS-OF-WAY AND IMPROVEMENT.

The thoroughfares within the city are classified as to width and type in accordance with their function as a part of the thoroughfare system and are designated as arterial, feeder and residential streets, as shown on the Thoroughfare Plan. Such streets are to be provided with the right-of-way widths shown on the plans set out in section 1309.05 and are to be improved as required by the city ordinance providing for the control of the subdivision of land.

1309.05 - POLICIES AND DIRECTIVES.

(a)

Opening and widening of streets. Whenever a street designated on the Thoroughfare Plan is to be platted as a part of a subdivision of land, the right-of-way width designated for such street shall be measured at 90 degrees to the centerline thereof.

(b)

Location of streets. Whenever the locations of streets are indicated on the Thoroughfare Plan as following existing roads or streets or established property lines, they shall conform to such locations; however, streets lying wholly within a subdivision and not designated as following an existing road or property line may be varied in their alignments when such variance promotes the orderly and harmonious planning of a neighborhood development unit in accordance with good site planning principles, and if such alignment provides for the continuity of traffic movement.

(c)

Irregular alignments. Streets which follow irregular alignments or indicate revised alignment, or which are not referenced to established property lines, shall follow in a general manner the alignments, shown on the Thoroughfare Plan. Their alignment shall be subject to detailed surveys which may be made by the owners of land to be subdivided. Such surveys shall be subject to the approval of the planning commission prior to the acquisition of land for right-of-way or the filing of subdivision plats affecting such streets.

(d)

Consideration of public agencies. After adoption of the Thoroughfare Plan and this article, council and all municipal boards, commissions and all other agencies of the city shall be guided by and give consideration to the general policy and pattern of development set out in the Thoroughfare Plan in the authorization, construction, alteration or abandonment of public highways and structures which might interfere with their alignment.

(e)

Issuance of permits. In the case of permits authorized by the city for the erection or alteration of structures and other improvements, permits shall be issued only if the proposed street and thoroughfare rights-of-way, as set forth in the Thoroughfare Plan, will be protected from encroachment and, for planning and zoning purposes, the proposed right-of-way lines will be considered as the front lines of lots and tracts bordering such streets and thoroughfares.

1309.06 - CONTINUING AUTHORITY OF PLANNING COMMISSION.

Subsequent to the adoption of the Thoroughfare Plan, the planning commission may:

(a)

Determine lines for new, extended, widened or narrowed thoroughfares in any portion of the city.

(b)

Certify to council the amended or additional plans under the same procedure as established for the certification and approval of the Thoroughfare Plan.

1309.07 - AMENDMENT.

In addition to the provisions of section 1309.06, amendments to the Thoroughfare Plan and this article may be made by council following a report thereon by the planning commission, prepared either upon direction of council or upon its own initiative.
